I suppose a jury might if the accused had competent counsel. She is careful not to overstate the case and to point out where there may be doubts. A video clip clearly has the mother stating that Heather Heyer died of a heart attack. The photo used all over the news appears to misrepresent the appearance of the Heyer at the time of her death. The person on the back of the car appears to be dressed differently than Heyer. Where I have difficulty is identifying Heyer in the crowd. If Lauren Rose is correct in that identification, then it would seem that Heyer was never struck by the car. I would disagree with Lauren Rose that the driver would nonetheless be criminally culpable for involuntary homicide. I would see no way to prove, beyond a reasonable doubt, causality. I did not see this before last night and offered it without comment to see what other people saw, as well as its general interest.
I agree. Assuming the accused has competent counsel and some expert witnesses. I don't think that will be the case. He'll be effectively presumed guilty, much easier since he is mentally ill. Well, I seem to recall you had a certain skeptical outlook on this supposed crime from the first day of reporting but perhaps that is just my perception.
I don't think that will be the case. He'll be effectively presumed guilty If Heyer was not struck by the vehicle, but just had a heart attack on her own, I would see no involuntary homicide charges being brought regarding Heyer. That is not to imply he will not be charged with other things involving other people. I posted a pic of the back of his car being struck by a bat-like "flagpole" before he got through the intersection prior to the one involving Heyer. I opined that he may have hit his accelerator as a reflex action, out of panic, rather than intent to harm. It made the nature of the event unclear. Below is a clear still photo. The kid at the left rear of the Dodge had just struck the car with the bat/pole in his hand. The mark on the lower left quadrant of the rear bumper appears to be where the bat struck. This was before the rear window had been beaten up, a little further down the road.
I have looked at the various videos from the camera angles that have been released to the public and am not convinced I have a clear idea of precisely what occurred or where/how this woman was hit or where she was at various times when the car moved/stopped/moved. Perhaps you have seen some footage I haven't or have a better grasp of it than I do. I don't think I've spent as much time on it as you have.
I am uncertain if Heyer was hit or not. An autopsy would tell if she were smashed by a car.
Given it can even be trusted; And whether any coroner is inclined to risk his/her life by announcing the findings.
If a criminal case is brought, the autopsy material must be made available to the defense. Just the pictures would show whether she were busted up or not.
YES. Under NORMAL apolitical circumstances. We all know (or maybe some of us know) that there has been an ongoing conspiracy that serves the Leftist/Globalist agenda. The MSM amd PTB have invested a lot of propagandist time, effort, soundbytes in demonizing of Trump and the "KKK alt-Right" in Charlottesville, and specifically this so-called "victim" of the aforementioned. This broad has been the Antifa's Martyr. An autopsy that proves the MSM, officials, and initial investigators lied when they claimed the Martyr died as a result of injuries sustain in the crash perpetrated a hoax will not wash.
It's Brady material. Turn it over or drop the case.
