When you leave Wal-Mart after making a purchase, you walk past a scanner that sets off an alarm if you haven't paid for something.

And if the alarm goes off at this Wal-Mart, Ed Bauman will want to talk to you.

Ed Bauman, Wal-Mart greeter, says "I'm getting too old for this stuff."

Too old to be punched in the head by a customer who exception to Bauman's questions.

Ed says "when he swang, he got me right here," pointing to the back of his head.

The 69-year-old greeter was at the entrance when a man in red shorts, identified as Skyler Lowery set off the alarm but then refused to stop when Bauman questioned him.

Bauman went outside to get his license but then the guy rips Bauman's clipboard from his hands and goes back inside.

Ed says "I grabbed the clip board back and as I was doing that, he hit me with a doubled-up fist behind my ear."

The 6-foot-2 retired Marine didn't back down.

Ed says "the security officer said if you would have hit him in the jaw the way you hit him in the chest, you would have knocked him out."

Police arrested Lowery who would have faced a charge of misdemeanor battery had Bauman been under 65. But hitting an older person is a felony and Bauman says he still doesn't know why it happened.

The alarm was false and Lowery had a receipt for everything in his bag.

Failing to show the receipt in this case meant the difference between 10 seconds and five years. It would have taken 10 seconds to show the receipt but now he faces up to five years for battery on a person over 65.

Look at the video. The Walmart greeter is trying to grab the bag of stuff he bought, which probably holds the only proof the shopper has, that he paid for everything, that being the receipt.

Question for you. If ANYONE tried to grab a bag of merchandise you have paid for, what would you do?

You're a cop. Is it robbery if someone tries to take from you what is legally yours? Is it legal to try to stop it to protect your property?

Do you think because an electronic box beeps when you walk past it, you must submit to a search of your bag by a Wal-Mart greeter.

Do you believe in this country that we are innocent until proven guilty, or that we are guilty until we prove we're innocent, and that we have to prove we are innocent because an electronic box, known for numerous false alarms, beeped when we walked past it.

One of our rights is the presumption of innocence, which is slowly being eroded by crap like this, and people don't even see it when it's happening right in front of their face. And it's being done by conditioning of the people by idiots like this reporter with sentences like this:

No, that's a separate question and a good one. You can do either.

You can keep your rights and walk on.

Or, you can stop and let the employee verify that your receipt matches the items in your bag, if you want to, but that proves nothing. If you were stealing something, you may have slid it into your pants and not put it in your shopping bag.

So what's next? The Wal-Mart greeter sees your bag and receipt match, but hey, the magic electronic box, known for false alarms, beeped when you walked by it. You already submitted to a search of your bag. Do you now allow yourself to be patted down, your pockets emptied so you can prove your innocence?

If not, why not?

... and then punch him out for writing down your license number?

He didn't punch the Wal-Mart greeter out for writing down his license number. If that were the case, he would have done it outside the store instead of just taking the clip board.

Did you notice which way he went after he got the clip board? INTO the store, not away from it. He wasn't trying to take evidence. He wasn't stealing the clipboard. My guess is that he was looking for a manager to give him a piece of his mind.

I've seen the video on our local news. It starts much earlier than the video at the link in this post. The guy and the greeter are standing there, the guy calmly looking around as if waiting for a manager when the GREETER grabs the guys arm (most likely trying to get the clipboard back) and the hand the guy is holding his bag with. You can see the guy trying to tug his arm away from the greeter, and when he can't loosen the greeter's grasp, takes a swing at the greeter.

He didn't sucker punch the greeter for writing down his license.

The greeter made the assault, and if that video ever gets to court, the greeter's fucked.

You're a cop. Is it robbery if someone tries to take from you what is legally yours?

There was no intent on the part of the store sanctioned door guy to deprive the shopper of his merchandise.

Thus no robbery.....no false imprisonment...no battery...no nothing.

Don't like it then don't shop there.

What Skylark does have is an attitude problem toward what probably was just a regular old guy at the door doing his legally sanctioned job......as well as a felony arrest record.

Life's too short to make a bigger deal of this "conditioning" issue you seem to allude to. Show the receipt and move on with your life.

Maybe follow the conditioning effects of red light cams, H1N1 phoniness, green / global warming hysteria, Homeland "Security" airport nonsense, freeway surveillance cams, advertising the latest twitter/iphone/madden200x......whatever.....

He'll sue Walmart, the greeter, and most likely the cops that arrested him, as well as who they work for, and win, if he doesn't settle first.

Well he won't be suing the PD.

He punched the old guy first....if he thought he was a victim of Misd. verbal assault by the old guy talking trash or something or when the old guy grabbed the bag, he could have made some kind of claim and maybe could have sued for some stupid reason....once going to the punch thing....(which by the way here in Ca is a felony wobbler and can be charged either way as Misd or Felony regardless of Vic age)....he kind of lost his mojo.

The old guy grabbing the bag was not a good idea on his part...but that is no assault or battery on anybody's person warranting a post incident slug to his head......he should have just written the guys tag down or let it go once he saw Skylark was an insufferable dick.

Tell you what.

Go to a sporting event and walk past the ticket taker with your ticket in your wallet. You have paid for the right to view the game......When the ticket taker accosts you by maybe standing in front of you or placing an arm on you to get you to wait then punch him out because you are innocent and have the right to proceed.

I'll need to say no more on this.....the principal is exactly the same other than the store typically won't make you go through the ticket taker/doorman......your logic is blowing on this particular issue.

Assault is the threat to do something, coupled with the ability to do what you've threatened. It does not include physical touching.

Battery is the physical touching.

Hence the word assault in quotes in one of my posts. Explaining that would have taken away from my message, so I let it ride.

I totally agree with that.

I just lump the searching of law abiding citizens who have committed no crime, or their detention sanctioned and protected from prosecution or civil suit, because an electronic box beeped, as a stepping stone and conditioning to accept those things that you and I agree are bad.

After all, those who would think allowing a search of one's possessions valid because an electronic box (that the searcher was in control of at the store) beeped, certainly would have no problems being searched when the electronic box (the searcher was in control of) beeped at the airport.

Store, restaurant, game, concert whatever.....

Walk out of a restaurant after eating and paying your bill and the person at the door could ask if you paid.....if you walk by without responding you can be in the same position as this situation
