United States News Title: Trump Sends in the Gun Confiscation Cops Remember when Randy Weaver and his family were subjected at their home to a US government siege? Back in 1989, an undercover ATF agent convinced Randy Weaver to sell a couple sawed-off shotguns allegedly in violation of US law. Weaver then did not appear in court in regard to the entrapment-derived gun charges on the correct day after a notice with the wrong date had been sent. Further US government actions included the killing of Weavers son and wife and the siege of the familys Idaho home. The new law is argued to be necessary to stop people from buying guns in other states where gun laws are less restrictive and then bringing the guns in to Illinois, and to Chicago in particular. And Illinois gun restrictions extend beyond these measures. The pro-gun-control Law Center to Prevent Violence so approves the states gun control efforts that, in its Gun Law State Scorecard, it ranks Illinois eighth out of the fifty states. Maybe this guy from the Ron Paul Institute (that I've never heard of) needs to tell us just how many guns the ATF has confiscated recently in Chicago and under which laws (U.S. or state) they were arrested and charged. I see nothing here to indicate those BATFE agents are doing anything other than enforce federal laws. Show us some cases where BATFE is enforcing Chicago/Illinois laws, not federal gun laws.
Enforcement is not the problem. Arresting is not the problem. Charging is not the problem. Conviction is the problem. Gun charges are the first thing the prosecutor drops to reach a plea deal. Even if convicted of gun possession, the average sentence is one year, reduced by 50% for good behavior. New York, for example, is 3-1/2 years.
I was merely raising the question of whether BATFE has arrested anyone to enforce Chicago or Illinois gun laws. The article accuses them of doing this or trying to. But I haven't seen anything elsewhere to suggest that they're doing anything other than federal law enforcement. Which is their job after all. I'm always up for a BATFE-hater thread. But they have to actually do something wrong first.
I didn't interpret the article that way. I assumed the BAFTE would be enforcing federal laws and local authorities would be enforcing local laws. BUT, if jurisdictions overlapped, I got the impression the case would be given to the feds to free up local courts.
I just want the RP guy to provide one single case of BATFE enforcing local or state gun laws in Illinois instead of the federal laws they have a mandate to enforce. Enough with the hypotheticals of what BATFE might do. [Now my stomach is getting queasy from semi-defending BATFE...]
The author is being very vague. He makes the point that if the BATFE were operating independently in Chicago, all would be well. But "the ATFs integrated action with the local police and state prosecutors on gun matters can be expected to unavoidably aid such confiscations". Well, isn't that the idea? Maybe he's saying, "That's not fair!"
In other words, no such thing has happened yet or he'd be screaming about it from the rooftops. Let BATFE exceed their mandate first, then complain about it. Actually, BATFE has gotten pretty quiet since their Guns-For-Mexican-Drug-Cartels program blew up in their faces. You really don't hear much about them at all. Not so many years back, you could expect a story or two every week on their latest sinister plans. Now you can go months without hearing about BATFE doing anything.
Felons are not allowed to own guns....or vote.
