Secretary of Defense Mark Esper broke with his superior, President Trump, this week saying he opposes using the US Military against the violent far left mobs in cities across the United States.

Via WGN — Esper told reporters the Insurrection Act, which would allow Trump to use active-duty military for law enforcement in containing street protests, should be invoked in the United States “only in the most urgent and dire of situations.” He declared, “We are not in one of those situations now.”

For a week now leftists, looters, thugs and Black Lives Matter have destroyed and torched businesses and government buildings across the country.

Now this…
Secretary Esper ordered the National Guard troops sent to Washington DC to NOT carry any guns or ammunition.

Esper also ordered all active-duty troops out of Washington DC.

Esper reportedly made this order without consulting the White House.

Secretary Esper is now putting National Guardsmen in danger.

He was also thrown out of a Princeton fraternity by George W. Bush.

10 U.S.Code #7894.Art.94:

Any person subject to this chapter who with intent to usurp or override lawful military authority, refuses in concert with any other person, to obey orders or otherwise do his duty or creates any violence or disturbance is guilty of Mutiny.

Esper has disarmed the NG, forcing them to wear soft hats instead of helmets, subjecting them to violence by Antifa. This Deep Stater is working in concert with the Mayor of DC who canceled their hotel stay, forcing them to sleep on parking lots. She defaced 16th ave. with bright, yellow paint to support Black Lives Matter/Antifa terrorists.

AG Barr subsequently swore into service the NG soldiers from FloridA, 53RD. Infantry Brigade Combat Team declaring them now US Marshals. This puts the Brigade under his authority and removes them from Espers authority.

Upon enlisting in the United States Armed Forces, each person enlisting in an armed force (whether a soldier, sailor, coast guardsman, airman, or Marine) takes an oath of enlistment required by federal statute in 10 U.S.C. § 502. That section provides the text of the oath and sets out who may administer the oath:

§ 502. Enlistment oath: who may administer

(a) Enlistment Oath.— Each person enlisting in an armed force shall take the following oath:

I, (state name of enlistee), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. (So help me God)."

Or, if enlisting in the National Guard:

I, (state name of enlistee), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and of the State of (applicable state) against all enemies, foreign and domestic; that I will bear true faith and allegiance to them; and that I will obey the orders of the President of the United States and the Governor of (applicable state) and the orders of the officers appointed over me, according to law and regulations. (So help me God)."

The US Constitution & Oath of Office supersedes the statute you quoted.

Esper is law abiding Oath-Keeper, the president is a scofflaw who violates his Oath of Office & the US Constitution every day.
