Police turn investigation over to Florida State Attorney's Office

A South Florida couple is outraged after they said their daughter was suspended from her middle school for using a child butter knife at lunchtime to cut a peach, Local10.com reported.

 "There's no one there trying to educate and to be reasonable to say, 'Let's work this out,'" the girl's father, Ronald Souto, said.

 Souto's daughter is an honor roll student at Silver Trail Middle School in Pembroke Pines.

"She's always trying to help someone. She's always trying to share things," Souto said about his daughter.

Ronald and Andrea Souto told Local 10 News reporter Michael Seiden that their 11-year-old daughter was suspended for six days for bringing the knife to school.

"This is a set of a spoon, fork and knife for toddlers -- one year old," Andrea Souto said. "It is made for children to learn how to eat properly. She's used it since she was baby."

According to the school district, the girl violated the county's weapon policy when she used her butter knife in the cafeteria to cut the peach. 

"The friend asked for half of the peach and she cuts half of the peach and gives to her friend. She goes to the bathroom and comes back and the guy said, 'Follow me,'" Ronald Souto said.

Ronald said he hopes what happened to his daughter will bring change to the district, specifically new polices when it comes to weapons.

He's not alone. 

"I think the principal should revisit this and everyone (should) sit down to the table, and let's just say, 'Don't do it again.' This is outrageous to go to that extreme," Melvin J. Smith, whose grandson attends the school, said.

The Soutos said they were shocked about the suspension and are now concerned that their daughter's act of kindness could lead to criminal charges.

"She's afraid now of the educators. She's afraid of people at school. They need to change the system," Ronald Souto said.

A Broward County school district spokeswoman declined to offer specifics about the incident because of "student privacy," but said, "The school followed district policy regarding this incident and continues to work with the student and parents involved.  It is the district's priority to maintain safe and secure campuses for students and staff at all times."

The Pembroke Pines Police Department said it has turned over their investigation to the State Attorney's Office.

It's unclear whether prosecutors will file charges, but the family's attorney said the school board isn't doing its job in this case.

"The school board has abused its discretion to act in this case," Larry Meltzer said. "It is tragic that a school that this little girl loves sees fit to prosecute and suspend her -- the epitome of a model and honor roll student -- for using a child-proof utensil that could never be construed in any form as a weapon in order to share part of her lunch with a fellow classmate.

"This item at all times was used in the school's lunch room as it should be -- to cut a peach and share lunch with a friend," he added. "She should be applauded for her generosity, kindness and for her motivation to be a great student in all senses of that word.

"The only harm that has been exacted in this case is by Silver Trail Middle School and the Broward County School Board upon one of its finest students and upon one who exemplifies the type of person and student it wishes to help create. It is truly senseless and does reflects poorly upon the type of educators and law enforcement involved in this case." (1 image)

Schools don’t just arbitrarily make rules against bringing a knife to school, they usually have a good reason.

Here is but one good reason:

The Utah teenager suspected of stabbing five high school classmates in a boys' locker room before turning the knife on himself Tuesday was a straight-A student with no record of disciplinary trouble, police said.

The 16-year-old suspect, a sophomore in his first year at Orem's Mountain View High School after being home-schooled, also stabbed himself in the neck. He was cornered Tuesday by school workers until a police officer assigned to the school got to the locker room and subdued him with a Taser shot.

Police said it appeared the victims weren't singled out for any reason other than being nearby when the attack started. School district spokeswoman Kimberly Bird said there were no indications the suspect was having problems or being bullied, she said.

Officials did not identify the suspect by name because of his age.

Hey, Pinguinite, this student didn’t use a handheld pencil sharpener which actually contains a steel cutting blade and he didn’t use some glass from a broken window in a class room….he used a “God Damned Knife.” This kid that brought the knife to school was only a few years older than the girl who brought the butter knife to school.

The school has a rule against bringing ANY knife to school....this kid didn't follow the rule, and look what happened.

BTW: The article didn’t specify if the knife used to stab the students was a butter knife of not …

Okay, here is a summary of my position on this.

I remember reading about a kid in school drawing the imagine of a gun on a piece of paper in the class room and the kid was suspended from school for that. I also remember two kids were playing cowboy in the school yard when one kid pointed a finger at the other with his index finger straight out and his thumb up so as to simulate a pistol. That kid was suspended also.

