The State of New York has a one-party consent law, meaning Trump does not have to consent or even know about the recording. Legally, that recording may be shared by anyone with anyone. Ethically, it may not be shared by a lawyer due to attorney-client privilege. The recording in question (and nearly a hundred more) were collected during the FBI raid on the homes and offices of Mikey the Fixer in April. The evidence was reviewed by a former judge hired by SDNY. The evidence was also reviewed by Cohen's attorney, and by DD45's attorney. Trump's attorneys waived any claim to privilege.
