Judge Orders Mueller To Prove Russian Company Meddled In Election

A Washington federal judge on Thursday ordered special counsel Robert Mueller's team to clarify election meddling claims lodged against a Russian company operated by Yevgeny Prigozhin, an ally of Russian President Vladimir Putin, according to Bloomberg.

Concord Management and Consulting, LLC. - one of three businesses indicted by Mueller in February along with 13 individuals for election meddling, surprised the special counsel in April when they actually showed up in court to fight the charges. Mueller's team tried to delay Concord from entering the case, arguing that thee Russian company not been properly served, however Judge Dabney Friedrich denied the request - effectively telling prosecutors 'well, they're here.'

Concord was accused in the indictment of supporting the Internet Research Agency (IRA), a Russian 'troll farm' accused of trying to influence the 2016 US election.

On Thursday, Judge Freidrich asked Mueller's prosecutors if she should assume they aren't accusing Concord of violating US laws applicable to election expenditures and failure to register as a foreign agent.

Concord has asked Dabney to throw out the charges - claiming that Mueller's office fabricated a crime, and that there is no law against interfering in elections.

According to the judge’s request for clarification, the Justice Department has argued that it doesn’t have to show that Concord had a legal duty to report its expenditures to the Federal Election Commission. Rather, the allegation is that the company knowingly engaged in deceptive acts that precluded the FEC, or the Justice Department, from ascertaining whether they had broken the law. -Bloomberg

On Monday, Friedrich raised questions over whether the special counsel's office could prove a key element of their case - saying that it was "hard to see" how allegations of Russian influence were intended to interfere with US government operations vs. simply "confusing voters," reports law.com.

During a 90-minute hearing, Friedrich questioned prosecutor Jonathan Kravis about how the government would be able to show the Russian defendants were aware of the Justice Department and FEC’s functions and then deliberately sought to skirt them.

“You still have to show knowledge of the agencies and what they do. How do you do that?” Friedrich asked.

Kravis, a prosecutor in the U.S. Attorney’s Office for the District of Columbia, argued that the government needed only to show that Concord Management and the other defendants were generally aware that the U.S. government “regulates and monitors” foreign participation in American politics. That awareness, Kravis said, could be inferred from the Russians’ alleged creation of fake social media accounts that appeared to be run by U.S. citizens and “computer infrastructure” intended to mask the Russian origin of the influence operation.

That is deception that is directed at a higher level,” Kravis said. Kravis appeared in court with Michael Dreeben, a top Justice Department appellate lawyer on detail to the special counsel’s office. -law.com

Concord pleaded not guilty in May. Their attorney, Eric Dubelier - a partner at Reed Smith, has described the election meddling charges as "make believe," arguing on Monday that Mueller's indictment against Concord "doesn't charge a crime."

"There is no statute of interfering with an election. There just isn’t," said Dubelier, who added that Mueller's office alleged a "made-up crime to fit the facts they have."

Dubelier added that the case against Concord Management is the first in US history "where anyone has ever been charged with defrauding the Justice Department" through their failure to register under FARA.

I’m not too stupid to use Google. I’m too uninterested. I see old lunatics raving about conspiracy theories, acting as though all of us should know the details of the strange hobbyhorses they have in their minds.

In my view, if somebody is going to talk about some dark and mysterious force, the “Chabad Mafia”, then he ought to be willing to discuss what it is. No, I’m not going to go research it. I doubt it really exists as anything other than a localized something-or-other. Sounds Jewish. And because I ascribe no supernatural power or influence to Jews, I simply am not interested in spending the bandwidth to learn about your hobbyhorse. I have offered you the opportunity to explain in your own words what the Chabad Mafia is, and why I should care enough about it to go look it up. You reply by bringing up an actual miracle.

You’re doing that for two reasons: (1) To make me cringe, but it doesn’t. All you’re doing is reminding me of how lucky I am to be so much closer to God than you. God raised a rodent in my hands, but he’s let you go nuts alone in your basement seeing Joooooooos behind everything.

(2) To make anybody who reads dismiss me, and presumably to listen to you.

Trouble is, even if I were a completely delusional psychotic, I would still be more polite, rational and nice to talk to than you are. So by picking on me you’re not advancing your cause with me - you’re reminding me that I’m blessed and you’re not. And you’re not actually gaining market share with your audience either, because you just look and sound like a dick.

You’re proposed that there is a thing - obviously a Jewish thing - called the Chabad Mafia, and that it somehow controls the Scottish Presbyterian New York billionaire President Donald Trump. This seems unlikely. It sounds like the sort of Jewish conspiracy nonsense that drove the Germans berserk and caused them to burn down their own country.

If it’s not, if its something real, explain yourself. Don’t ask people who think yoiu’re a nut to go look at nutty websites. Explain it yourself.

Notice, please, that the guy for whom God raised a rodent is the ONLY ONE who actually tries to engage you on the IDEAS you present. Everybody else mocks you and curses at you. I mock you only in proportion to the degree you mock me. I would like to hear what YOU have to say, mostly because I have compassion for what I perceive to be an old man struggling with mental health, loneliness and anger issues, and going down the path of anti-Semitism because that’s the path than has been laid out already by mentally unstable, lonely angry men in the past.

By having YOU talk about the Jooooos you see behind every rock, it is my hope that you will find that it doesn’t really hold together, and that you’ll engage in more wholesome mental activity.

So, my talking to you is actually an act of kindness, on my part. I’m doing good to one who insults me, just like Jesus said to do.

Tell me about your Chabad Mafia, and why I should care about it. And where it starts to drop off into nonsense, see the crazy yourself and decide to back away from the abyss, for your own good.

And yes, God DID raise a rodent and a lizard from the dead right in my presence. I never said that I did it. I can’t raise anything from the dead. I always have recounted what happened the same way. It is a mark of the dishonesty of those who attack me with it that they change my oft-repeated story from God raising the dead to me doing it - something I never, ever said. If you can’t even get THAT right, why would I trust your judgment or honesty on anything else you say?
