Two men have told Senate Judiciary Committee staffers that they believe they — not Judge Brett Kavanaugh — had the sexual encounter with Christine Blasey Ford which is the basis of her sexual assault allegation against the Supreme Court nominee.

Documents released by majority members of the Senate Judiciary Committee on Wednesday evening threw a new wrinkle into the accusations against Kavanaugh, the night before he and Ford are scheduled to testify about the situation.

Republican members of the committee released a summary timeline of staff activities related to the numerous sexual misconduct allegations against Kavanaugh. The timeline includes several bullet points that indicate two men have said Kavanaugh did not sexually assault Christine Blasey Ford at a 1982 party — because they did it.

From Sept. 24:

  • Committee staff have first interview with a man who believes he, not Judge Kavanaugh, had the encounter with Dr. Ford in 1982 that is the basis of his complaint. He submitted a written statement earlier in the day.

From Sept. 25:

  • Committee staff have a second interview with a man who believes he, not Judge Kavanaugh, had the encounter with Dr. Ford in the summer of 1982 that is the basis of her allegation. He described his recollection of their interaction in some detail.

And from Sept. 26:

  • Committee staff receive a more in-depth written statement from the man interviewed twice previously who believes he, not Judge Kavanaugh, had the encounter in question with Dr. Ford.

  • Committee investigative staff spoke via phone with another man who believes he, not Judge Kavanaugh, had the encounter with Dr. Ford in 1982 that is the basis of her allegation. He explained his recollection of the details of the encounter.

Christine Blasey Ford helped herself, but not nearly as much as Brett Kavanaugh did himself.

If Brett Kavanaugh wins confirmation to the Supreme Court, he can thank himself.

With nobody willing to say “boo” to Christine Blasey Ford, Kavanaugh’s accuser appeared credible, nice, and likable in her testimony. She did not filibuster in her answers. Her voice, with its high pitch and uptalk inflections, sounded not like that of a fiftysomething woman but of a teenage girl — helping senators imagine the teenage girl she was 36 years ago. In contrast, she used “sequalae,” “hippocampus,” and other ten-cent words indicative of an intelligent woman (but strangely needed an explanation on “exculpatory”). She firmly maintained that she knew with “100 percent” certainty that the man looking for a seat on the Supreme Court used her as a mattress all those years ago.

She helped her cause. So did the peculiar manner that Republicans chose to question her.

Don’t blame Rachel Mitchell entirely. Blame the eleven men hiding behind her. Whereas Democrats constantly interrupted Kavanaugh and turned the hearings into chaos earlier this month, Republicans on the committee did not utter a peep to Ford on Thursday. This strategy had everything to do with protecting themselves and nothing to do with protecting Kavanaugh, Ford, or the truth. Mitchell’s questioning centered on matters on the periphery. Her body language wisely spoke in a warm tone. But her words focusing on the alleged incident, the only thing that really mattered, came infrequently.

Mitchell’s best moment interrogating Ford occurred when she exposed her stated fear-of-flying excuse for rebuffing initial attempts to bring her to Washington as lame. The prosecutor asked how Ford traveled to visit her family this summer. She admitted she flew from the West Coast to the East Coast. The prosecutor noted that her interests included Costa Rica, Hawaii, and points beyond. Did she ever travel to those places? Yes. How? Flying.

Ironically, Connecticut Senator Richard Blumenthal, who manufactured tales of nonexistent service in Vietnam, tried to apply the concept of crimen falsi, which broadly means that one who lies about one thing impugns his or her credibility on another thing, to Kavanaugh. Ford’s less-than-honest answers on aviophobia, and hard-to-believe contention that she did not realize what everybody else knew — that the committee offered to interview her in California — raised issues of crimen falsi, but just not in the way Blumenthal imagined.

Though relevant, Ford’s fibs about flying did not speak directly to whether Kavanaugh jumped on her at a party in 1982. They spoke to her credibility, sure. But when your best moment as the questioner involves a moment that occurred more than three decades after the alleged moment then you missed your moment.

