Police turn investigation over to Florida State Attorney's Office

A South Florida couple is outraged after they said their daughter was suspended from her middle school for using a child butter knife at lunchtime to cut a peach, Local10.com reported.

Alternate text if image doesn't load

"There's no one there trying to educate and to be reasonable to say, 'Let's work this out,'" the girl's father, Ronald Souto, said.

Souto's daughter is an honor roll student at Silver Trail Middle School in Pembroke Pines.

"She's always trying to help someone. She's always trying to share things," Souto said about his daughter.

Ronald and Andrea Souto told Local 10 News reporter Michael Seiden that their 11-year-old daughter was suspended for six days for bringing the knife to school.

"This is a set of a spoon, fork and knife for toddlers -- one year old," Andrea Souto said. "It is made for children to learn how to eat properly. She's used it since she was baby."

According to the school district, the girl violated the county's weapon policy when she used her butter knife in the cafeteria to cut the peach.

"The friend asked for half of the peach and she cuts half of the peach and gives to her friend. She goes to the bathroom and comes back and the guy said, 'Follow me,'" Ronald Souto said.

Ronald said he hopes what happened to his daughter will bring change to the district, specifically new polices when it comes to weapons.

He's not alone.

"I think the principal should revisit this and everyone (should) sit down to the table, and let's just say, 'Don't do it again.' This is outrageous to go to that extreme," Melvin J. Smith, whose grandson attends the school, said.

The Soutos said they were shocked about the suspension and are now concerned that their daughter's act of kindness could lead to criminal charges.

"She's afraid now of the educators. She's afraid of people at school. They need to change the system," Ronald Souto said.

A Broward County school district spokeswoman declined to offer specifics about the incident because of "student privacy," but said, "The school followed district policy regarding this incident and continues to work with the student and parents involved.  It is the district's priority to maintain safe and secure campuses for students and staff at all times."

The Pembroke Pines Police Department said it has turned over their investigation to the State Attorney's Office.

It's unclear whether prosecutors will file charges, but the family's attorney said the school board isn't doing its job in this case.

"The school board has abused its discretion to act in this case," Larry Meltzer said. "It is tragic that a school that this little girl loves sees fit to prosecute and suspend her -- the epitome of a model and honor roll student -- for using a child-proof utensil that could never be construed in any form as a weapon in order to share part of her lunch with a fellow classmate.

"This item at all times was used in the school's lunch room as it should be -- to cut a peach and share lunch with a friend," he added. "She should be applauded for her generosity, kindness and for her motivation to be a great student in all senses of that word.

"The only harm that has been exacted in this case is by Silver Trail Middle School and the Broward County School Board upon one of its finest students and upon one who exemplifies the type of person and student it wishes to help create. It is truly senseless and does reflects poorly upon the type of educators and law enforcement involved in this case." (1 image)

Schools don’t just arbitrarily make rules against bringing a knife to school, they usually have a good reason.

Here is but one good reason:

The Utah teenager suspected of stabbing five high school classmates in a boys' locker room before turning the knife on himself Tuesday was a straight-A student with no record of disciplinary trouble, police said.

The 16-year-old suspect, a sophomore in his first year at Orem's Mountain View High School after being home-schooled, also stabbed himself in the neck. He was cornered Tuesday by school workers until a police officer assigned to the school got to the locker room and subdued him with a Taser shot.

Police said it appeared the victims weren't singled out for any reason other than being nearby when the attack started. School district spokeswoman Kimberly Bird said there were no indications the suspect was having problems or being bullied, she said.

Officials did not identify the suspect by name because of his age.

http://www.foxnews.com/us/2016/11/16/utah-school-stabbing- leaves-5-injured-school-startled.html.

Hey, Pinguinite, this student didn’t use a handheld pencil sharpener which actually contains a steel cutting blade and he didn’t use some glass from a broken window in a class room….he used a “God Damned Knife.” This kid that brought the knife to school was only a few years older than the girl who brought the butter knife to school.

The school has a rule against bringing ANY knife to school....this kid didn't follow the rule, and look what happened.

BTW: The article didn’t specify if the knife used to stab the students was a butter knife of not …

Well, Gatlin knives are not the only weapons of choice used these days in school. Sharp pencils can be a weapon. Your teeth can be used as a weapon. And so can your body be used as a weapon provided that you know how to fight to the very death.

