The Supreme Court is expected to take up this week the case over whether a Colorado baker discriminated against a gay couple because he declined to bake a cake for their wedding. The case – Masterpiece Cakeshop, Ltd v. Colorado Civil Rights Commission – asks the high court to balance the religious rights of the baker against the couple’s right to equal treatment under the law. Similar disputes have popped up across the U.S. The decision to take on the case reflects renewed energy among the court's conservative justices, whose ranks have recently been bolstered by the addition of Justice Neil Gorsuch to the high court.

Jack Phillips, the owner of Masterpiece Cakeshop in Lakewood, Colo., declined to make a cake for the wedding celebration of two gay men in 2012. Phillips told the couple that he would make a birthday cake but could not make a cake that would promote same-sex marriage due to his religious beliefs.

July 2012

Shopping for a cake for their upcoming wedding and celebration, couple David Mullins and Charlie Craig stopped into Masterpiece Cakeshop.

Jack Phillips, the bakery’s owner, informed the couple that he did not provide cakes for same-sex weddings and celebrations due to his religious beliefs. “What should have been a joyous occasion had turned into a humiliating occasion,” Deborah Munn, the mother of Craig, wrote in a blog post for the American Civil Liberties Union about the experience.

The ACLU of Colorado represented the same-sex couple in their complaint against Phillips.

December 2013

Judge Robert Spencer of the Colorado Office of Administrative Courts decided — in line with the Colorado Civil Rights Division (CCRD) — that the bakeshop had violated a Colorado law which prohibits businesses from refusing service due to a person’s sexual orientation.

Masterpiece Cakeshop appealed the decision.

May 2014

The Colorado Civil Rights Commission decided at a public hearing that Masterpiece had violated Colorado's Anti-Discrimination Act, or CADA. COLORADO BAKER RECEIVES DEATH THREATS AND HATE FOR REFUSING TO MAKE GAY WEDDING CAKE

Phillips was ordered to change its company policies as well as offer “comprehensive staff training” to employees. The cake shop was also required to provide quarterly reports about how it handled prospective customers.

August 2015

The Colorado Court of Appeals ruled that Phillips cannot cite his religious beliefs in his refusal to provide a service to same-sex couples. With the ruling, Phillips could face a penalty if he continues to deny wedding cakes to same-sex couples.

April 2016

The Colorado Supreme Court declined to hear the appeal from Phillips.

July 2016

On behalf of Phillips, the Alliance Defending Freedom, a conservative legal nonprofit, petitioned the Supreme Court to hear the case.

SUPREME COURT IS IN SESSION WITH GORSUCH ON BOARD, GAY WEDDING CAKE CASE ON DECK “We are asking the U.S. Supreme Court to ensure that government understands that its duty is to protect the people’s freedom to follow their beliefs personally and professionally, not force them to violate those beliefs as the price of earning a living,” ADF senior counsel Jeremy Tedesco said in a statement at the time.

June 2017

The Supreme Court agreed to consider the case during its next term, which began in the fall.

December 2017

The Supreme Court is set to take up the case on Dec. 5. Then, the justices will hear oral arguments.

The queers have a right to grievance about government policies and procedures. But this court case isn't about a government institution denying their rights nor the private shop owner not performing due diligence to meet his market objectives.

Court will favor the shop keeper's rights. Wanna bet?

If any USC justice rules against the baker... then their is no true freedom in this country, at all. The very idea that I can't decide who enters my house or who I cater to as a customer, in my privately owned business, is just wrong.

Plenty of silly cock sucking faggot bakers that would be happy to make the pickle smoocher cake. The USSC does not need to force any baker to bake a faggot cake.

If they do decide against the baker... then I think every Klansman needs to bring their KKK uniforms into every George Jefferson dry cleaners... and DEMAND THE OWNER TO WASH THOSE SHEETS!