Republicans surely missed their moment in the morning. Brett Kavanaugh seized it in the afternoon. The former football player executed a second-half comeback akin to the one Tom Brady engineered several Super Bowls ago in this Super Bowl of politics. A man who looked like a dead man walking when his turn began breathed life into Republicans. Politicians know a good bandwagon when they see one, and so several who had ceded their time to Mitchell in the morning came out swinging in the afternoon.

Kavanaugh engineered the difficult task of showing passion as he employed logic. Gone were the coached, rote answers from his Fox News interview with Martha MacCallum. Tearfully, angrily, he noted that all of the people who his accuser names as witnesses do not corroborate her story. Even her friend, the former wife of Democratic Party strategist Bob Beckel, not only said under the penalty of perjury that she did not attend any such party, but that she has never even met Brett Kavanaugh. Skillfully, Kavanaugh targeted the Democrats on the committee who leaked Ford’s identity against her stated wishes. He exposed them as cynical, manipulative. Like Brendan Sullivan at a similar high-drama hearing a generation ago, Kavanaugh effectively declared himself no potted plant. Several Democrats, especially Cory Booker and Kamala Harris, took his bait, and in doing so exposed their hyper-partisan faces. The judge masterfully transformed a he-said/she-said into Kavanaugh vs. the Committee. That’s an easier fight to win.

Forced to lay out the facts after Republicans continually opted to punt in the morning, Kavanaugh, with, yes, some earlier help from Mitchell, made a strong case. Ford said she did not know who paid for her polygraph. She said she did not know who drove her to or from the house where she says Kavanaugh assaulted her. She said she did not know where the alleged assault took place, “the Bethesda area” was as specific as she got. She said she did not know exactly when the alleged assault took place despite shifting from the mid-1980s to 1982. None of the witnesses she named said they remember any such party that she described. If her performance helped her cause, the evidence presented did not. A woman can only appear as credible as her story.

Thursday ended where it began. But in between, everything changed. Christine Blasey Ford left a positive impression that appeared to doom Brett Kavanaugh. Then Brett Kavanaugh showed himself as a fighter — and one adept at dragging himself off the canvas at that. Democrats supporting Ford supported Ford by the day’s end and Republicans supporting Kavanaugh supported Kavanaugh by the day’s end, too.

Given their bare majority, a party-line vote should determine the outcome. But a process filled with surprises surely offers a few more.

Does this mean Ford can be prosecuted/indicted for perjury? And can media and Dem Senators be sued for defamation?

MOREOVER, IF the boys (now men) testify that a drunken Ford encouraged them to make her a "pin-cushion" and grabbed THEM and their private parts...THEN WHAT? (in your opinion of course?)

What's interesting is Montgomery Co MD County Prosecutor came out with a statement and letter that (1) for them to investigate Ms Ford's allegations, she has to file a report and (2) even though MD law now considers attempted rape (new age language sexual assault) as a felony with no statute of limitations, such a case in 1982 under the law was a misdemeanor offense with a statute limit of one year.

All very interesting. 8 hours of testimony over what back then was a misdemeanor offense and would be treated as such even with a newer more strict law in effect.

But False memories is a separate thing from simply having a shaky memory over time, and I think this fits the scenario perfectly.

False memories are memories that a person was compelled to assemble that are different from actual facts. A person with a false memory would be honestly convinced of its authenticity so they would pass a lie detector test and otherwise act in the same way in regards to them as they would if the memory were real. The more people think about a memory over time, the more it can accumulate artificially added detail.

In Ford's case, this possibility moots the significance of the claim that she mentioned Kavanaugh's name in 2012 as she still had 30 years to construct, deconstruct and reconstruct her memory.

What I wanted Ford to be asked is how long before the event she knew Kavanaugh, or knew of Kavanaugh. If she was not familiar with Kavanaugh before that party, and then she was attacked by some guy that looked similar to Kavanaugh, then after a few more weeks learns about Kavanaugh and sees him looking similar to the attacker, then she could easily have created a false memory copying his face and identity into her experience. Maybe she would have only suspected and been not sure at first, but then with more time, with every hash and rehash of that memory, made it more and more real for her. Fast forward to today and she's magically 100% certain it was Kavanaugh.

