Title: An $80 Fine for a Busted Taillight Ends With a Woman Being Tased

Debra Hamil, 65, tased after refusing fine for busted taillight

(Screenshot via Facebook/KOCO 5 News)

A disagreement over a busted taillight fine ended with an Oklahoma police officer tasing a 65-year-old woman.

Body camera footage shows an unnamed officer interacting with the woman, Debra Hamil, during the July 16 traffic stop. The officer presents Hamil with an $80 ticket and asks her to sign it. Hamil protests: "I don't think that I deserve to pay $80 for something that is fixable—and I can fix it, if that's all you want me to do."

The officer tells Hamil that she is under arrest for refusing the ticket and asks her to step out of the vehicle. Hamil says "no," rolls her windows up, and locks the doors before the officer can open them. Hamil briefly rolls her window down to tell the officer that he's "full of shit," then tells him to hand the ticket over so she can sign it. The officer says they're "beyond that." She drives off. The officer enters his vehicle.

The footage cuts to the officer approaching Hamil's truck. He's eventually able to pull her out of the truck and down the ground. After she refuses to put her hands behind her back and kicks the officer away, he deploys his taser.

Hamil is eventually handcuffed and placed in the back seat.

Hamil was later charged with assaulting an officer (felony) and resisting (misdemeanor).

When KOCO posted the video on Facebook, some of the comments supported the woman and some supported the officer. But one thing is certain: This situation was avoidable.

Traffic stops for busted taillights and other minor infractions just aren't worth the risks they generate, both for motorists and police officers. Often, the stops are really being used to generate revenue or as a pretense to search for contraband, such as drugs or guns, when an officer otherwise lacks probable cause. Even then, Berkeley law professor Christopher Kutz has argued, the few times police successfully find something "don't justify the enormous social costs of widespread police interventions." In the worst-case scenario, a traffic stop could result in death, as the surviving families of Philando Castile and Sandra Bland know well.

If police truly wish to continue to go after low-level crimes, they can cut down on interactions like the one seen in the video by reserving traffic stops for accidents and impaired drivers while using cameras and other technology to enforce minor violations. Though it's also worth asking how many of those minor violations are worth prohibiting in the first place. Such fines often amount to the criminalization of poverty, especially given that poorer Americans are more likely to drive older cars, which are at a higher risk for finable offenses.

Poster Comment:

Around here for this kind of "offense", the cops write a "Fix It" ticket, giving you 10 days to make the necessary repairs.

Revenue enhancement is alive and well in police state Amerika.

Hamil briefly rolls her window down to tell the officer that he's "full of shit," then tells him to hand the ticket over so she can sign it. The officer says they're "beyond that."

Oh, she agreed to pay the ticket, yet the arrogant cop said no.

Guess he didn't want to hear the truth that he's "full of shit". (1 image)

Uh-huh. Sign the ticket when told to sign the ticket. Like the rest of us do, you self-important bitch.

Sure they are. Many times the officer finds outstanding warrants and other felonies.

as the surviving families of Philando Castile and Sandra Bland know well.

Philando Castile was high on marijuana and reached for his gun. Sandra Bland hanged herself in jail.

Philando Castile was high on marijuana and reached for his gun.

Not true..

But you knew that.

Two Phony Excuses for Shooting Philando Castile

Toxicology tests found THC in Castile's blood, but post-mortem levels are an unreliable indicator of impairment because THC is stored in body fat and re-enters the bloodstream after death. Even when blood is drawn from a living source, THC levels cannot be directly tied to impairment, partly because individual responses vary widely and regular users develop tolerance. It is therefore not clear whether Castile was under the influence of marijuana at the time of the shooting or, if so, how intoxicated he might have been.

The question of Castile's cannabis consumption is relevant only if you accept the defense argument that marijuana impaired his ability to follow Yanez's instructions, as evidenced by his failure to do as he was told. But the dashcam video of the shooting does not support the claim that Castile was uncooperative. To the contrary, he interacted with Yanez calmly and politely, handed over his insurance card as instructed, and let the officer know he was carrying a concealed firearm (for which he had a permit). According to Reynolds, whose account on this point has always been consistent, Castile was reaching for his wallet so he could retrieve his driver's license, which Yanez had also requested, when the officer became agitated.

Notably, Yanez never told Castile to stop moving, to keep his hands in plain view, or to put them on the dashboard. Instead he told Castile, "Don't pull it out," referring to the handgun. "I'm not pulling it out," Castile assured Yanez. "He's not pulling it out," Reynolds reiterated. This is the point at which Yanez freaked out, screaming, "Don't pull it out!" He immediately drew his pistol and fired seven rounds at Castile, who managed to say "I wasn't reaching for it" before he died.

Philando Castile Video Shows a Cop Who Panicked and Killed an Innocent Man

Government is in the last resort the employment of armed men, of policemen, gendarmes, soldiers, prison guards, and hangmen.
The essential feature of government is the enforcement of its decrees by beating, killing, and imprisoning.
Those who are asking for more government interference are asking ultimately for more compulsion and less freedom.

A cop (or anyone for that matter) points a gun at me from two feet away and says anything, I freeze.

I don't keep doin' what I'm doin' -- unless I'm high on marijuana.