But you know what is more dangerous than a butter knife, your teeth, or your body as weapons?

Ans: Your mind.

Okay, here is a summary of my position on this.

I remember reading about a kid in school drawing the imagine of a gun on a piece of paper in the class room and the kid was suspended from school for that. I also remember two kids were playing cowboy in the school yard when one kid pointed a finger at the other with his index finger straight out and his thumb up so as to simulate a pistol. That kid was suspended also.

In both these cases, those were STUPID RULES and should never have been written in first place. I can lay blame on a school for instituting those rules….but I place MORE blame on the parents of the kids for letting those rules stand. I say the parents should carefully study the book of rules they are required to sign and abide by each year and when they discover something as ridiculous as the rules I have just pointed out, they should go to the PTSB meeting and SCREAM like HELL to get those changed….BEFORE HAND! I feel that when the parents are united….they will accomplish that.

On the other hand, I personally see good reason to have a rule prohibiting knives from being brought to school….I just linked you to one good reason and that was where a kid stabbed 5 classmates with a knife he brought to school. So I go for a rule against bringing knives to school.

When a rule against knives being brought to school in order to prevent more stabbings is established, the problem then becomes how to write the rule. Then do you start making some exceptions and say a butter knife like this on for which the girl was suspended …

… is okay because the steel blade is only 3 inches long?

If you start making exceptions, you can wind up with a multitude of pages on exceptions listed. Then when a kid brings a butter knife with a 4 inch blade to school and is suspended, the parents cry and say that a 3 inch blade was okay and “Johnny” shouldn’t be suspended because the knife he brought to school was ONLY one inch longer. This could go on and on …

If you go with drawing a knife or pointing a finger to simulate a pistol as being ridiculous….then I will stand up with you and “sing out” loudly against that.

But if yu go with bringing a 3 inch (estimated from the picture) steel bladed knife to school and tryinb to down play the situation by calling it a “kids toy butter knife used for training” then you will stand alone and I will stand against you.

If that makes me a “Hitler” as you say….then you can damned well throw your right arm up at a 45 degree angle with you palm facing down and start yelling Sieg Heil to me all day long.

I have considered: Why do we need rules? Why do we have rules? Why do we follow rules?

And after consideration, I feel the same as I did before. I confess, I am a “rules and law” person because I feel that rules and laws are important since they keep a society together and functioning. Rules and laws strive to maintain peace and safety among people and provide ways to resolve issues that do arise among individuals. Rules and laws are designed to keep people safe and free from harm, or they should be.

So, I will end this by saying the girl brought a three inch steel bladed knife to school that cut through a peach….therefore it was sharp. If the school had simply said: “Well, sweet child, this is okay this time….but don’t bring it again. Then if that becomes the policy, just to warn, the next youngster may decide to bring his favorite five inch hunting knife to school to show a friend thinking all the time all he will get is a warning from doing so.

I believe rules are rules and they should be well published. I also believe they should be reasonable. Furthermore, I also believe there should be enforcement of the rules, otherwise there should be no rules. On the other hand, I strongly believe if a rule is wrong….then the RULE MUST BE CHANGED. That is done every day, changing rules. It is not a hard thing to do.

You may lower your right arm down now from the 45 degree angle, if you understand and agree with what I said. If you don’t….then I simply don’t know what else to say. I feel that I am a reasonable person….and I don’t feel that it is unfair to have rules and to enforce those rules. Again, as long as they are reasonable rules….and if they are not, then get them changed.

If you still feel like you should place me on bozo….then just go ahead a do it.

DO NOT BOZO TATER!

You will miss the YUKS on a daily basis.

No, after some more thought, I think it's the thing to do. At least for a while.

This is a throwing pearls before swine type thing. I have better things, productive things that I can do with my time, and having a stupid conversation, if it even qualifies as that, with Gatlin is not what I should be doing. Maybe he's got time to waste, but I don't.

It's apparent to me that Gatlin purposely responds to articles and others with the intent to inflame, not to offer any kind of constructive viewpoint. This has been demonstrated to my satisfaction on this thread where inferring his position on an article based on his early posts earned me an accusation of improper condemnation because he never explicitly expressed the opinion that I and everyone else inferred. Presumably it's somewhat different, but in spite of advocating he has been misrepresented, he nonetheless refused to voluntarily express that opinion without an engraved invitation because I guess he thinks he's special, or more likely, because he's wants to be an asshole. Which is fine if that's the case. To each his own.