The question the dem asked her about her degree of certainly that it was Kavanaugh was completely worthless. Even if she had said she was 99.5% sure instead of 100% sure, the entire proceeding would have gone up in an uproar. She had no alternative to answer as she did.

On the other hand, one question was very good. The one where she was asked what things about the attack she could never forget. She listed a bunch of things. The stairs, the laughter and so on. One thing was notably absent: The identity of her attacker, either by name or face. To me, that was a glaring omission.

Other questions: Did she KNOWINGLY lie? Was Ford LED to lie? If so, who else was involved in yet ONE MORE conspiracy by Democrats?

I think the other accusers are much more likely lying than is Ford. And one could ask this of Kavanaugh as easily as Ford.

Agree. I'm pretty sure we're all in the process of doing exactly this; embellished certain details in order to compensate for lost details. (That's why when old friends get together, most of us hear the phrase, "THAT'S RIGHT! I FORGOT THAT HAPPENED!" )

AS she saw fit, from a personal narrative that necessarily erased her own adverse role while over-exaggerating in a negative light whatever minor role Kavanaugh played in order to fill out her mental account. It was as though this chapter of her life was a lost cake recipe that made for a horribly bad cake then; But after 30+ years, the "lost recipe" is now recalled as "delicious" as additional ingredient were added.

I believe SHE may have been responsible not only as a "tease", but as THE sexual aggressor. SO SHE FLIPPED THE ENTIRE STORY. (again, I think you're right in that OTHER boys were involved, and due to her own wishful thinking based on politics, the accomplished Judge Kav became her Boogeyman.)

So...If even a squeaky-clean SCOTUS candidate as Justice is not afforded Due Process and indicted simply on unsubstantiated words/lies, then WHO IS safe from character assassination BASED ON THESE FALSE/ERRONEOUS MEMORIES?

Overriding Ramifications:

Does this circus and legitimizing ancient re-constructed fictional accounts from ANY and ALL teenage girls mean you and I and the rest of us are "future criminals" as a result of their long-forgotten hand-holding "fails" as teenagers? Of any and every frivolous charge, validating even 36 year old false memories of hazy, drunken-stupor claims?

Kavanaugh was a virtual relative altar boy. If this crap is allowed to be validated and stand, the Democrats/Fascists-Commies will have not only succeeded in creating national chaos, but criminalizing ONLY Conservative/Republican Men. (THE LEFT'S #1 GOAL)

The statute of limitations does not apply to felonies. If the alleged misdeeds are classified as misdemeanors, it ran decades ago. I believe the statute of limitations does apply. Attempted rape was a misdemeanor in Maryland in 1982.

Yep. All of the major gains by liberals have been made through the courts.

Gay rights, gay marriage, gays in the military, transgenders in bathrooms, removal of religious icons, removal of Southern monuments, flag burning, Title IX implementation, quotas in school admissions, hate crimes, civil rights protection of certain groups, accomodations for the handicapped, etc.

Yeah, you usually need a complainant, a dead body, or a victim missing and presumed dead.

Also jurisdiction. The Columbia Country Club, about 7 miles from Ford's 1982 home, it's just over a mile from the D.C. border, and the party was somewhere near the country club. As Ford does not know where the party house was, she cannot affirmatively establish that it was in Maryland or D.C.

Maryland raised the drinking age to 21 in July 1982. D.C. did not raise the age until September 1986, so there may have been an incentive to drink brewskis in D.C. starting in July 1982.

In 1982, in Maryland attempted rape was a common law misdemeanor with a statute of limitations of one (1) year. Maryland is an odd state with common law crimes which derive from courts and not statutes. Common law misdemeanors may carry felony-like penalties, but they are misdemeanors for purposes of the statute of limitations. In Maryland, that is one year.

Kavanaugh was a juvenile.

Criminal investigations usually require jurisdiction and a crime that is possible to prosecute.

The FBI generally does not do criminal investigations of state crimes. They do background investigations. They collect statements. They do not reach conclusions, they compile the statements and provide them to the requesting agency. They can investigate unusual matter when the President tells them to, as they are part of the executive branch.
