July 24, 2019 (LifeSiteNews) — The Minnesota mother whose son was maneuvered through a “sex change” by county officials has asked the U.S. Supreme Court to review her case. She is charging the government with usurping her parental rights when its agents provided her son with transgender services and narcotic drugs against her wishes.

The Thomas More Society petitioned the High Court Wednesday on behalf of Anmarie Calgaro, arguing that Calgaro’s due process rights were “trampled on” when St. Louis County and its referred health providers “ended her parental control over her minor son without a court order of emancipation.”

“It’s a parent’s worst nightmare,” Thomas More Society special counsel Erick Kaardal said. “Anmarie Calgaro’s child, while a minor, was steered through a life-changing, permanent body altering process, becoming a pawn in someone else’s sociopolitical agenda and being influenced by those who have no legal or moral right to usurp the role of a parent.”

Calgaro sued state agencies and health providers in federal court in 2016 for terminating her parental rights without due process after her minor son was given elective medical services for a so-called “sex change” without her consent or a legal order of emancipation.

Her suit said the state’s entities decided on their own that the then-17-year-old boy was emancipated.

The defendants handled Calgaro’s son as an emancipated minor even though there had been no court action to that effect, the Thomas More statement says. Neither the school district, the county, nor any of the medical agencies named in the lawsuit gave Calgaro any notice or hearing before ending her parental rights over her minor child.

A district judge dismissed Calgaro’s lawsuit in May 2017, admitting that the boy was not legally emancipated by a court order but ruling that Calgaro’s parental rights “remained intact.” The Thomas More Society says the judge decreed that the de facto emancipation of Calgaro’s minor son by the county, school, and medical care providers did not constitute an infringement of constitutionally protected parental rights.

The case was appealed in July 2017 and the district court ruling upheld by the 8th Circuit Court of Appeals in March of this year.

St. Louis County decided without any basis that Calgaro’s son was emancipated and could receive government benefits, even though Calgaro was a “fit parent” who objected to their actions, the legal non-profit’s statement on the Supreme Court filing said.

“Unbelievably, Minnesota statutes authorize a county to deem a minor ‘emancipated’ to receive welfare payments to live on their own and allow medical providers to void parental input if it determines the minor is living apart from the parents and is managing personal financial affairs,” said Kaardal.

“And the St. Louis County School District in Minnesota has a custom and practice of barring a parent from involvement in the child’s education for more than two years after a child is deemed by the school principal, not by a court order, to be emancipated,” he said. “This is an unacceptable situation for any parent and a serious violation of parental and due process rights.”

Minnesota’s language regarding emancipation is vague, and state law presents no procedural due process rights for “fit parents,” according to Kaardal, even though it does so for those deemed unfit.

“Why wouldn’t we make this same effort for fit parents?” he asked.

Kaardal said he was concerned in particular about the conflict in Minnesota’s legal statutes.

“The U.S. Court of Appeals ignored the major disconnect in the District Court decision where the mother’s parental rights are admitted but not honored, and the ridiculous claims that the agencies which have violated Calgaro’s rights did nothing wrong,” he stated. “The United States Supreme Court now has the opportunity to untangle this incompatible and untenable scenario; so, nationwide fit parents can keep parenting without governmental interference.”

“Under federal law, the right to parent is considered an unenumerated right, protected from governmental interference by the Due Process Clauses of the Fifth and Fourteenth Amendments,” said Kaardal. “The “liberty” of the Due Process Clauses safeguards those substantive rights “so rooted in the traditions and conscience as to be ranked as fundamental.”

The U.S. Supreme Court reconvenes in October.

Not enough info really.

If the mother was allowing her son to live separately from her home and direct control, it sounds like she opened the door to this legally. It is unlikely those MN statutes were ever intended to apply in such a situation but that some tranny lawyers know how to use the existing statutory language to achieve their objective. And the mother had no real cause to know that she lived in a state that would allow such a travesty of parental rights.

Maybe the lesson is: don't let your minor child live with a grandparent or relative or with the family of a friend or you can easily lose control of them via emancipation, even without a formal court order. And they may even qualify for welfare and other goodies, an incentive to sever parental ties. That is what apparently has happened here.

She should disown her former son and move on with her life. It's a free country after all. He/she can have his/her freedom and so can his/her mother. They don't have to do anything more with each other.