But I don't want to reward it. It's much like feeding wildlife in a wilderness park. It's bad for them and you. As I said, I would ban Gatlin if this were my site. Site owners should certainly exercise the ban power cautiously when it comes to people they differ with politically. Having opposing viewpoints is valuable for any forum and personal bias can a proper decision hard. But that's not my burden. So... to bozo Gatlin goes.

That is the second time that Pinguinite has said he would ban me if this were his site. This time he pinged you as probably an inference that it is an action you should take.

As I have said many times, this is your site and I am here only at your pleasure. Anytime I do something you deem wrong, then of course you have the right to ban me….and that is the way it should be. It is the RULE, albeit an inferred one….IT IS STILL THE RULE.

I challenged Pinguinite on the issue of the girl bring the knife to school. And the candy-ass weakling got all upset because of the way I presented my position, or more so, the way I would not let him defend a position he wrongly held. If that pissed him off, as it obviously did….then that’s fine with me. If he doesn’t care to read my posts and respond to me….that’s also fine with me.

But I will never let anyone tell me WHAT TO THINK. I carefully consider my position and opinion and before I post it. I shoot all the holes in my argument that I can find in advance of posting it. Therefore, I seldom….if ever….change my position on anything.

I will continue to express my positions STRONGLY and if you find that is disrupting your forum, as Pinguinite has tried to point out to you….then I ask you to say so now. At which time I will immediately depart your forum or you can ban me.

But no candy assed weakling is going to stamp his feet, roll around on the floor and bawl about the way I argue against him and expect me to relent….for I will not. I WILL STAND MY GROUND.

You may respond to this post, if you so choose. If you do no choose to do so, I will consider that to be an okay for me to continue to post in the method I have been doing, and have at these self righteous assholes who always think they are right about everything and try to shove their philosophies and agendas down my throat.

Respectfully,
Gatlin

Common sense should prevail in instances like this one.

Ready. Fire! Aim.

The school has no discretion. It is district policy coming from on high.

Zero-tolerance policies did not sprout from nowhere. Litigious parents tend to sue whenever their precious snowflake gets any form of punishment. Zero-tolerance was the result. There is no interpretation of the rule whatever to be made. There is no discretion afforded in enforcement. Do not bring a knife to school. Zero tolerance rules are made for nonsensical parents who exercise no common sense.

The girl received a suspension for six days as a result of the system’s weapons policy.

A straight-A Utah high school student brouht a knife to school then stabbed five boys in the school's locker room before stabbing himself and the bleeding heart libertarian assholes on LF post nothing about it and neither do they make a comment after I post it.

Yet a girl brings this 3-inch steel blade knife to school and the bleeding heart libertarian assholes get their panties all wadded up between their crotch and start moaning and crying trying to pass it off as a teeny-tiny “wittle” butter knife a very small infant uses to learn how to eat.

Look at the picture. There is nothing there to garner the description as a “butter knife.” That descriptive term was coined by the author to downplay the potential danger of the knife. Look at the picture and you will see a STANDARD stainless steel knife, fork and spoon set with, judging by the length of the handle in proportion, a blade length of at least 3 inches or more.

The school the girl attends has a written police that NO KNIVES OF ANY KIND will be brought to school. The school where the boy who stabbed 5 students also has a written policy that no knives of any kind will be brought to school Don’t you think the parents of the 5 stabbed students wish someone had discovered the boy with the knife before the stabbings and suspended him for six days?

But the bleeding heart libertarian assholes may contend that the young girl had no intention of stabbing anyone. Well they could have said that about the young kid that did the stabbing….until he did the stabbing.

It is as nolu chan posted:

Zero-tolerance policies did not sprout from nowhere. Litigious parents tend to sue whenever their precious snowflake gets any form of punishment. Zero- tolerance was the result. You Paultard libertarian assholes can continue to whimper, cry and attempt to discredit me as long as you want to….but it will do me no harm and I will not change my point of view. I will also continue to defend my position and say that a steel bladed knife should not be in a student's hand at school. You don’t believe that….then ask the parents of the 5 students who were stabbed to explain "why" to you.

