STATHAM, GA (CBS46) -

There is yet another controversy that has people outraged in one metro Atlanta community CBS46 learned on Friday.

With the controversy surrounding 63 DUI arrests made by officer Marc Lofton in the past year, you could imagine people were outraged to learn that Winder Police charged Lofton’s wife last year with DUI.

She blew a .204 on a breathalyzer test which is more than double the legal limit, but in August of this year, her case was dismissed. 

“She’s married to a police officer and all of a sudden she’s not going to jail and she’s not getting prosecuted, but everyone else in our county and in this city is getting prosecuted for the same offenses and even less,” Statham resident Kendra Moore said.

Lofton is the talk of the town in Statham. The Barrow County District Attorney is investigating complaints which accuse him of policing for profit.

“I’m simply tired of these innocent people and these citizen’s lives being ruined by an officer and apparently by a department that is strictly trying to gain money from it,” Moore said.

Some of those arrested by Lofton argue they were completely sober and falsely charged because they take prescription medication. In light of the dismissal of his wife's case, some are raising questions.

“Now why is that? That’s all we want to know. Why? Not some legal gobbledygook, why didn’t you prosecute?” Statham resident Roger Bradshaw asked.

According to the incident report, Lofton’s wife admitted she should not have been driving.  CBS46 tried calling her and even dropped by the gated community where she lives, but never made contact.

“It smells foul. It stinks, it stinks, it stinks, it stinks. I don’t care which way you try to spin it. The facts, are the facts, are the facts,” Moore said.

CBS46 spoke with District Attorney Brad Smith, about the dismissal of the case.

He said the officer involved had severe credibility issues and no longer works with the Winder Police Department — as a result many of his cases were dropped.

That said, this same officer was honored by Mothers Against Drunk Driving for his excellent work in 2014.

There is not enough information here to know why the charges were dropped. Corruption is a likely possibility, but not the only possibility. As the driver's husband is a cop, he is likely to know the reasons why a Breathylizer test could be invalidated. The NHTSA guideline is to observe the individual 20 minutes before administering a Breathylizer test. He might know that the machine used had not been properly calibrated as required.

There may be a court decision which has invalidated the machine used.

Or the cop husband may be aware of something like this, a state-wide issuance of bogus certificates.

Dozens of pending driving under the influence cases and prior convictions are now in legal limbo in Summit County after Judge Edward Casias deferred to a new statewide precedent that bars the use of blood alcohol testing machine results as evidence.

The precedent, handed down in an order by Gilpin County Judge David Taylor last Monday, admonished state regulators for knowingly producing falsified certificates attesting to the accuracy of breathalyzer machines in court, a practice the defendant in that case described as "the biggest scandal in the history of alcohol testing."

The order came after three days and 20 hours of testimony in the case of Robert Friedlander, who was arrested for a DUI while driving near Black Hawk last year but insists he wasn't over the legal limit.

Given the broad scope of the hearings, Judge Taylor's order is likely to serve as statewide precedent unless prosecutors successfully appeal the order, said Friedlander's attorney Danny Luneau.

"There have been judges all over the state who were waiting for an opinion in the Gilpin case," he said. "I haven't heard of one judge in the state that hasn't deferred to it."

The order potentially affects all Colorado DUI cases from July 2015 to January 2017 that include test results from the Intoxilyzer-9000 machines used in police stations and jails statewide.

The Colorado Department of Public Health and Environment issues certificates that are presented in court to prove the machines are accurate and have been properly tested.

For 18 months, however, those certificates were being generated with the forged signature of Dr. Laura Gilllim-Ross, who had departed from her role as director of CDPHE's laboratory services division in July 2015.

In a sworn statement, Gillim-Ross said she was not aware that her signature continued to be used after her departure, nor was she "involved in any way" with the certification of the machines.

Each Intoxilyzer machine automatically generates the certificates. According to testimony by a current CDPHE employee, the agency knew that the signatures were inaccurate but chose to not immediately fix the problem, instead waiting to do so as part of a planned software update.

The result was thousands of "inaccurate, misleading and deceptive," certificates being filed in court, according to Judge Taylor's order, which found that they were not only inadmissible but also violated defendants' rights to due process.

As the driver's husband is a cop, he is likely to know the reasons why a Breathylizer test could be invalidated.

Right - "Blue Privilege" applies to spouses of cops as well as cops themselves.
