I did notice he mentioned he is officially a resident as an alien of extraordinary ability, almost certainly here on an O-1 special visa. On Wikipedia's page, they list him and Piers Morgan and Justin Bieber as all holding this type of visa.
So Milo is a legal resident alien holding an O-1 special visa.
