California AG Will Prosecute Employers For Helping Federal Immigration Officials

January 18, 2018| by Brian Anderson

This is the most insane bonkers thing ever, even for California. The state attorney general says he plans to prosecute employers if they assist federal immigration officials in any way. The state won’t arrest illegal aliens, even for breaking state laws, but they are going to bring the hammer down on business owners for aiding in the enforcement of federal law. When California declared itself a sanctuary state, they really meant it.

This travesty is courtesy of The Sacramento Bee:

The state’s top cop issued a warning to California employers Thursday that businesses face legal repercussions, including fines up to $10,000, if they assist federal immigration authorities with a potential widespread immigration crackdown.

“It’s important, given these rumors that are out there, to let people know – more specifically today, employers – that if they voluntarily start giving up information about their employees or access to their employees in ways that contradict our new California laws, they subject themselves to actions by my office. We will prosecute those who violate the law,” said state Attorney General Xavier Becerra.

That’s not entirely true. He won’t prosecute illegal aliens for breaking the law. The law that Becerra is talking about enforcing is called The Immigrant Workers Protection Act and it went into effect January 1. Here’s some of the provisions:

Requires employers to ask immigration agents for a warrant before granting access to a worksite.

Prevents employers from voluntarily sharing confidential employee information without a subpoena.

Requires employers to notify their workers before a federal audit of employee records.

Gives the attorney general and labor commissioner exclusive authority to enforce new provisions of state labor laws.

Prohibits employers from re-verifying information on employment verification forms, unless compelled to by federal law.

This ill-conceived law forces California employers to violate federal law and, should it arise, to obstruct federal investigations. I’d actually like to see Becerra prosecute one of these cases because it will end up going all the way to the Supreme Court, where the Cali law will get annihilated. I also think that if the AG hauls an employer into court over this, there will be massive outrage, even from liberal Californians.

The reason why Becerra issued this warning is equally as dumb:

Becerra’s warning comes as fears spread of mass workplace raids following reports that immigration agents plan to target Northern California communities for deportations due in part to the state’s “sanctuary” law, which seeks to restrict local law enforcement agencies’ ability to cooperate with immigration authorities.

Immigration and Customs Enforcement’s acting director Thomas Homan told a Fox News host earlier this month that “California better hold on tight… If the politicians in California don’t want to protect their communities, then ICE will,” prompting a query from Sens. Dianne Feinstein and Kamala Harris to brief them on how raids are prioritized.

Putting this all together: California is shielding illegal aliens so the federal government is going to ramp up its enforcement efforts and the state’s response is to go after lawful business owners. That may be the most liberal thing that is or ever was.

If you are keeping track, California’s law enforcement priorities are: 1) otherwise legal gun owners who don’t comply with the state’s unconstitutional gun laws and 2) business owners who won’t help shield illegal aliens. Killers, rapists, and robbers? Not so much.

Nearly all of these are unconstitutional. Becerra is relying on the Ninth Circus to uphold this mess and stall and delay. And the CA gov and libmedia will crucify any employer who tries to challenge the law in court.

I think Sessions will have a strategy to defeat this.

I was gonna say -- flip the situation and the first thing the liberals would do is file a suit and get a stay.

You know they'll run to the Ninth Circus at the first challenge who will then uphold the law and stall its resolution for, well, as long as Trump is in office if not longer.

Trying to forbid business owners from complying with federal law or voluntarily producing their records is clearly unconstitutional.

Recall how they stayed the Arizona laws and ultimately prevailed because "immigration law is a federal matter". Sure it is. Until the Blue state libs don't like it. Then it isn't the law at all.

"Trying to forbid business owners from complying with federal law ..."

That truly crosses the line. When California decided not to enforce federal marijuana laws, that was bad enough.

But to pass a law forcing private citizens to violate federal law ... well, start building the gallows. This is a clear violation of the Supremacy Clause (Article VI, Clause 2) and the very definition of sedition.

You can be sure that the Ninth Circus will find a way to debate that issue for several years at a minimum. And Grandma Roberts will likely let them get away with it because otherwise the WaPo Wassholes and Slim's Slimes will write bad things about him and make him start crying.

I hope he does. Sooner or later he will piss off somebody with the money to take it to court, and chances are the AG might end up facing a lawsuit. He might claim immunity due to his position, but that's bullshit because we don't have royalty in America. The laws are supposed to apply to everyone, and he is KNOWINGLY breaking federal law while abusing the powers of his office.

In the entire history of the world, the only nations that had to build walls to keep their own citizens from leaving were those with leftist governments.

The best one is to have US Marshall's show up at the AG's office with arrest warrants, and haul his ass off in handcuffs.

I just don't see any state or local LEO's drawing firearms or physically attacking US Marshall's with federal arrest warrants. NOT a good career move.

I am not aware of any law that makes the 9th Circuit Court exempt from arrest for obstruction of justice.

But they are. That is very unlikely to change.

The only thing you can do is impeach a federal judge. And that only happened to Dem Alcee Hastings when they had him on tape taking bribes. Didn't slow him down as he got himself elected to Congress. But even Pelosi wouldn't let him have the chair on Intelligence when his seniority warranted it because of his history of bribery. Instead, she installed Jane Harman, an ugly old woman who just happened to be sleeping with a handsome younger Mossad agent. She got in trouble and was run out of Congress.

NOBODY is immune to arrest. Not even the President.

He still has a seat on that committee, and is still getting regular briefings on classified plans and operations. Yet nobody seems to be worried about a federal judge convicted of taking bribes to throw cases is now in a position to make millions from selling national security secrets. He's black and he's a Dim,so nobody can touch him.

In the entire history of the world, the only nations that had to build walls to keep their own citizens from leaving were those with leftist governments.
