A Valparaiso man faces a felony charge of obstruction of justice after police said he allegedly ate a partially smoked marijuana cigarette and had bits of marijuana stuck to his teeth.

Deputies with the Porter County Sheriff's Department arrested Kyle D. Reineke, 28, of the 300 East block of U.S. 6, after a traffic stop around 3:50 p.m. Sunday on Harmel Drive near LaPorte Avenue.

A deputy stated in a report that Reineke was allegedly driving behind him on Indiana 2 near Eastport Center Drive and changed lanes without signaling. Reineke also appeared to be slowing down to create distance between the two vehicles and, as seen in the deputy's rearview mirror, appeared nervous.

The deputy was able to slow down enough to let Reineke pass him in the left lane and then initiate a traffic stop.

The deputy said in the report he allegedly detected "the overwhelming odor of raw marijuana mixed with burnt marijuana" coming from inside the car.

When the deputy asked Reineke to get out of his car, he realized the odor was coming from Reineke, according to a report. During a pat down, Reineke allegedly put a piece of gum in his mouth.

When police asked him to open his mouth, which the report states he did "reluctantly," police "observed pieces of raw and burnt marijuana stuck to the piece of chewing gum and to Kyle's teeth."

Reineke told police he ate about half of a joint or less and did so in an attempt to destroy it to avoid criminal charges, and ate it shortly before police initiated the traffic stop, a report said.

Police transported Reineke to Porter County Jail.

Wow - that cop must have super powers - he could tell that just looking at him?

And so what if he did appear nervous - most people would be when they see a badged revenue collector behind them.

Obstruction of justice? For swallowing half a joint before he was even pulled over?

What a joke law enforcement has become.

I will say though the guy was foolish to admit it.

Of course he was. If he was going to admit anything, he should have said it helps him with his digestion.

Still, I can't imagine the charges are legit as they are for something he did before he was even stopped, and before he was even suspected of being involved with drugs. That line of reasoning would mean anyone that puts a potentially illegal item in a hidden place at any time before police execute a search warrant would be guilty of the same thing.

Expecting accused to show potentially incriminating stuff to the police obviously runs afoul of the 5th Amendment. Declaring it a crime to hide such evidence from the law would seemingly violate the 4th.

I wonder if the same thing would apply if someone after having one drink, mabe an hour before, was being tailed by cops and decided to put a breath mint in their mouth.

Would that make them guilty of "obstructing justice" or would that be "tampering with evidence"?

Although the breath mint is perfectly legal (for now) I suppose a zealous prosecutor could make that argument.

Of course the cops can always claim that the mint was Ecstasy

They should use mouth wash since it has alcohol in it. I heard the story many years ago of a guy getting off for that reason. He may have been drunk as a monkey too; I don't recall that detail.

Anyways, this yahoo converted a civil violation with a $200 fine to felony obstruction under Illinois 720 ILCS 5/31-4(1): Destroys, alters, conceals or disguises physical evidence.

I got pulled over for a DWI, and put a candy cane in my mouth when the cop came to the car. He told me to throw it away, which I did not do as it was good. He put me through the paces of a roadside test, while I continuously asked for him to give me a breathalyzer. After I failed the test miserably, as I have one leg 2 inches shorter and with a fused ankle and cannot walk straight, he gave me the test..I blew a 0.000. He apologize and let me go my way, but what a waste of time.

THIS IS A TAG LINE...Exercising rights is only radical to two people, Tyrants and Slaves. Which are YOU? Our ignorance has driven us into slavery and we do not recognize it.

And you…YOU…. never bothered to stop at any one of them at anytime and make a citizens arrest or at least let them off with a warning….like this lady who had more balls than you will ever have did:
