Police said they were threatened because he was holding a Coke bottle.

On August 14, Ethan Buckner and his girlfriend, Heather Kryczka, were prepping their dinner when they heard three gunshots outside their apartment.

The Buckners went outside to see what was going on, only to discover Los Angeles police had shot a homeless man in their driveway. 

LAPD said they were responding to a noise complaint from a neighbor when they confronted John Penny, a homeless man who had permission from the property owner to live in the driveway.

Police said Penny was “armed with a bottle” when they first confronted him but the Buckners say they are stretching the truth.

“John didn’t have a weapon, he just had a Coke bottle. And police shot him anyway,” Ethan Buckner posted on Facebook Thursday.

The landlord of the property, a man identified only as Jack, who was present the whole time, tried to deescalate the situation by telling them Penny was harmless but the cops ordered him back inside.

Sounds of the sirens spooked Penny who began panicking about going to jail, according to the Facebook post.

According to Buckner:

“In moments like these, police may try to deescalate, but their very presence (essentially soldiers with guns) is often an escalation by itself. That is exactly what happened tonight. John Penny was triggered by the sirens. Police didn’t need to be there in the first place. When they arrived, they could have used other means to subdue him, but used live fire. This is why we need other ways to keep our communities safe, to protect folks who are suffering, to support people struggling with addiction and mental illness.”

According to Buckner, Jack told him Penny only had a Coca-Cola bottle, but according to the Los Angeles Police Departments press release, it states that Penny picked up a three-foot wooden plank which made them further fear for their lives.

“Penny refused to drop the bottle and approached officers. The officers deployed a taser, however it appears the darts did not strike Penny. Penny then armed himself with a three-foot-long wooden plank and again approached the officers, which resulted in an Officer-Involved- Shooting.”

Penny is recovering from non-life threatening gunshot wounds and is in stable condition while in jail.

Buckner is working on getting Penny released so he can assist the homeless man in getting the proper medical care and justice he deserves.

In a Facebook message interview, Photography is Not a Crime spoke with Buckner and he believes Penny is charged with felony resisting arrest and assault with a deadly weapon and believes he is being held on $125,000 bail.

The police press release does not specify what Penny was charged with but they will probably accuse him of some type of assault against police officers.

***NEW UPDATE*** 8.15 -John is in stable condition recovering from non-life threatening gunshot wounds but is now in jail and being held on $50,000 bail, which is completely unacceptable.

UPDATE 8.14 - His name is John Penny, and he was just shot by police in our driveway for being black, unarmed, and homeless. We don't know if he's ok. Praying for his safety and well being.

Our landlord Jack had been letting him sleep in his driveway for the past few months. A neighbor called the police with a noise complaint. Jack tried to calm him down. But hearing the police sirens escalated John. He didn't want to go to jail. Police arrived, and then backup, and Jack tried to tell the cops that he knew John, and that John was harmless, but the police just yelled at Jack to go inside his house.

John didn't have a weapon, he just had a coke bottle. And police shot him anyway.

Well, let's see, it's a slow day.

According to Buckner, Our landlord Jack had been letting him sleep in his driveway for the past few months. It appears that Jack owns the driveway and sublets it free of charge to John. It would therefore appear that it is Jack's responsibility to ensure the shit is scooped up, the piss is washed off and deodorized, and that John does not pose a public nuisance. Perhaps Jack could put an oversized litter box in the driveway and change the litter regularly, or Jack could let John crash on his couch. And do something to curtail John's out of control screaming.

It appears John was posing a public nuisance and Jack failed to deal with it, resulting in a neighbor calling the police. The police were not there in the first place, Jack was. Jack failed to effectively deal with his invited public nuisance and the police responded to a complaint so they would do what Jack failed to do.

Upon hearing police sirens, John's public nuisance increased as Jack was unable to deal with his screaming, out of control charge, John. There is no indication that Jack invited John into his home to curtail the public nuisance, nor did he force John to leave the driveway.

[Ethan Buckner] Police arrived, and then backup, and Jack tried to tell the cops that he knew John, and that John was harmless, but the police just yelled at Jack to go inside his house. John didn't have a weapon, he just had a coke bottle.

Buckner observed none of this. He could not have known what weapon John did, or did not, have. An unstable, agitated person with a coke bottle or a plank is not harmless.

MMA/UFC fighters should be able to arm themselves with a coke bottle when entering the octagon. After all, it is not a weapon. Alternatively, let someone smack Buckner in the face with a coke bottle.

Well, Jack could not deescalate John and neither could the cops. Acting pursuant to a complaint, the cops had a duty to act, not walk away or do nothing. Cops do not have a duty to wrestle with a mentally unstable person who is armed and threatening. The cops can use force to subdue the unpredictable, mentally unstable person. They can escalate said applied force until the subject is subdued. If the subject poses a treat to the life of the officer, he may be shot.

Of course, the subject may simply comply with the instructions given by the officer. But one cannot reason with an unstable, unhinged person. For example, it would appear that one cannot reason with Ethan Buckner, John or Jack.