I agree, unless the reason service is denied is because the clients are black. That particular issue was litigated in blood on 100 battlefields, and the full result of that fight has to be enforced. But gays aren't blacks, aren't segregated unjustly, aren't former slaves. Neither are Latnos., or anybody else. Amerindians are the only people with a somewhat common history, but in their case the litigation should focus on treaty rights. With the blacks, it's the right not to be discriminated against.

But that particular case cannot be extended to everything else.

Hatred and bigotry is not illegal, nor should it be. My opinions are protected... your feelings aren't.

I should be able to put a big sign up on my PRIVATELY owned business... that takes no tax funded subsidies.... "NO NIGGERS ALLOWED". The success of my business should only be defined by the size of my customer base. If I can still turn a profit, and CHOOSE to be ignorant... then THATS AMERICA. Telling me who my private business should cater to... is Nazi Germany.

That was a fine statement, heartfelt….and I personally feel that you are correct.

Unfortunately in the attitude of today’s legal environment, I believe the liberal justices do not feel that way and the baker is going to lose.

You say you “should” be able to do those ridiculous things. Well, you can’t. If you do, you will be shut down, crushed by the law. Your kind has been at war with my kind for 170 years. Your side has resorted to war, even, to assert those “rights” you claim. You lost. With much bloodshed. You lost, fought again, and lost again. Over and over again. No, you don’t have the right to operate a business that won’t serve blacks. You assert you do, just as your type has so many times. You always lose when you try. So, you are cordially invited to sink your money and your time into a business, and then to try to bar blacks. I and my kind will be more than happy to come in with force and take what you built and destroy it, leaving you without anything to show for your efforts. You want to relight the Civil War and relitigate the Civil rights movement? Fine. Bring it. Crushing your type AGAIN will be my pleasure. Lather, rinse, repeat until your kind admits defeat. You do not in fact have the right to exclude blacks from your private business in America. You lost that right in the Civil War and the civil rights struggles, and your side is not strong enough to change the result.

Yes, unequal treatment under the law. So much blood has been shed over this issue that the victors have imposed victors’ justice. The victors are aware of the unequal treatment, and take pleasure in the fact of their power to impose it. The two sides hate each other, and the one side is much stronger.

Sotomayor, certainly. Kennedy, to an extend.

Thomas opposes it. Alito all most certainly opposes it.

That leaves the Chief Justice, John Roberts. How he would vote is anybody's guess.

Gorsuch was baptized and raised Catholic, but attends an Episcopal Church (which is the opposite of Catholicism on issues) - so he's not a Catholic.

You go ahead and try, racist, and we'll have uniformed cops and civilian clad prosecutors crawling up your ass, shuttering your doors, and forcing you to obey the law just like everybody else.

This was fought out on the battlefield and in the courts. Your side lost. If you want to go out on the battlefield again, by all means DO. It gives us the excuse to make an example out of you. And believe me, it's our pleasure to do it. Because you see, we hate you everybody bit as much as you hate us, but we are much, MUCH more powerful than you, the law is on our side, the armed might of the nation is on our side, history is on our side, the majority of the people are on our side - and did I mention that we hate you? - emotion is on our side.

So DO please assert a right you do not have, and assert a power you do not have, so we can beat you to your knees and make an example out of you.

Wanna die on this battlefield? So did the guys in butternut and grey. And they DID die on that battlefield. And they lost. Lather, rinse, repeat.

The problem with telling somebody on the Internet to STFU is that it guarantees that he won't.

The debate Was ABOUT whether business owners in America have the right to exclude blacks.

And the answer is "No".

When pressed as to why, there are two possible answers: (1) A long explanation. or (2) We won, you lost.

I prefer answer 2, because it's true.

Your notion that someone MUST bake a wedding cake for gay blacks, but not gay whites is ridiculous on it's face.

The fact is that you don't have to bake ANY gay wedding cakes, regardless of race! DUH!

If a biracial gay "couple" comes into your bakery and the white one orders a gay wedding cake, you can tell him to F' off, but if the black one orders then you have to start baking?
