Title: Stormy Daniels sues Trump for defamation over 'con job' tweet

Adult film star Stormy Daniels has filed a defamation suit against President Donald Trump for a tweet that said a forensic sketch of a man who allegedly threatened her in 2011 was "a total con job."

Daniels, whose real name is Stephanie Clifford, claims she had a sexual encounter with Trump in 2006 and was warned by an unidentified man to keep quiet about it five years later, after she gave an interview to a gossip magazine.

The lawsuit filed Monday in federal court in Manhattan centers on an April 18 post on Trump's Twitter account in which he reacts to another person's tweet about the sketch.

"A sketch years later about a nonexistent man," Trump's post said. "A total con job, playing the Fake News Media for Fools (but they know it)!"

The suit alleges Trump's comment amounts to an accusation that Clifford fabricated the threat and exposed her to ridicule and violent threats.

"Mr. Trump used his national and international audience of millions of people to make a false factual statement to denigrate and attack Ms. Clifford," the complaint says.

Trump's attorney had no immediate comment on the defamation claim.

Read Stormy Daniels' defamation lawsuit

Clifford's attorney, Michael Avenatti, said, "Regardless of who you are or what position you hold, you are not permitted to fabricate statements in an effort to deceive people. There are consequences for doing that."

This is the second lawsuit that Clifford has filed against Trump. Earlier this year she sued him and his personal attorney, Michael Cohen, to dissolve a confidentiality agreement she signed days before the 2016 election in exchange for $130,000.

Last week, a federal judge put the earlier suit on hold for 90 days because Cohen is now under federal investigation in connection with the payment to Clifford.

The White House has said Clifford's allegations are false.

"I've had conversations with the president about this," Press Secretary Sarah Huckabee Sanders said in March. "And as I outlined earlier, that this case had already been won in arbitration, and that there was no knowledge of any payments from the president and he's denied all of these allegations."

Earlier this month, aboard Air Force One, Trump told reporters that he didn't know about the $130,000 payment to Clifford and said they should ask Cohen. Cohen has said that he paid the hush money out of his own funds and was not repaid by the Trump campaign or Trump Organization — though he has not explicitly said Trump himself didn't repay it.

Last week, during a live interview, Trump appeared to acknowledge that Cohen was representing him in the payment arrangement.

"He represents me like with this crazy Stormy Daniels deal, he represented me," Trump said in a phone call to "Fox and Friends."

Clifford underwent a polygraph test in 2011, and the examiner concluded she was telling the truth when she said she and Trump had unprotected sex in 2006. She took the exam at the request of a magazine that interviewed her about the encounter but didn't publish a story about it at the time.

She contends the confidentiality pact she signed in 2016 is invalid because Trump didn't sign it. Lawyers for Cohen and Trump say the president was not a party to the agreement, so his signature wasn't required.

Stormy the worn-out porn whore!

This is so damned ridiculous. She allegedly screws, gets $130,000 and now wants to hog the spotlight and our leftist press accommodates her. (1 image)

Assuming they did have this affair, and assuming Trump did want to pay her to be silent about it, what exactly is Stormy upset about, and why would Trump have committed any illegal act? Whatever happened was long before he got elected.

It's not like Trump got serviced by an intern in the Oral office, is it?

I guess I'm not up on all the steamy details. I have my criticisms of Trump, but this one isn't one of them.

"...what exactly is Stormy upset about..."

"...why would Trump have committed any illegal act?..."

Stormy is a capitalist. Stormy has a product to sell and wishes to sell it.

She believes that she has found a loophole in a contract that will allow her to increase her revenue and net income.

She has a competitor who has made statements and taken actions to hurt her ability to produce revenue.

Stormy is looking to the courts to decide what is fair and what is unfair in this matter.

defamation

I don't mean the defamation claim, though I doubt she has a claim there as this case is already in the public domain. Celebrities pretty much forfeit any defamation claims by way of their being celebrities, as public discussion and speculation about them is considered legitimate public discourse.

Trump likewise, cannot sue for defamation either for things said about him as he's well achieved celebrity status.

That's a general rule, at least. I'm sure things can go too far.

But I was referring more about her original spat with Trump. I took the time to read up on it. It seems Trump was married at the time of the alleged encounter, and wanted it kept quiet and was willing to pay to keep it so. Stormy signed a contract but wanted to renege on it, claiming Trump didn't personally sign it, so now the alleged affair is public, and Trump is now denying it ever happened. So now Stormy is upset because she's gone public with claims of an encounter that is being contested. It seems it's important to Stormy that the world know she had sex with Trump, and wants to renege on a hush contract, but otherwise has no claim to damage.

I guess the questions comes down to *why* she wants to renege on this contract. Does she feel she was raped? Does she feel the amount of hush money isn't enough? I don't know what other reason for her claim would be. And now that her claim is public, I don't know what she stands to gain. Certainly no hush money will be offered at this point. So if she simply wants to establish as public record she had sex with Trump, then ultimately, it will come down to nothing more than a "he said/she said" claim.

Certainly it wouldn't be surprising to me if it was true. But whatever Trump's sexual escapades were with Stormy, they occurred long before he ran for the presidency, and don't hold a candle to the political corruption that Hillary engaged in.

And now that her claim is public, I don't know what she stands to gain.

You know as much as I do...

I'm guessing there are several issues for her.

1. She has claimed the NDA is void, Cohen claims it is not and that Stormy breached it - leaving her open to damages. So She asks the court to decide.

2. She can profit from the story - appearances, book deal, etc - so she must make sure she is not bound by the NDA

3. The defamation claim is simply a way to keep the ball rolling...?

4. It's all about the money - just like it is for DD45

In which case her motive was likely Trump's winning the presidency. Or maybe she's on the "I hate Trump" bandwagon as so many people are, in which case it doesn't look good for her.

I think she took the $130,000 believing that GS Donnie would lose.

Now that he's POTUS, there's a lot more cash to be made....

just speculation............