What a nutjob. Military training dictates the only reason to draw one's weapon is to shoot something or somebody. Shoot center mass, to kill, not to wound. The function of the engaged military is to kill people and break things until the other side yields. Police officers are in no way soldiers with guns.

**The following information is based on a preliminary and ongoing investigation, which continues to evolve as investigators interview witnesses, review physical and electronic records, and analyze forensic evidence. The Department's understanding of the facts and circumstances may change as additional evidence is collected and analyzed**

Venice: Los Angeles Police Department's Force Investigation Division is investigating an Officer-Involved-Shooting in which officers shot a man armed with a three-foot wooden plank.

On August 14, 2019, around 5:50 p.m., uniformed officers assigned to Pacific Patrol Division responded to a radio call of a screaming man at Thornton Court and Pacific Avenue. Upon arriving at the location, the officers encountered the suspect, John Penny, who was initially armed with a glass bottle. Penny refused to drop the bottle and approached officers. The officers deployed a taser, however it appears the darts did not strike Penny. Penny then armed himself with a three-foot-long wooden plank and again approached the officers, which resulted in an Officer-Involved- Shooting. Penny was struck once in the left arm and once in the left thigh. The officers also deployed one round from a beanbag shotgun and one 40mm round.

Penny was treated at scene by members of the Los Angeles Fire Department (LAFD) and then transported via Rescue Ambulance (RA) to UCLA Westwood Medical Center, where he was treated and cleared for booking. No officers were injured during the incident.

A three-foot wooden plank was recovered at scene.

Force Investigation Division (FID) responded and is handling the administrative investigation and the FID Criminal Apprehension Team (CAT) is conducting the criminal investigation.

LAPD's specialized Force Investigation Division responded to the scene and began interviewing witnesses and collecting forensic evidence. Representatives from the Office of the Inspector General and Los Angeles County District Attorney's Justice System Integrity Division responded and monitored the investigation.

The complete investigation will be reviewed by the Chief of Police and the Board of Police Commissioners and the Office of the Inspector General to determine the thoroughness and accuracy of the investigation and whether the use of deadly force complied with the LAPD's policies and procedures. Additionally, representatives from the Los Angeles County District Attorney's Office who responded to the scene will review the subsequent FID investigation; evidence collected and witness statements to determine if the force used by the officer(s) violated any criminal laws.

A group of activists voiced anger during Tuesday's Los Angeles Board of Police Commissioners meeting over the non-fatal shooting of a homeless man who officers said was acting aggressive and wielding a glass bottle and later a wooden plank.

About 6 p.m. Aug. 14, officers responded to a radio call of a "screaming man" at Thornton Court and Pacific Avenue in Venice, according to the Los Angeles Police Department.

"Upon arriving at the location, the officers encountered the suspect, John Penny, who was initially armed with a glass bottle," according to an LAPD statement. "Penny refused to drop the bottle and approached officers. The officers deployed a Taser, however it appears the darts did not strike Penny."

Penny then armed himself with a 3-foot plank and again approached the officers, who shot him once in the left arm and once in the left thigh, police said. Penny was treated and booked into jail early the next morning.

Activists, including members of Black Lives Matter Los Angeles and the Los Angeles Community Action Network, gathered at the commission's meeting, contending Penny was on private property with the permission. They contend Penny did nothing to warrant a police response, although they conceded he may have been having "emotional issues."

"Penny was armed with a bottle. It's miraculous he was shot ... and survived, and now you're going to charge him with a crime?" one speaker said.

Penny remains jailed in lieu of $775,000 bail, according to sheriff's department records.

The "activists" would have one believe that a homeless nut job inhabiting one's driveway and screaming insanely does not warrant a police response as long as the landlord permits it. As thjey might say, Saul Goodman.

Penny assaulted police and resisted arrest. Activists are going to put him back in the alley to scream some more? If landlord Jack kept a barking dog in the driveway, and it was a public nuisance, the cops may act to end the public nuisance.

Yes, the police were negligent for using sirens and triggering emotional John and his sensitive landlord Jack, and snowflake Ethan.

The dispatcher should have known about John's condition and should have dispatched an ice cream truck along with a social worker instead. Then none of this would have happened.

Again, the police were negligent in their failure to bring along Good Humor truck to appease John's jones, and for not recognizing that I scream, John screams, we all scream for ice cream. And then they shot John for no reason other than he would not stop screaming for ice cream.

As for the neighbors, just because someone was shitting and pissing in the driveway next door, and engaging in uncontrolled screaming for ice cream, they had no reasonable cause to call the cops when they could have held the noses or tried Vick's Vaporub in their nose, and worn ear plugs or headphones with soothing music or chants, and they could have gone down with a pooper scooper to clean up and have answered John's plaintive wails with a gift card for Baskin Robbins, but no, they were simply raciss bigots. And besides, John was on Jack's private property and had Jack's permission.

This is a clear case of social injustice and should result in universal kneeling for the national anthem to start the NFL season. By the grace of Allah, Colin Kaepernick will be on the job, and the Squad and the Most Reverend Al Sharpton will fly in to lend support.