I doubt that Mom will have any legal recourse or settlement for interference in parental rights. Not in Minnesota at least. Strange, too, because Minnesota used to be such a sensible state, so down to earth. They've been radicalized in recent decades. I used to like Minnesotans but now I am suspicious of anyone from that state. Unlike, say, Michigan where I perceive Michiganders as still being Michiganders. Or Hoosiers are still Hoosiers. Some of these states, like Maine, Vermont, New Hampshire were the very definition of rock-ribbed Republicanism. Now they're all a shade of deep Blue as the rotten hippie scum from the Sixties spread from metro areas like locusts along the eastern seaboard.

I don't believe this for a minute. I just can't see surgeons performing this operation on a child,and furthermore,can't see a county spending the money for a sex change for a minor or anyone else.

In the entire history of the world,the only nations that had to build walls to keep their own citizens from leaving were those with leftist governments.

I don't think they've started the actual surgery part yet (penis inversion, etc.). Maybe not even the boob job.

They'd instead be looking at doing the hormones and starting to depilate the male genitals. As you might know, the penis is inverted so a wannabe-girl has to have the shaft of the penis depilated all the way to the base. Otherwise, when they invert the tissue to form a vagina, it would have pubic hair growing inside the #FakeVagina. Ingrown hairs, infections and just a rather obvious #FakeVagina would be the outcome. Similarly, they need to remove scrotal hair with a laser as part of that tissue will be transformed to turn into labia. And hairy labia are pretty obvious, not something that looks natural.

I know it sounds gross but I'm sparing you some of the really ugly details. I'm eating some pizza now and I just can't bear to talk about the really gross stuff while eating a supreme pizza.

I don't believe any US doctor or hospital would even do that to a juvenile. For one thing,their insurance companies would drop them like a hot rock,and can you imagine the joy on the face of any DA with political ambitions (which is all of them) anywhere but San Francisco would have if handed that case?

It just flat isn't possible.

They're doing it right now. And to kids younger than 17. They're doing full sex changes on kids very early now. A woman who leads the tranny movement in England got in trouble because she took her son to Thailand for the full-tranny before he was 16. And we have even fewer safeguards to proetect children against that sort of thing than most European countries do.

There are over 40 of these transgendery clinics operating across the country now. 20 years ago, there was just one. It is a booming industry and lucrative. The depilations, the voice surgeries, all of it represents a lucrative stream of revenue.

It's become an industry. A scummy industry. And the pols and the rest of the medical community won't stand up to them.

The vast majority of these surgeries are unnecessary. These are overwhelmingly kids who can't accept they're gay/lesbian so they turn themselves into a lousy version of a #FakeMale or #FakeFemale. Among the #FakeFemale types, the vast majority become call girls so they don't have to turn tricks as she-male prostitutes and can still fulfill their brain's natural male bent toward promiscuity. A lot of call girls in the major cities were not born female, a dirty trick of the trade. I anticipate that it might eventually become more trannies than actual females in prostitution.

I'm not kidding. I've read a fair amount of studies on these people because they're just so damned weird.

If you want to hear some real sick stuff that you could never imagine, I'll provide a description of the male autogynephilic transsexual types. Along with helpful tips on how a wife can detect if her husband is one of them. Then you have the women who want to become men so they can be gay men. Yes, that's right.

These people need effective psychiatrists to deal with their rejection of their own bodies. Unfortunately, fewer than 15% of all psychiatrists and clinical psychologists are at all effective in treating any kind of mental illness. They're a giant failure and no one ever says anything about it. But they have high status and make a good living from it. Most of them choose that career path to deal with their own personal problems, not to help others.

It has a big YouTube following, a TV show on TLC (including the how-to of emasculation that premiered in January 2019), and apparently is going to have a doll made of her. I think they plan a fifth season of this sickening crap for next year.

It likes boys and wants to be a mother. Isn't that sweet?

Well, the "child" in article under discussion was a 17yo in 2016 when this case occurred. How much over 17, we don't know exactly from the article.

For legal purposes, a "child" is a person under the age of 18. At 18, you can buy liquor, sign documents, enlist, incur debt, get tattooed, abort offspring, etc. Prior to that, it is either forbidden or only allowed with the explicit written consent of at least one parent/guardian or a court.
