Operations conducted by Border Patrol and Immigration and Customs Enforcement have taken center stage this month after agents from each agency fatally shot a U.S. citizen. Alex Pretti, 37, was shot and killed by Border Patrol on Saturday after agents removed his holstered firearm, which he had a permit to carry. After disarming him, agents shot him 10 times. Earlier this month, ICE agent Jonathan Ross shot 37-year-old Renee Good three times as she drove away from agents. The shootings came as the Trump administration ramped up deportation efforts in Minnesota and elsewhere across the country. Immigration agents have been seen raiding establishments where they suspect undocumented workers are employed or looking for work. That includes various Home Depot locations, where federal agents have rounded up day laborers looking for work. On Monday’s edition of The Sean Hannity Show on Premiere Radio Networks, Hannity, who is also a Fox News host, criticized the Democratic Party’s immigration policies, but added that such raids are ill-advised: Poster Comment: FU Hannity you POS! Legally, constitutionally, with due process. Pretti was not an alien, he was blinded by pepper spray and disarmed before he was shot ten times. He was being disruptive and should have gotten off the road and not interfered with ICE. It looks like they disarmed him and in the process of disarming him the gun he had went off. I read that gun is notorious for going off easily without firing it on purpose. One agent a second or a few before that yelled weapon. When the agents heard the gunshot in micro seconds they reacted and shot him thinking was coming from him. Tragic honest mistake. What does that mean legally, I don't know. To: A K A Stone (#5) The incident starts with an agent shoving a woman violently and sending her sprawling. That was not an attempt to arrrest, nor was it part of any known policing procedure. It raises questions about his not acting within the limits of his position, thereby losing his qualified immunity. Pretti should have not gone on the road but he did not interfere with ICE. Interfering or impeding would be a misdemeanor that and would not justify the use of lethal force. He was not shot ten times for jaywalking. When the woman was shoved, he went to her aid. Pretti was pepper sprayed from behind — twice. He was not confronting the officer, he was facing the woman. Pretti was then tackled from behind and taken to the ground. It is likely Pretti was (temporarily) blinded by the pepper spray. When the officer's pepper spray ran out, and Pretti was taken down to the ground, the officer is seen beating Pretti in the head with what appears to be the canister. Pretti was lawfullycarrying in the small of his back. He never brandished or went for his weapon. The Sig Sauer P320 was alleged to have allowed unintentional fire in 2017. Pretti was struck only with rounds from two Glocks. DHS has released no information on whether the Sig was fired or not. The available video does not establish whether there was a discharge of that weapon or not. I believe the call of "weapon" was immediately after an agent reached in and removed the weapon and took it away to a vehicle where it was later photographed. Apparently, one officer observed the other removing the weapon. I believe someone reacted to the cal of "gun," but it would also be consistent with a discharge from the Sig. For each shot there must be a determination about the use of lethal force. The officer must reasonably fear for his life at the time the shot is taken for each and every shot. Having a reasonable fear at the time of the first shot will not justify continuous shooting until the magazine is empty. It is beyond question that at the time of the first shot, and for all the shots, there was no actual lethal threat to any of the officers. The reasonable fear to justify lethal force must arise from what the firing officer observes and hears, not hearsay. When the shooting ended, officers who returned to the body were heard frantically asking, "Where's the gun? Where's the gun?" Those officers apparently did not see the gun removed and taken away, and never saw the gun at all. Standard police policy would be to aim for center mass. It is not standard to go for a head shot from behind. I hear ten gunshots. Various sources claim ten to twelve. For at least the last six shots, Pretti was unresponsive as they continued to pump shots into his apparently dead body. It does not look like a righteous shoot, but rather as a group of poorly trained CBP officers who panicked and shot in the absence of any lethal threat. The call of "gun" does not necessarily imply that the observed gun is being wielded in the hands of the subject. It implies that a gun has been seen somewhere on the person of the subject. A call of "gun" is hearsay until the the officer hearing the call observes that there is a gun. It is not a threat of imminent lethality until it is observed being wielded by the subject. Bad precedent would be set if the cops could enter any scene, have one of them call "gun," and that would justify all of them to open fire. Adding to the problem for the administration were the over the top performances of Kristi Noem and Gregory Bovino. Separately, each evidently read from a script by Stephen Miller. Each said Pretti was a "dangerous individual" who planned or intended to “massacre law enforcement.” Each claimed that Pretti entered or came to "the United States with the intent to kill police officers.” Each asserted that DHS had "credible intelligence" that Pretti was “armed and prepared to carry out an attack.” Each claimed law enforcement “stopped a massacre before it happened.” All of that was make-believe bullshit. Noem has since attempted to shift responsibility to Miller and Trump, for the words she said. Any credibility the administration had was shredded. While the problem is much deeper than just public relations, the administration faces a public relations nightmare. They are doing their utmost to cover up the non-release of the Epstein Files as required by law signed by Trump. They are doing their utmost to prevent any state investigation of the Renee Good shooting. That fatal shot was through the open driver side window, entering the left temple and exiting the right side of her head. The shot was taken while Officer Ross stood three or four feet back from the side of the vehicle as it was pulling away, and he was in no threat to his life. And now they have acted to prevent any state investigation of the Pretti shooting, and turned over the investigation not to the FBI, but to Homeland Security which does not normally perform criminal investigations, and has no crime lab. Whether it is MacDonald and Rich, or a liberal a few years later, it matters in forming public opinion, and public opinion sure matters to politicians and what they choose to do. Think of how Trump's comments on 2A go against RKBA. It's really bad to carry at a protest. The main point of 2A was to enable defense against out of control expansion of centralized federal power. That sort of implies carrying when confronting federal power. 2A was not primarily intended to keep you safe from unruly WalMart shoppers.