Zero tolerance is there for a reason in this case. The reason has been demonstrated by the stabbing of 5 students.

Now suck it up, you Paultard libertarian assholes and face reality….don’t be swayed by some tear-jerking liberal biased agenda driven article yet another time.

Take your anything goes bullshit and jam that up your Stinky Pete hole. If you want everyone to live by your standards, become this school districts superintendent... or shut the fuck up.

If a school district outside of where you live decides to be zero tolerant, then it's non of your business. Asshole.

Glass can also be used as a weapon.

Case scenario: Back in '95, I was in a dressing room with several of my co-workers. Two of them were fighting to the point that the one pushed the other very hard next to a standing vanity mirror. The mirror split into several places leaving shards of glass on the floor. The one co-worker picked up one of the shards of glass and took and grabbed the other co-worker and began slicing into their right side temple of the face and continued all way down to their leg. There was blood everywhere and all I remember is running to the restroom to get some paper towels to stop the bleeding while awaiting for an ambulance. I believe the fight started where one of the co-workers said some shitty stuff about the other co-worker which was effecting their earnings, and that set off the fight.

I have no doubt the 11-year old girl who is portrayed as an innocent little darling knew exactly what she was doing and knew that she was prohibited from doing it.

The kids who bring knives and guns to schools this day and time are not innocent babies who just happen to make a mistake.

They know what they are doing, and they will do it as long as they can get away with doing it.

Whether they are age 11, 13, 15 or 17….it doesn’t matter….they know what they are bringing to the schools.

A day after a 13-year-old boy brought a handgun to a Queens middle school, random metal detector searches at the same school uncovered even more weapons, officials said.

Three students at Middle School 202 in Ozone Park tried to sneak in two knives and two box-cutters Thursday, according to school safety agent union officials.

One 12-year-old boy came to school with a four-and-a-half inch, stashed in his backpack, police sources said.

School safety agents prepared a “juvenile report” against the boy, then released him to his mother, sources said.

School officials also caught a 15-year-old girl with two box-cutters, and a 13- year-old boy with a three-and-a-half inch knife.

“We take this matter very seriously, the item was safely confiscated and appropriate follow-up actions will be taken,” Education Department spokeswoman Toya Holness said when asked about the kitchen knife incident.

“Safety comes first, and we have detailed protocols and robust programs in place to ensure schools provide a safe and supportive learning environment in every school building.”

On Wednesday, cops took a 13-year-old boy into custody after he brought a .22- caliber handgun to the school.

The boy showed the gun to a friend, who told school authorities, sources said.

That incident marked the fourth time since the start of the current academic year on Sept. 8 that a city student was busted bringing a gun to school.

Also on Wednesday, school officials at Intermediate School 93 in Ridgewood caught a 13-year-old boy with an imitation pistol, police sources said. The boy told another student he was carrying a gun, and that student told school administrators, which led to a search of the boy’s bag.

And you know why that's happening, Gatlin? It's because some of the parents of those kids teach their kids to be assholes and bullies to other classmates and then those classmates wonder why all hell breaks loose on those campuses. But its not just the parents that are at fault but also the school that condones such gross behavior.

Yea, that is absolutely correcrt.

The girl should have had enought common sense not to take the knife to school.

The parents should have had enough common sense to make sure the girl had enough common sense not to take the knife to school

Yep, is is as you say: Common sense should prevail in instances like this one.

You are a weak libtard.

You and Gatlin have a fetish about calling people "tards". As I've made clear before, it's quite childish to resort to such name calling time and time again.

Your weakness makes me wanna puke.

The power to make someone puke would actually be a strength of one sort or another, not a weakness. But puke away, if you want.

According to the school district, the girl violated the county's weapon policy when she used her butter knife in the cafeteria to cut the peach.

May I ask what the girl was expected to use to cut the peach with in the cafeteria?

Whatever the school, at its sole discretion, provides. That could be a plastic spork or whatever. I assume the other kids are getting it done somehow.

If the school allows knives and someone gets stabbed, the school district gets sued for allowing an unsafe environment. If some school authority determines that Johhny's knife is dangerous, and Jimmy's is not, the school district gets sued for disparate treatment. If the school sets a zero tolerance policy, and enforces it, they are golden. It is difficult to make any lawsuit.

