A Sacramento police officer has been relieved of his duties after cell phone video appeared to capture him tackling and beating a jaywalker, authorities said. In the video, a young black man and the white officer seem to be exchanging words in the middle of a suburban street. A neighbor videotaped the altercation with her cell phone, and her screams and sobs can be heard on the footage. "Why you doing him like that!?” yells Naomi Montaie, who posted her video to Facebook, where it quickly went viral. "Why you beating him like that? Oh, Jesus. I seen this, Lord." She identified the man as Nandi Cain Jr., a resident of her apartment complex. He was stopped for illegally crossing the street, authorities said. Many years ago in the 80s my younger brother graduated from college and had something like an 8 month wait until entering active duty as a Marine LT. He took a job at the local police dept as patrolman; he didn't tell them he'd be gone after so many months as he needed a paycheck. He told me of one incident where he and his veteran partner chased down some burglar, on foot, who happened to be black. My brother caught up with him and tackled him and had him subdued. His partner came up and kicked the guy in the head "real hard" my brother told me. Guess the lesson was to not run from cops. My bro was shocked to say the least. This was in South Carolina.
The ones that need the lesson is the bonehead cops. It's crap like that that makes their job dangerous,and they bring in on themselves. I have a basic rule in life that is my personal "Rule Number 1". It states "If you cause bad things to happen to me,even worse things will happen to you." Dashcam Catches Cop Snap As Alleged Jaywalking Suspect Questions His Manhood Del Paso Heights, CA — Newly released dashcam video of an incident the Free Thought Project reported on Tuesday shows just how far police are willing to go to extort people for jaywalking — or alleged jaywalking. It also shows how some cops react when their manhood is brought into question by those they are trying to extort. As we reported yesterday Nandi Cain Jr. was crossing the street when a Sacramento police officer approached him. As seen in the video, the pair exchanged some words just before the officer charged Cain and began choking him. In the original video, we cannot hear what Cain said to the officer as he removed his jacket. As the newly released dashcam video shows, however, Cain was just showing the officer he was unarmed, while questioning the validity of the stop — and questioning his manhood by saying, “if you were a real man, you’d put down that gun and fight me.” This apparent questioning of his manhood sent the officer over the edge and into Cain’s neck. This entire time, Cain had done nothing wrong. It is not illegal to walk away from an officer unless you are accused of a crime. When the officer said he was accusing Cain of jaywalking, Cain stopped. However, this cop couldn’t contain his rage and snapped. Police say, according to Fox40, the officer charged at Cain to take him into custody, then “the officer threw the pedestrian to the ground and began striking him in the face with his hand multiple times.” Cain told Fox40 he didn’t fight back because, “that’s when guns would’ve been pulled out and I would’ve gotten shot. I would’ve been dead.” After repeatedly bludgeoning the man in the face for doing nothing other than questioning his manhood, this officer arrested Cain and brought him downtown. Absent from the arrest report, however, was the charge of jaywalking. This officer only charged Cain with suspicion of resisting arrest. I sure do hope you don't think that dashcam video vindicates the perp. After viewing that video, no public defender in his right mind would take his case.

Let's not confuse the issue. Although it is illegal to walk away from an officer if you are accused of a crime, that doesn't mean being accused of a crime is the only way to stop an individual. Jaywalking gave the officer reasonable suspicion (in addition to violating a city ordinance). Reasonable suspicion is all that is needed for a Terry stop.
