A 26-year-old woman who was raped in broad daylight on a West Toledo street spoke out yesterday, saying that the 15-year-old boy charged with the crime should be tried as an adult.

"He knows better and he did a heinous act," the woman told The Blade in an exclusive interview.

"This is an adult crime and he knows better than to do it. He's old enough to. If you do an adult crime, you should do adult time," she said.

Anferney Fontenet, 15, of 1656 Shady Drive, was charged with juvenile delinquency in connection with rape and robbery.

The teenage suspect confessed when he was arrested about 12 hours after the crime, Toledo Police Sgt. Sam Harris said.

The Blade does not identify victims of sexual offenses.

None of those who witnessed the sexual assault on Royalton

Road stopped as they drove past, but their 911 calls and descriptions of the assailant ultimately led police to the Start High School freshman, Sergeant Harris said.

"We are afraid he is going to get out of jail when he is 18 and walk free," the victim's mother said. "This is an adult crime, a very flagrant and blatant crime, and we are still pretty stunned here."

Police said the Fontenet youth had left school early and was walking about six blocks from his home when he approached the victim on Royalton Road at Lyman Avenue about 2:30 p.m. Tuesday.

The victim lives in a group home and has bipolar disorder and Asperger's syndrome, an autism spectrum disorder that can affect social interaction, according to her mother.

The victim said she sometimes uses a cane because she has "really bad balance."

The victim was walking to the West Toledo branch library from a friend's house when she noticed someone following her on Royalton, she said.

He approached her and said he would pay her to perform a sex act.

"Finally he grabbed me by the jacket and pulled out a pair of scissors and said if I made a sound he would cut me," she said.

The Fontenet youth told police that he was carrying the scissors "for protection against other people," Sergeant Harris said.

The assailant held the scissors to the victim's chest.

She said she feared for her life and complied when he ordered her to her knees. He pulled down her sweatpants and sexually assaulted her, the victim said.

"I don't know how long it was happening. It just seemed like a blur and a bad dream," she said.

Yelling for help She yelled for help during the attack and said she noticed at least two cars drive by without stopping.

After the assailant fled, she asked a pedestrian talking on his cell phone if she could use the phone to call for help.

He kept walking, she said.

"I'm ticked off because people were doing nothing. Just driving by. What kind of humans are we becoming?" she said.

Calls about the incident indicated that the witnesses were unsure if the public act was consensual, though officers were dispatched to a "rape in progress," Sergeant Harris said.

The teen did not know the victim and the assault was not premeditated, Sergeant Harris said.

"The urge came over him to attack her, and he said he did," Sergeant Harris said. "It was a crime of opportunity."

The assailant took the victim's cell phone and fled before emergency crews responded to the witnesses' 911 calls.

The victim was taken to Toledo Hospital.

Through descriptions of the assailant provided by the victim and witness, the Fontenet youth was arrested at his home about 2 a.m. yesterday, Sergeant Harris said.

Investigators from the Northwest Ohio Violent Fugitive Task Force assisted Toledo police, Sergeant Harris said.

Lucas County Juvenile Court Magistrate Susan Cairl set a trial for 8:30 a.m. Feb. 2.

Juvenile Court Administrator Dan Pompa said the teenager had no previous arrests and no contact with the court.

"We've never seen him," he said, adding that it's highly unusual for a first-time offense to be of such a violent nature.

Court officials will decide before tomorrow whether to pursue adult charges, said Lori Olender, a Lucas County assistant prosecutor.

Those who live near the Fontenet youth said he wasn't known to cause trouble in the time he's lived in the neighborhood. They said his family moved into their Shady Drive home last summer.

A neighbor, who declined to be identified, said his 16-year-old son often played catch with the boy.

Gwen Chubner, who lives three doors down from him, said the boy sometimes asked her for cigarettes for his mother and generally "acted like a normal kid."

The neighborhood Some neighbors closest to the intersection of Royalton and Lyman said they didn't hear calls for help and didn't see the assault.

Pete Smith, whose living-room window in the 4200 block of Lyman overlooks the scene of the assault, said he was home during the attack but the only noise he heard Tuesday afternoon was a utility digging into the ground.

Many residents have been concerned about their security, as home burglaries and thefts have seemed to increase lately, neighbors said.

Maria Dahmoun, who lives two houses away on Lyman, was not at home at the time of the assault. She said she had a security system installed at her home a few days before.

She said neighbors generally look out for each other here and was disappointed to learn that no one had stopped to help the victim.

"I'm a woman, and if I had seen it happen, I'd have grabbed my baseball bat," Mrs. Dahmoun said.

Karen Kain, also on Lyman, said she's seen teenagers fighting on the street but "nothing like this."

She was home during the incident but didn't see or hear anything.

Mrs. Kain said she wondered why "with people driving by, nobody rolled down their window and said, 'Hey, do you need help?'•"

The victim said she grew up in the neighborhood, and that it wasn't the first time she was attacked here.

She was once robbed by several youths who struck her over the head with a skateboard before emptying her pockets, she said.

An unusual case

Last year, 135 sexual assaults in Toledo were recorded by the FBI.

But that number may not reflect the actual number of nonconsensual sex acts in the city, Sergeant Harris said. Because the FBI only counts nonconsensual intercourse between a man and woman in the statistics, the actual number of sexual assaults may be closer to 500, Sergeant Harris said.

Regardless of the recorded number of rapes, the circumstances of this one were unusual, he said.

"I've never had one which happened on the side of the road at 2:30 in the afternoon," Sergeant Harris said.

Juvenile cases of sexual assault typically involve an act between family members or acquaintances, Ms. Olender said.

"The way it happened is not our normal rape that we would have, it's not usually a stranger rape," Ms. Olender said.

The victim said she's coping with the rape by talking to friends, her Zepf Center case worker, and crisis counselors.

"I think I'm doing great, I haven't snapped down into tears yet. I just want this scumbag off the streets," she said, adding that the attack won't stop her from walking alone to the library again.

She said she plans to be in the front row for his trial.

"I would really be disgusted with the court system if they don't lock him up. I think he should be treated as an adult and a registered sex offender," she said. (1 image)
