Two Asbury Park police officers donned disguises to exact revenge on a citizen who filed a complaint against them by slashing the tires on two of his vehicles, authorities announced Wednesday.

The Monmouth County Prosecutor’s Office charged officers Stephen Martinsen, 29, and Thomas Dowling, 26, both of Asbury Park, with conspiracy, criminal mischief and weapons offenses. The officers are accused of vandalizing two vehicles in Ocean Grove and Asbury Park early on Sept. 3, authorities said.

“It is alleged that officer Martinsen and Special Law Enforcement officer Dowling did purposely damage both vehicles, both owned by the same person,” a press release from the Monmouth County Prosecutor’s Office said. “The vehicle owner had filed an administrative complaint against both officers several days before the vandalism incidents.”

Authorities said the two officers wore disguises when they rode their bikes to the vehicles, smashed out windows and slashed all the tires.

The victim, Ernest Mignoli, is an outspoken critic of Asbury Park and its police department. In an interview with NJ Advance Media, he said his “jaw dropped” when he learned that the people responsible for damaging two of his vehicles — a white Jeep Liberty and a Toyota Prius — were police officers.

“I just wouldn’t think it would be in the scope of police officers to do something like that,” he said. “I’m a concerned citizen, outspoken critic of Asbury Park Police Department. But this goes behind the pale.”

Mignoli would not comment on the nature of the administrative complaints he filed. But he said he’s constantly keeping a watchful eye on the police officers in the city he has lived in for 12 years.

“I’m constantly harassed by police wherever I go," he said. “It’s just the nature of my work.”

Martinsen, a member of the Asbury Park police force since 2013, has been suspended without pay. Dowling was fired.

Asbury Park police Chief David Kelso said in the press release that the actions of these two officers “is not acceptable and does not represent the level of professionalism, community focus or resident safety that we expect of our officers.

“We will not let the actions of these officers overshadow the great work and dedication by the men and women of this department,” he said.

The officers could not be immediately reached for comment.

If it isn't acceptable, then why didn't he fire both officers.

His own actions demonstrate that it is acceptable to him to employ a known vengeful vandal on his police force.

“We will not let the actions of these officers overshadow the great work and dedication by the men and women of this department,” he said.

Ah, the comedy routine. But this action and his weak non-response to it is exactly what does undermine any confidence in the "great work" of his departmenet. I like how he tosses in the "men and women of this department" as a reminder that they are female-friendly employers. But why drag the women cops into it when it was only male cops committing this crime? Just misdirection and standard PR folderol. I suppose these puny PD police chiefs have some standard list of excuses and propaganda they issue at such press conferences.

The chief isn't sorry at all. He's only sorry that he has to hold this embarrassing press conference about his officers committing premeditated property destruction against citizens and then had to admit he only fired one of them, not both. And if both donned disguises to commit their crime, it was premeditated by both perps and it was equally the fault of both. So why fire only one of them when both are equally guilty of a premeditated crime? Why? Because it's all a joke. The chief is a joke, the PD is a joke, the town is a joke. They just don't like it when evidence like this is produced to demonstrate just how ridiculous they are.

Stephen Martinsen, 29, and Thomas Dowling, 26

Martinsen has 2 years on the force according to pension records and earns $40,635 salary. If they get the usual stalls in court for six months or so, he could collect another $20K in salary for stay-home pay. That's a lot of loyalty for the chief to demonstrate for someone who only had 2 years on the job with vandalism and prosecution as the high point of his brief career.

Dowling is a Class 2 Special Officer. Apparently this not a full-time cop, typically picking up hours and pay during the tourist season around beaches and tourist attractions when the big crowds come in summer. IOW, a part-time beach cop of some kind.

As for charges:

Prosecutor Christopher Gramiccioni said he could not speak to the nature of the internal affairs complaint, in an interview Wednesday.

Gramiccioni did say that Dowling and Martinsen are believed to have disguised themselves before riding bicycles to the victim's cars and slashing tires.

Dowling, Gramiccioni said, is believed to have put a hand through a window, cutting himself.

Though neither man is facing any charges of official misconduct, Gramiccioni said that possibility is not off the table.

"We'll see where this case goes," Gramiccioni said. "If the state's feet is held to the fire and we go to a grand jury, there's probably a strong possibility you'll see official misconduct charges."

An official misconduct conviction would carry a five-year mandatory minimum prison sentence, Gramiccioni said. If convicted of all the charges they are currently facing, each man could face up to 26 years in prison apiece.

So, the prosecutor is already saying it will amount to nothing unless people are riled enough or some political pressure brought to bear and only then will he end up taking it to a grand jury to prosecute as a criminal offense. Otherwise, it's probably less serious than a cop getting a ticket for spitting on a sidewalk. Clearly the prosecutor is saying that there will be no criminal prosecution at all unless "the state's feet are held to the fire". He should be fired simply for making a statement so damaging to his own case.

Well, let’s just take time to look into that …

It should be ever so easy to understand that the chief was making an “assumptive statement.” An assumptive statement is just that – it “assumes” and in doing so, it cannot be that assumption ever overrides the “presumption of innocence.” The presumption of innocence is undoubtedly one of the most sacred and cherished principles in our criminal justice system, holding that a defendant is innocent until proven guilty. In other words, each essential element of the crime charged must be proved beyond a reasonable doubt.

Furthermore, an internal affairs investigation must be ongoing since there is no mention in the article of its completion. Internal affairs is required to investigate incidents and possible suspicions of law-breaking and professional misconduct attributed to officers on the force.

So, if the chief were to act impulsively – like you appear to me to be doing with your over reactive premature condemnation – on an “assumption” and fire the two officers who were later found innocent in court, then the city would be face a lawsuit involving a major dollar payout. Uh, It has happened.

I hope that I have been of some assistance to you in finding an answer to your heartfelt question – “why didn't he fire both officers” – expressing deep your deep concern.

In closing, let me please say that I always work on the “presumption of innocence” while I far too often find there are those who work on the “presumption of guilt.”

Presumption of guilt is “the principle that one is considered guilty unless proven innocent: thus the burden of proof is on the accused, not the accuser. Presumption of guilt is a denial of an international human right under Article 11 of the Universal Declaration of Human Rights."

So the chief knows that they have evidence that both engaged in premeditated retaliation and domestic terrorism via pointed property vandalism against a citizen.

But he only fired one. Nothing you wrote explains why he fired only one and not the other.

Yet, strangely, most readers here at LF would think you operate on "presumption of guilt" unless the accused are cops.

Of course, misterwhite leaves you in the dust when it comes to fellating police criminality.

And, interestingly, GI has a more nuanced view on policing than either of you even though he is a passionate guy with a long long career dealing with the constant need to deal with real shitbirds while respecting their rights.

The contrast is what draws my notice.