The Broward County Public Schools – Acknowledgement - Page 15 of 15
This booklet lists the District’s rules in Policy 5.8, for students in Broward County Public Schools. The rules apply to all activities occurring on school grounds, on other sites being used for school activities, and on any vehicles authorized totransport students. Your signature below does not indicate that you agree or disagree with the rules, but rather that you have reviewed the electronic copy of these rules (www.BrowardSchools.com/ index.asp). Return this form to school within 3 days from the first day of school or from the date of enrollment.

Signature / Date Blocks

The bold red is included as part of the acknowledgement….it was NOT added..

The parents HAD to sign this Acknowledgement Form before their child was admitted to the school.

The patents acknowledged they had reviewed the rules.

Therefore, they had to have known the girl was not allowed to take the knife to school.

The School Board’s suspension was without question authorized and justified.

You libtard assholes….just keep on whining….that is the only repercussion you have available.

It’s the same kind of school you have there in Las Vegas, Clark County, Nevada….where I believe you said you live.

Your schools have basically the same RULES.

Check the restrictions on Page 2 of CLARK COUNTY DISTRICT SCHOOL REGULATION at:

http://ccsd.net/district/policies- regulations/pdf/5141.1_R.pdf.

This is nothing new….most all schools across the nation have the same basic inclusive rules.

Sorry but the schools I attended did not have policies like this. Schools like these today are prison camps for those students and the school principal and superindendent managing them are merely prison guards. Plastic forks to cut a peach! What is the school going to do next? Like take the plastic forks away and have the kids eating meat loaf and mashed potatoes with their hands?

I feel so sorry for those students. The best thing to do is pull the kid out of those schools and home school them cause they sure as hell are not learning anything of true value anyways.

Sorry but the schools I attended did not have policies like this.

Neither did the school I attended. All 12 grades were in one small building.

There was no rule book, no code of conduct....except the principal's paddle board.

Fortunately, I escaped the wrath of the paddle board and never felt the experence ...

Unfortunately for the youth today....times have changed, so have the parents.

God help them....the kids of today.

Unfortunately, I never escaped the wrath of the paddle from the teachers. The paddle never served its purpose with me at all. I spend more time in the principals office than in the classroom. However, the principal and I enjoyed each others company from having lunch together to just spending my time in detention. We had a mutual respect and understanding for one another. Never did they lay a hand on me or said discouraging words to me and never yelled at me. On the other hand, the teachers and I never had respect for one another. Never!

The reason why the kids of today have it worse than schools of yesterday, is that the teachers are not there to teach anymore. They just don't care about those students. They prefer to keep those student dumb and stupid. Students respect a teacher that permits the students to express themselves and even be challenged academically. This does not exist in the classrooms. As a result of this the students are discouraged about their future place in this world because they feel nobody gives a shit about them. After all, this is their world too. They are repeatedly told they are not special and put down alot by older generations that they are shit. As a result, if they are not getting this treatment from school, they are getting it from home. And since they have no place to vent their anger and rage, we are seeing the results of this on the school campuses where school fights turn into dangerous rages. Older generations laugh at this but to the younger generations, this is real. It is not so much that God should help this younger generation but also the older generation to guide them. After all, we did bring them into this world. Although it is true that the world never promised today's youth a rose garden, it also never promised any other generations a rosy garden either.

It is now a typical school that must face the reality of litigation such as that described below. They sue the school district because that is where the potential jackpot is. The school districts must take measures to prevent jackpot payments.

Muslim Mom Sues School for $50 Million

8/17/2016 5:45:00 AM, Nick Divito

CENTRAL ISLIP, N.Y. (CN) — Schoolyard bullies frightened a 12-year-old developmentally disabled Pakistani-American boy by calling him a terrorist, so to fend them off and without knowing what he was talking about, he said he belonged to ISIS and was going to blow up the school's fence, his mother says in a $50 million lawsuit against the school.

Nubaisha Amar sued the East Islip Union Free School District, East Islip Middle School, the school superintendent, principal and an assistant principal on Monday in Federal Court.

Amar calls her son's ordeal a prime example of "Islamophobia," and "rampant discrimination" against Muslims, which is "ongoing, escalating and troubling."

