Bannon confirmed that Trump's Cabinet appointments aren't there to govern. They're there to destroy

On Thursday, Steve Bannon — the Breitbart CEO-turned White House adviser — confirmed that President Donald Trump selected his Cabinet of billionaires for the specific purpose of “[deconstructing] the administrative state.”

Bannon argued that “if you look at these Cabinet nominees, they were selected for a reason, and that is deconstruction,” according to The Washington Post. The chief strategist cited as one example the president’s withdrawal from the Trans-Pacific Partnership, which he described as “one of the most pivotal moments in modern American history.”

Trump’s critics had worried that Trump’s picks — including climate change denier Scott Pruitt to lead the EPA — would mean that the government would ease up on regulations.

Bannon, who appeared jointly with White House Chief of Staff Reince Priebus, also denounced the media as “the opposition party,” telling his audience that “if you think they are giving you your country back without a fight, you are sadly mistaken.” He also described them as the “corporatist, globalist media that are adamantly opposed to an economic nationalist agenda like Donald Trump has” and added that “if you look at the opposition party and how they portrayed the campaign and how they portrayed the transition and how they portray the administration, it’s always wrong.”

Priebus joined in, telling the audience that “everything that you’re reading” about the Trump administration has been erroneous.

Bannon and Priebus also took advantage of the opportunity to dispute rumors that they’re engaged in a power struggle, with Priebus praising Bannon as “very dogged” and “incredibly loyal” and Bannon responding that Priebus “is indefatigable. Reince is indefatigable in saying, ‘We’ve got to drive this forward.’” There was also this moment.

It seems a non-controversial statement to me. And Trump did campaign on deregulation and withdrawing from TPP. So why the surprise?

Trump is promising to try to repeal 75% - 80% of all federal regulations. They alone account for much of the power of what is often called the administrative state (the permanent bureaucracies that have arrogated or been granted authority by Congress to write regulations with the force of law).

It is interesting that SCOTUS nominee Gorsuch is himself very opposed to the expansion of power by the administrative state via Chevron deference while Bob Goodlatte has already passed a bill in the House in 2017 to end Chevron deference at all agencies. That bill is moving on to the Senate.

Under Chevron deference (which Scalia defended and which Gorsuch firmly opposes), all courts must defer to the findings of the legal departments of various federal agencies. So courts could not intervene against an EPA regulation if the EPA legal staff insisted it was lawful. In essence, the courts have no control or recourse against federal agencies at all unless they are violating the Bill of Rights or engaging in criminal conduct of some kind. Congress is left just as helpless as the courts.

This is why Gorsuch was considered such a valuable pick. He is as good as Scalia on any other area of the law, is a brilliant writer like Scalia, and he is better than Scalia on this one crucial issue.

If bankers want to figure out how stop bank robberies, they might decide to hire ex-bank robbers, which some banks have. If you want to stop getting hacked, you might want to hire a hacker to assist you.

By that token, if you want to cut the guts out of corporate government, you won't do it by hiring a Paul or a Kucinich or a Nader. You've got to have guys who know what strings to pull and who know where the bodies are buried.
