Subject: Blackwell Locks Down Ohio Voting Records

Ohio Election Investigation Thwarted by Surprise Blackwell Order

Dayton, Ohio Friday December 10, 2004

On Friday December 10 two certified volunteers for the Ohio Recount team assigned to Greene County were in process recording voting information from minority precincts in Greene County, and were stopped mid-count by a surprise order from Secretary of State Blackwell’s office. The Director Board of Elections stated that “all voter records for the state of Ohio were “locked- down,” and now they are not considered public records.”

The volunteers were working with voter printouts received directly from Carole Garman, Director, Greene County Board of Elections. Joan Quinn and Eve Roberson, retired attorney and election official respectively, were hand- copying voter discrepancies from precinct voting books on behalf of the presidential candidates Mr. Cobb (Green) and Mr. Badnarik Libertarian) who had requested the recount.

One of the goals of the recount was to determine how many minority voters were unable to vote or denied voting at the polls. Upon requesting copies of precinct records from predominantly minority precincts, Ms. Garman contacted Secretary of State Blackwell’s office and spoke to Pat Wolfe, Election Administrator. Ms. Wolfe told Ms. Garman to assert that all voter records for the State of Ohio were “locked down” and that they are “not considered public records.”

Quinn and Roberson asked specifically for the legal authority authorizing Mr. Blackwell to “lock down” public records. Garman stated that it was the Secretary of State’s decision. Ohio statute requires the Directors of Boards of Election to comply with public requests for inspection and copying of public election records. As the volunteer team continued recording information from the precinct records in question, Garman entered the room and stated she was withdrawing permission to inspect or copy any voting records at the Board of Elections. Garman then physically removed the precinct book from Ms. Roberson’s hands. They later requested the records again from Garman’s office, which was again denied.

Ohio Revised Code Title XXXV Elections, Sec. 3503.26 that requires all election records to be made available for public inspection and copying. ORC Sec. 3599.161 makes it a crime for any employee of the Board of Elections to knowingly prevent or prohibit any person from inspecting the public records filed in the office of the Board of Elections. Finally, ORC Sec. 3599.42 clearly states: “A violation of any provision of Title XXXV (35) of the Revised Code constitutes a prima facie case of election fraud within the purview of such Title.”

Green Party presidential candidate says Republican Secretary of State is stalling.

Green Party presidential candidate David Cobb today filed counterclaims in the United States District Court for the Southern District of Ohio against Republican Secretary of State Kenneth Blackwell, asserting that Blackwell is stalling the Ohio recount and abusing his authority. The counterclaims have been alleged in pending litigation in federal court which originated in Delaware County, Ohio, when that county's board of elections asked a local state court judge to stop the recount in Delaware County. The state court judge issued a temporary restraining order attempting to prevent Cobb, Libertarian Michael Badnarik and their attorney's from seeking a recount of the presidential ballots cast in that county.

On Tuesday, Cobb asked a federal court to take jurisdiction in the case. The Kerry-Edwards campaign also moved to intervene in the case in defense of Cobb and Badnarik's position.

The suit filed today by Cobb, Badnarik and the National Voting Rights Institute alleges that Blackwell is abusing his discretionary authority and is, in effect, stalling. The suit asks that the recount begin immediately and be completed by the federally declared "safe harbor" date of December 7 and by December 13, when the presidential electors are scheduled to meet. The suit also demands that Blackwell not declare the results of the election as official and final and that the presidential electors not be certified until the recount has been completed.

Legal filing highlights Blackwell's hypocrisy in Ohio recount case by Blair Bobier March 7, 2005

A spokesman for the Green Party's 2004 presidential campaign, which initiated the Ohio recount, today blasted the suggestion by Ohio's Republican Secretary of State J. Kenneth Blackwell that he would need to take depositions from John Kerry and John Edwards as part of the Ohio recount litigation.

"Mr. Blackwell's contention that he needs to depose Senators Kerry and Edwards is a laughable and blatantly political move. Mr. Blackwell has refused to be deposed himself about the Ohio election, has refused to appear before Congress and has refused to answer questions from members of the House Judiciary Committee who have been investigating allegations of election fraud. To suggest that Kerry and Edwards should be deposed to address a legal technicality while Mr. Blackwell continues to avoid any public scrutiny of his own misconduct in the Ohio election is the height of hypocrisy," said Blair Bobier, Media Director for the 2004 Cobb-LaMarche campaign.

The report by the House Judiciary Committee's Democratic staff on the Ohio election and recount states that "there were massive and unprecedented voter irregularities and anomalies in Ohio. In many cases these irregularities were caused by intentional misconduct and illegal behavior, much of it involving Secretary of State J. Kenneth Blackwell, the co-chair of the Bush-Cheney campaign in Ohio."

Blackwell's intention to depose Kerry and Edwards was made known by Ohio Attorney General Jim Petro in the latest round of legal filings concerning the Ohio recount. In February, Federal Judge Edmund Sargus in Columbus asked the parties in the Ohio recount case to submit filings to his court addressing whether the litigation should be transferred and consolidated with a Toledo case brought last November seeking to expedite the start of the recount. Blackwell's filing was in response to that request.

Attorneys for Green Party presidential candidate David Cobb and Libertarian Party presidential candidate Michael Badnarik, who jointly requested the Ohio recount, have already filed their response to the Judge's question. Kerry and Edwards, through their Ohio attorney, filed a one sentence statement with the Judge supporting the Cobb and Badnarik position. Kerry's lawyer also filed a short, two page summary charting inconsistencies observed by Democratic Party witnesses to the recount.

The matter is pending in the Eastern Division of the United States District Court for the Southern District of Ohio, before Judge Sargus.

Conferences, lectures and teach-ins about the Ohio election and electoral reform have been taking place all over the country, most recently in Santa Monica, California on Sunday.

Election officials finished the presidential recount in Ohio on Tuesday, with the final tally shaving about 300 votes off President Bush’s six-figure margin of victory in the state that gave him a second term. The recount shows Bush winning Ohio by 118,457 votes over John Kerry, according to unofficial results provided to The Associated Press by the 88 counties. Lucas County, home to Toledo, was the last to finish counting. The state had earlier declared Bush the winner by 118,775 votes and plans to adjust its totals to reflect the recount later this week.

The Kerry campaign supported the recount, but said it did not expect the tally to change the election winner. Supporters of the recount, requested by two minor party candidates, said they wanted to make sure every valid vote was counted.

Ohio 2004, like FL 2000, never had a complete recount done as mandated by law and in Ohio 2004, like FL 2000, the recount process was steered by the head of Boy Blunder's campaigns.

FL was just a naked power grab...Ohio was a little bit more creative...they just took from Column A and added to Column B or they simply just didn't add on to Column A and then, as those facts began to be discovered, Blackwell shut it down.

Total Philly votes cast: 643,463

So Kerry got 4.14 votes for every 1 Bush vote in Philly (an absolutely astounding number - even heavily democratic Broward Country, Fl only went for Kerry 2:1 and heavily democratic Cook County, IL went for Kerry 2.5:1)

Some conclusions:

1. Even as Philadelphia looses population, the number of registered voters continues to increase

2. Nearly every person of voting age is registered to vote (as compared to a national average of 50% by the Census Bureau )

3 The total lopsidedness of the vote is an astounding number to believe

4. Either Philadelphia has the most engaged and civic population in the WORLD, or there is massive fraud.

5. The amount of fraud easily exceeds the margin of loss of President Bush. If Bush had won Pennsylvania, it would have been a landslide.