Her son has a known "social, language and learning disability," she says. Through bullying by his peers, he was coerced to say he was a member of ISIS, "a vile, abhorrent and infamous terrorist organization," his attorney wrote in the 44-page lawsuit.

The boy was born in Islip Terrace, a town in Suffolk County, a suburb of Long Island, N.Y.

He was attending Connetquot Elementary School when the bullying began. He had been diagnosed with "severe learning and social disabilities, as well as speech, language, vocabulary and communication impairment."

He had been diagnosed with the learning disabilities since kindergarten, the lawsuit notes. Psychological evaluations in his file noted that he was "very sweet and cooperative," and a "kind boy," "very polite."

But in January this year he was subjected to "severe bullying" from an older pack of students in the school cafeteria. They called him a "terrorist," and asked "what he was going to blow up next," his mother says in the complaint.

In an attempt to stop the incessant bullying, he finally said that he is a terrorist and was going to blow up a fence at the school.

But he had no idea what that meant, his mother says.

He thought a "'terrorist' was someone who 'travels from place to place,' more akin to a 'tourist,'" and he said "fence" "because that was the first thing he saw when he peered out of the cafeteria window," his mom says in the complaint.

He was plucked out of gym class and hauled into the principal's office, where the principal interrogated him, asking him, among other things, if he knew who Osama bin Laden was, and if he was part of ISIS, his mother says.

His backpack, wallet and cellphone were illegally searched, and he was forced to confess that he was part of ISIS, that he knew how to make bombs, was making them at his home, and was going to blow up the school, according to the complaint.

He didn't write the confession; he just unknowingly signed it, according to the complaint.

That first bogus confession was ripped from his hands and torn up, and a new draft was made. He was forced under duress to sign another confession to the same accusations.

His mother, who was six months pregnant at the time, came into the office , "scared, dizzy and distraught," after being called to talk to security. Her son was banned from school for more than a month.

The boys who taunted him were never disciplined, his mother says.

Mother and son were taken to a police station and their home was searched, including the boy's room, his phone and all computers.

The boy now suffers from "extreme emotional distress, including, but not limited to nightmares, sleeplessness, crying, fear, humiliation and stress," according to the complaint.

The family seeks punitive damages for defamation, racial and disability discrimination, intentional infliction of emotional distress and several constitutional violations.

The school district declined to comment in a phone call Tuesday afternoon.

The lawsuit was filed by David Antwork.

From your post #54, I quote you from above.

If the parents did sign a statement of such concerning the school handbook and the school zero policy on bringing of illegal items on the campus, then is it fair to say that the parents would lose in court because they waived their right to sue?

If the parents did sign a statement of such concerning the school handbook and the school zero policy on bringing of illegal items on the campus, then is it fair to say that the parents would lose in court because they waived their right to sue?

They make it mandatory to sign an acknowledgement of the rules in order for little Johnny to attend the school. This is done for legal reasons to defeat any subsequent claim of unawareness of the rules.

They did not waive their right to sue, but they have no case. It would be documented that they acknowledged knowing the rules. With knowledge of the rules, they sent their snowflake to school with what they knew to be a prohibited knife.

From the article at the top:

"The school board has abused its discretion to act in this case," Larry Meltzer said.

To make this case, one would have to prove that the school board did not have the discretionary power to prohibit the bringing of knives to school, or to implement a zero tolerance policy providing for a mandatory suspension.

If the school does not ban knives, someone is sure to sue them for abuse of discretion for allowing students to bring weapons to school, allowing an unsafe environment, and failing their affirmative duty to provide a safe environment. Let the first student get stabbed and see who gets sued, the student doing the stabbing or the school district with the money.

In the example at #54, a boy is called names by other boys and says he is going to set off a bomb at the school. The school reports it. Mom sues the school district for $50M.

If a teacher used a paddle today, little Johnny would tell his parents and they would sue. And when you went to school and got paddled, if you complained to your parents, you may have got another paddling for misbehaving.

If students are fighting in the classroom, totally disrupting class, it goes on while the teacher calls the assigned safety officer and waits for him to arrive to break it up.

Yep, and this is why homeschooling is the best alternative. I wound never subject a child to a school like this. In fact, I would have an attorney present with me before I signed some mandatory policy that would put me at a disadvantage to sue later. I don't believe in subjecting a child to a school system that regards them all as criminals.
