Colin Kaepernick is still in the process of trying to prove NFL owners got together and decided not to sign him because of his national anthem protests, and his attorneys are looking to take the case to the next level.

Charles Robinson of Yahoo Sports reports that Kaepernick’s legal team is expected to seek federal subpoenas that would compel Donald Trump, Vice President Mike Pence and other government officials to testify in the free agent quarterback’s collusion case. The goal will be to prove that statements about anthem protests from Trump and his camp directly influenced Kaepernick’s standing with the league.

The aim will be a dive into the administration’s political involvement with the NFL during Kaepernick’s free agency and the league’s handling of player protests, sources said. This after recent disclosures that multiple owners had direct talks with Trump about players kneeling during the national anthem. The content of those conversations between Trump and owners – as well as any forms of pressure directed at the league by the administration – are expected to shape the requests to force the testimony of Trump, Pence and other affiliated officials, sources said.

As Robinson notes, there will be a lot of hurdles to clear before Trump could actually be forced to testify. For starters, an NFL arbitrator would have to rule that testimony from Trump and others is relevant to the case. That would allow Kaepernick’s attorneys to seek federal subpoenas under the Federal Arbitration Act. That would only be step one, as Trump could decline and leave it up to a federal judge to determine if the president can be forced to sit for a deposition.

NFL executives have essentially admitted that Trump influenced the league’s new national anthem policy, but that could be a different argument altogether. That doesn’t necessarily prove that teams blacklisted Kaepernick.

If anything, the NFL’s biggest issue could be the poll it reportedly conducted that mentioned Kaepernick by name. While Trump has been incredibly outspoken about the anthem issue, it seems unlikely that the President of the United States will be forced to testify in a case about a free agent NFL player.

Concede the point for the sake of argument and you've got a big "So what?"

The behavior of Kaepernick and his followers directly influenced Kaepernick's standing with the league. Kaepernick opting out of the last year of his contract with the 49ers, and his choice to become a free agent, directly influenced his standing with the league.

The evidence is indisputable that the behavior of Kaepernick and his followers has cost the NFL hundreds of millions, if not billions, of dollars. In addition, it is indisputable that said behavior has cost the NFL millions of former fans. Viewership is down, and empty stadium seats are up.

Kaepernick made himself so toxic that no owner is willing to take on all of that baggage to obtain a mediocre quarterback. There is no more collusion against Kaepernick than Johnny Football. Johnny can prove he has mended his ways and is worth adding to a team, or not. Kaepernick repeatedly shit the bed.

President Trump used his bully pulpit to appeal to the American people. He did not collude with the NFL, he was their antagonist. The NFL wanted to deny they had a problem and hide it. Many of the American people chose to use their constitutional right to freedom of association to not associate with an NFL demonstrating Antifa and BLM values, and the lack of balls or judgment to do the right thing. The NFL continues to suffer as a result of its mismanagement of the situation.

I think this is the key point. He chose to become unemployed when he had a valid contract. And it is no one else's fault that he made himself so radioactive that no one wanted to hire him. His performance as QB wasn't strong enough that anyone wanted him, with or without the anthem controversies.

Not so strangely, Kapercommie's lawsuit actually will hurt the anthem protest cause. He will lose, anyone trying to do protests like that will make themselves a little less (or a lot less) employable, etc. As a result, only players that are ready to retire are likely to take a knee.

Heck, even Tim Tebow isn't taking a knee to pray in the baseball minor leagues. Too bad he didn't learn to pray off the field before it caused him to look less desirable to NFL owners. And I do think it affected his career and was not considered a plus for him overall.

I think the fans and owners are happiest when people leave their politics and religion back in the locker room. It is a team venue, not a "personal platform" for personal activism or religion. Just like the Oscars and other big awards shows who keep losing viewers, the NFL needs to stick to business: football. Not some dumb jocks with political or religious issues.
