ANCHORAGE, Alaska (AP) — An Anchorage judge will likely wait until 2010 before deciding whether state public records law governs the e-mail messages that former Gov. Sarah Palin and her top administration officials sent to one another outside of the state's computer network. Andree McLeod of Anchorage has been seeking copies of the messages. She says in a lawsuit that Palin and her officials violated the public records law by using off-the-record networks to discuss matters of public concern. Assistant Attorney General Michael Mitchell on Tuesday asked state Superior Court Judge Patrick McKay to dismiss the case. McKay took the motion under advisement and said he will probably make a decision after the holidays.

How would Andree McLeod of Anchorage know if Palin were discussing matters of public concern if she has never seen the messages that were sent outside of the state's computer network? If these were private messages, it doesn't matter what Palin and her top administration officials were discussing. Amendment IV The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
What computers were they using?

If they used government computers and used secondary accounts to bypass disclosure/sunshine laws or regulations - which I believe they did - then the lawsuit has merit.

Sorry...that should be "non government" and my "which" reference was vague. To restate - I believe that they used these accounts SOLELY as an attempt to bypass sunshine regs.

Sarah Palin did not violate state law by using her private e-mail account to conduct state business. Andree McLeod, a Palin critic, had sued in state court for release of Palin's private e-mails dealing with state business under the state's public records law. Earlier this month, Alaska Dispatch obtained and published a batch of the sort of e-mails McLeod wanted to see. E-mails sent during the second month of the Palin administration clearly show then-Gov. Palin discussing state business on her personal Yahoo account. Among the examples: -- A Jan. 13, 2007, e-mail Palin sent to then-Chief of Staff Mike Tibbles' personal account (and copied to others in her inner circle) discussing candidates for various state jobs. "I know Ryan Colgan bugs folks," Palin wrote, "but he is supportive and wants a job so he can help. Why not find a spot for him somewhere in the 17,000 state employee group?" She went on to criticize Ron Miller, who had headed the Alaska Industrial Export and Development Authority under Gov. Frank Murkowski: "Ron Miller and others who made very poor decisions must be replaced with more sensible Alaskans who will not squander public funds. My discussions with Andrew (Halcro) sure has convinced me (as I was convinced after 10 months on the trail with him) that he agrees with me that we MUST clean up state government." Halcro ran against Palin in the 2006 gubernatorial election as an independent. Weeks after this e-mail, he and Palin had a falling out and Halcro began criticizing the governor on his blog, eventually breaking the so-called Troopergate scandal that embroiled Palin as she leaped to the national stage in late summer 2008. -- A Jan. 28, 2007, e-mail from Palin's personal account went out to a list of high-level staff and commissioners' state e-mails encouraging them to speak freely to the press. The note was in response to an item in the Anchorage Daily News' Alaska Ear about whether members of her administration were banned from speaking to the media. "I have NEVER banned any of our team members from voicing opinions on anything," she told her commissioners and others. -- On Jan. 30, 2007, Palin sent an e-mail from her Yahoo account to several of her advisors' personal accounts to discuss candidates for Fish and Game Board appointments, including one candidate who she described as a "strange dude" who "sounds pretty crazy."

IIRC, my point was that if the accounts were used to EVADE state requirements there was a de facto "mens rea" and the emails should be "discoverable"... She's less relevant to the public debate anyway...the new GOP strategy is simply "We ain't Obama"...if the GOP should somehow regain the WH in the next couple of presidential cycles he might be made Secretary of Hypocrisy but that's about as far as she'll go... My Dad used to have a saying that was a corollary to the Peter Principle..."The further up the flag pole a monkey goes the more of his ass he shows..." that is applicable to her...

Packrat is a two faced sniveling little coward...he had been trying to get me banned for over a year...it was his next personal mission after getting glc banned. And for as much shit as you get for who you are and what you do - especially by me...I have to say that you always sat there and took it and never complained... I don't like to see anybody banned from any forum, but I couldn't think of a counter argument. Okay...I laughed but considering how often you've had accounts closed or limited there and have been allowed to reappear it's kind of disingenuous for you to "say" that... Unless packrat sent some private email to Goldi that no one knows about, he had nothing to do with getting you banned. I thought it was a pretty obvious and often used bit of rhetoric that anybody who has been on Internet forums more than one day should have recognized, but I can't read her mind and i don't communicate with her. Well, I've been posting a lot of Palin's own statements so I'll probably be next. You know how they feel about exposing the pseudo sacred psycho virgin as less than conservative.

Some time last year, packass and Goldi were discussing something and packass said that that he'd contact Goldi directly with more information. ON the day that I was banned, I tried to post something but got booted when I hit send and then couldn't log back because I was "suspended" so I emailed her right away and asked what the problem was. I heard nothing. About a half an hour later, Goldi's post announcing my suspension appeared. After I read that post, she got a second email from me - probably within 2 minutes of that post - stating that I would not apologize...and good luck and happy trails...I got a total of one email from her which came two days later...again i told her happy trails and thanks for the years... I have no doubt that packass contacted her demanding action.

I spent the last year kind of looking over my shoulder...the day that I was banned it was six of one, half a dozen of the other as to which post it was that caused it because it was a half of an hour from her "suspending" the account to her actually posting why... I actually laughed my ass off when I read why but I ***think*** that reaction was going to happen no matter what because I always knew that packass would be behind it...

I also happened to notice that your banning occurred after someone stated that she was allowing you to post (in spite of your evil self) so that she could still count on your generous donations. I think that embarrassed her and, goodness knows, this is not a person who likes to be publically embarrassed. So, she took your money first and then banned you. HELLO, BTW.

I understand (although just who got taken to the woodshed and when seemed erratic and suspect, at best). I lost interest in the site as it appeared to be going in the direction of too many "hoods" to suit me. Some of the comments about Haiti were deplorable. I really didn't think people would sink so low. Oh well, I guess it's simply an indicator about how these people feel about their own lives. It did prompt me to make a donation to Doctors Without Borders...LOL.
Americans have donated nearly a half BILLION dollars thus far to Haiti relief organizations.. Hopefully it won't be stolen!
