FACT: It is illegal in the United States to sell, offer for sale or promote via any means that touches interstate commerce (which would include any communications form that crosses a state line) any drug or device intended to treat, prevent or cure any disease or disorder of the human body without proof in the form of random clinical trials which are then submitted and analyzed by the FDA. This is controlled under the Food, Drug and Cosmetic Act (Title 21 USC.) The government goes after sellers of supplements and devices on this basis all the time. The law is crystal clear in this regard; both safety and efficacy must be scientifically proved, reviewed and then formally approved by the FDA.

FACT: There are protocols for "compassionate use" and similar for drugs and devices in the pipeline for approval, or approved in other nations, but such are specific to an individual person and circumstance (e.g. in the event of a terminal illness) and cannot be ordered as either a "standard of care" nor ordered against someone's expressed desires.

FACT: Flu-like illness (ILI) kills roughly 60,000 Americans a year. As a result of that significant toll of death and disease we have studied the means by which such transmission can be modified or interrupted entirely for roughly the last 100 years dating all the way back to the Flu Pandemic of 1918, including but certainly not limited to random clinical trials, both in health care settings and in the general population.

FACT: There are multiple random clinical trials that have been performed on the efficacy of face coverings of various sorts, from N95 masks on down to cloth coverings in the general population with the aim of identifying effective means of controlling the spread of ILI ("influenza like illness"), specifically respiratory viruses.

FACT: There is NO record established by said Random Clinical Trials (RCTs) in over one hundred years, including those performed in the last 20 years, that establishes statistically-significant effectiveness of face coverings for the prevention of transmission of ILI. Exactly zero science supports such a claim.

FACT: As a direct result of the lack of such evidence the FDA has never issued an approval for any facial covering intended to be used in the general population for the suppression of any illness, including but not limited to Covid-19. In fact I suspect no such approval has ever been sought, otherwise someone would have tried to make money on a "flu mask", making such a medical claim, in previous years.

FACT: It is therefore UNLAWFUL under United States Law for any seller to advertise, market, sell, vend or represent that any facial covering in fact does or will prevent, treat or cure any transmissible disease whatsoever as exactly zero said devices when used by the general population have ever been certified and approved for said use. THIS IS FEDERAL LAW (TITLE 21) AND IS NOT A SUGGESTION.

This is why every package of N95 masks at the Home Deport (and elsewhere) has the clear statement on the "use document" that comes with it which states it does not prevent the transmission of any disease.

To not so-state would be a violation of federal law.

It is thus likewise impermissible for any element of a State or Local Government to mandate the use of a device that is not FDA approved for such a purpose since it is flatly against the law to recommend or so state that an unapproved drug or device is safe or effective to cure, treat or prevent any disease.

Such a government entity is in fact mandating a direct violation of United States Federal Law and committing said violation itself through promotion of said use.

I haven't worn a mask once as yet. In ace hardware some guy called me a dick and I told him I would beat his ass if he said it again. He shut up. In the local convenience store I went mask free no questions. They just passed a mask color of law thing here. I don't like confronting people but I will. Matthew 10:40-42 –

Jesus commands us to care about the welfare of others for the sake of the other. There seems to be two kinds of Christians in the world today. There is the Christianity that is worried about personal salvation and maintaining a personal relationship with Jesus so that at the end of their life they will receive their promised reward. Then there is the other form of Christianity that takes salvation and relationship seriously, but also the call to discipleship and the command to care for others. All are brothers and sisters in Christ, but see their function in God’s family quite differently.

When we look at the gospels, Matthew, Mark, Luke and John, it is quite obvious where Jesus places the most emphasis during his earthly ministry and that is in helping others. Jesus heals the sick, feeds the hungry, preaches good news to the poor, and demonstrates how to live as children of God in a world dominated by self will. To those that only look inward and worry about their righteousness without looking around themselves, well they are missing the mark by a long shot. The whole point of Jesus is that he takes care of our salvation and empowers us so we can focus on the welfare of others.

Jesus understood better than we do, which is why I remind you again that he instructed his disciples, and us, to be wise as serpents and gentle as doves. We aren’t called to be idiots, but we are called to be gracious. So, where is that line? It is on a case by case basis, but it doesn’t stop the overall purpose and direction of our ministry.

Is there a line that Christians can’t cross when it comes to caring for the welfare of others? Does it mean that we advocate for the health and welfare of all people? Does it mean that we work towards the betterment of our community, culture, country, world? I would say the line is the one drawn by the cross of Jesus Christ. Christ gave his life for the welfare of others and the world. Over and over Jesus tells us that if we want to be his disciple we are to pick up our cross and follow him. What is the limit of the cross? There is no limit. As our Creed tells us, even hell wasn’t a line Jesus was afraid to cross. So is there a line? No, as long as we adhere to the principles and teachings of Jesus and stay true to his methods there is no line.

However, once we swerve off course and decide that we know a better way to achieve God’s goals and they veer away from the teaching of Jesus then we become like those who are more focused on their agenda and less focused on Jesus’ ministry. Those who work for and care about the welfare of others because only when we care fore and love all is God’s mission in full swing. Let us be the courteous and loving of Jesus’ message that we are called to be for the sake of others because we were lucky enough to be called and sent, which is reward enough.

I just noticed something. Gatlin's anti-mask stance is identical to Biden's, Newsom's, Whitmer's....just about every Democrat politician has echoed Gatlin's demand that everyone mask up. Even Cheney (who is 100% anti-Trump.)

And Trump has defiantly refused to wear a mask and has yet to make wearing a submission mask mandatory.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

ALL power resides with the people. Everything not delegated to the Federal government was reserved to the People except for what they have delegated to their State. The People of each State can delegate as much of their power as they choose to the State. Precisely what is delegated, and to what specific official, varies by State. Your question amounts to Do the People "the power to issue an emergency proclamation/order with the force of law to require face masks use during a pandemic" and impose that requirement upon themselves, and have they delegated that power to the Governor or another official?

State Emergency Powers Acts usually contain a grant of general authority to either the Governor or a Public Health official. An Act of the People's representatives in the legislature is considered an Act of the People. If they do not want their grant of authority to be general and broad, encompassing damn near anything and everything, they need to change their law which delegates their authority.

Yes, but it cannot close the churches and keep the bars and marijuana dispensaries open, without running afoul of religious discrimination law. De Blasio's closing of churches (and playgrounds, etc.) while supporting BLM protests is an example of legal stupidity. The government can declare a quarantine, but not an irrational selective quarantine.
