Norfolk, VA For weeks, Sarah Sims said she called and emailed school officials repeatedly to tell them her child was being bullied at school and was never given a response. So, she took matters into her own hands and now she is facing felony charges.
Sims discovered her daughter was being bullied in late September. So, like any parent would do, she reached out to school officials for help. But she received nothing.
The thing that bothers me the most is that I am yet to get a response from anyone in the administration, Sims added.
After being shrugged off by the school, Sims decided that she would take matters into her own hands and catch her 9-year-old daughters bully.
I tried to be fair, but its not fair, said Sims. There is nothing fair about this.
She wanted to obtain proof that nothing was being done to help her 4th-grader, so she put a digital recorder in her backpack to capture audio from inside the classroom.
If Im not getting an answer from you, what am I left to do? she asked.
Shortly after placing the recorder in her daughters backpack, it was found by the school who has a no electronic device policy. Her daughter was then moved to a new class and police came after Sims.
I was mortified, Sims said. The next thing I know, Im a felon. Felony charges and a misdemeanor when Im trying to look out for my kid. What do you do?
Local news outlet WAVY contacted the Norfolk School system for a comment and they were told because it is a pending investigation no one could comment on what happened. We were told that in elementary schools, no electronic devices are allowed.
They arent making this about that classroom, said Sims attorney Kristin Paulding. [These] are charges that carry jail time.
According to WAVY, Sims was charged with felony use of device to intercept oral communication and misdemeanor contributing to the delinquency of a minor. The felony charge could carry five years in prison.
Instead of comforting her shes going to a magistrate and being handcuffed, Paulding added.
For simply listening to what her own child went through during the day via a recording device, this mother is facing a felony charge that can land her in jail. Hopefully, as her attorney notes, these charges wont hold up in court.
We are at the very early stages of this, but even at the early stages I think the community needs to know that this is happening because any parent out there that is sending their child to school now could be at risk for something that happened to Sarah, Paulding said.
Sadly, TFTP has reported on mothers putting recording devices in their childs backpack to catch bullies after the school failed to act. Megan Dowdy was one of those mothers.
Dowdy said her son had been having night terrors. She suspected something wrong was happening at school, so she placed a recording device in her sons pocket. Her child, whos 13-years-old and autistic, has the cognitive skills of a first-grader and the communication capacity of a kindergartener, according to Dowdy. She said his behavior at night led her to believe something terrible was happening at school. She said, He kept getting up during the night having night terrors, screaming, having meltdowns for no reason.
What Dowdy found with her recorder was horrifying. Her autistic sons bully was a cop.
A Pinellas County school resource officer, serving in Osceola Middle School, was caught on audio recordings abusing the autistic child. Ironically, the officer, Ural Darling, had been celebrated as one of Floridas top school resource officers for his work in preventing bullying. All that has since changed now that Darling has been found to be the bully, caught by the students mother verbally torturing the child.
He was fired in August but unlike Sarah Sims in the story abovewho merely tried to catch her daughters bullythe officer was not charged.
Mommy probably didn't tell her little angel that she was being used like a chump. Mommy didn't know that in Virginia, at least ONE PARTY needs to know they are being recorded... or it's an illegal wiretap or ease dropping felony.
With a mommy that stupid... no wonder her mutts get harassed at school.

When I first read the story, I just assumed her daughter was being bullied by other students. But it now appears as though she was reprimanded by either her teacher or the school resource officer for her behavior in the classroom.
Of course the little darling would call it bullying because she dint do nuffin. So her mom seeks revenge for her daughter's treatment by attempting to record the confrontation in the hopes of getting them fired.
that parents cannot collect objective evidence to support their otherwise serious complaint.
That millennial whore can collect all the evidence she desires... she can't break the law to do it. Maybe she should have applied for a warrant to record.
Virginia'swiretapping law is a "one-party consent" law.Virginiamakes it a crime to intercept or record any "wire, oral, or electronic communication" unlessone partyto the conversation consents.VirginiaCode § 19.2-62.
The crime of recording the conversation the child was involved in, dumb shit?
No... the crime of recording the teacher AND ANYONE ELSE BESIDES HER CHILD you simpleton stupid mother fucker. You think the child was turning the recording device on and off when OTHER PEOPLE were being recorded, outside of any conversation the child was involved in?
No... the crime of recording the teacher AND ANYONE ELSE BESIDES HER CHILD you simpleton stupid mother fucker.
Classrooms aren't private, Comrade Stasi Dipshit.
[Only Private Conversations are Protected
Under these laws, the first question you should always ask yourself is whether the conversation youre thinking of recording is actually covered by the statute.]
"Floridas wiretapping law requires that both parties in a conversation give consent before a recording can be made. Florida makes it a crime to intercept, or record, any wire, oral, or electronic communication, unless all parties to the communication give consent. However, the law allows recordings to be made in places where there is no reasonable expectation of privacy, such as a conversation in a public where they could be overheard. In such cases, consent is not needed for someone to make a recording." http://www.ocala.com/news/20101225/is-it-legal-to-secretly-record-a-teacher- in-class

For the last time, a school classroom isn't "public". You can be told you aren't allowed inside the school. A classroom isn't any more public than the inside of the Whitehouse... think that place is public, cock breath?
Amanda Howie, spokeswoman for the attorney's office, told CNN that the office decided against prosecuting the case despite having evidence to support the charges.
It wasn't "game set or match". The DA decided to drop the charges because you and libtard society feel the need to make "bullying" the next Ebola epidemic... so we can weaken our future millennials further. There was over 6,000 petitions signed by SHEEP that didn't give a fuck about the legality or constitutionality of the case... they, like you, couldn't cope with a child being bullied. If big fat black mom walked in the school and shot the teacher... libtards like you would want her not charged. It's YOU that's wrong with society. It's your thinking that's moved us LEFT THROUGH WEAKNESS.

So...bullying weaker kids is a "good" thing?
There's no doubt in my mind that when you were in school, you constantly bullied smaller kids, maybe even kids simply because they were smarter than you.
That's probably the reason you became a cop. Your badge encouraged you to be a sadistic asshole - and you got paid to do it.
Your pseudo macho rants here are indicative of an authoritarian tyrant who would like to eliminate those who are in his eyes "unworthy".
Kind of like that guy who ruled Germany a few decades ago.