In both these cases, those were STUPID RULES and should never have been written in first place. I can lay blame on a school for instituting those rules….but I place MORE blame on the parents of the kids for letting those rules stand. I say the parents should carefully study the book of rules they are required to sign and abide by each year and when they discover something as ridiculous as the rules I have just pointed out, they should go to the PTSB meeting and SCREAM like HELL to get those changed….BEFORE HAND! I feel that when the parents are united….they will accomplish that.

On the other hand, I personally see good reason to have a rule prohibiting knives from being brought to school….I just linked you to one good reason and that was where a kid stabbed 5 classmates with a knife he brought to school. So I go for a rule against bringing knives to school.

When a rule against knives being brought to school in order to prevent more stabbings is established, the problem then becomes how to write the rule. Then do you start making some exceptions and say a butter knife like this on for which the girl was suspended …

… is okay because the steel blade is only 3 inches long?

If you start making exceptions, you can wind up with a multitude of pages on exceptions listed. Then when a kid brings a butter knife with a 4 inch blade to school and is suspended, the parents cry and say that a 3 inch blade was okay and “Johnny” shouldn’t be suspended because the knife he brought to school was ONLY one inch longer. This could go on and on …

If you go with drawing a knife or pointing a finger to simulate a pistol as being ridiculous….then I will stand up with you and “sing out” loudly against that.

But if yu go with bringing a 3 inch (estimated from the picture) steel bladed knife to school and tryinb to down play the situation by calling it a “kids toy butter knife used for training” then you will stand alone and I will stand against you.

If that makes me a “Hitler” as you say….then you can damned well throw your right arm up at a 45 degree angle with you palm facing down and start yelling Sieg Heil to me all day long.

I have considered: Why do we need rules? Why do we have rules? Why do we follow rules?

And after consideration, I feel the same as I did before. I confess, I am a “rules and law” person because I feel that rules and laws are important since they keep a society together and functioning. Rules and laws strive to maintain peace and safety among people and provide ways to resolve issues that do arise among individuals. Rules and laws are designed to keep people safe and free from harm, or they should be.

So, I will end this by saying the girl brought a three inch steel bladed knife to school that cut through a peach….therefore it was sharp. If the school had simply said: “Well, sweet child, this is okay this time….but don’t bring it again. Then if that becomes the policy, just to warn, the next youngster may decide to bring his favorite five inch hunting knife to school to show a friend thinking all the time all he will get is a warning from doing so.

I believe rules are rules and they should be well published. I also believe they should be reasonable. Furthermore, I also believe there should be enforcement of the rules, otherwise there should be no rules. On the other hand, I strongly believe if a rule is wrong….then the RULE MUST BE CHANGED. That is done every day, changing rules. It is not a hard thing to do.

You may lower your right arm down now from the 45 degree angle, if you understand and agree with what I said. If you don’t….then I simply don’t know what else to say. I feel that I am a reasonable person….and I don’t feel that it is unfair to have rules and to enforce those rules. Again, as long as they are reasonable rules….and if they are not, then get them changed.

If you still feel like you should place me on bozo….then just go ahead a do it.

This is a throwing pearls before swine type thing. I have better things, productive things that I can do with my time, and having a stupid conversation, if it even qualifies as that, with Gatlin is not what I should be doing. Maybe he's got time to waste, but I don't.

It's apparent to me that Gatlin purposely responds to articles and others with the intent to inflame, not to offer any kind of constructive viewpoint. This has been demonstrated to my satisfaction on this thread where inferring his position on an article based on his early posts earned me an accusation of improper condemnation because he never explicitly expressed the opinion that I and everyone else inferred. Presumably it's somewhat different, but in spite of advocating he has been misrepresented, he nonetheless refused to voluntarily express that opinion without an engraved invitation because I guess he thinks he's special, or more likely, because he's wants to be an asshole. Which is fine if that's the case. To each his own.

But I don't want to reward it. It's much like feeding wildlife in a wilderness park. It's bad for them and you. As I said, I would ban Gatlin if this were my site. Site owners should certainly exercise the ban power cautiously when it comes to people they differ with politically. Having opposing viewpoints is valuable for any forum and personal bias can a proper decision hard. But that's not my burden. So... to bozo Gatlin goes.

Zero-tolerance policies did not sprout from nowhere. Litigious parents tend to sue whenever their precious snowflake gets any form of punishment. Zero-tolerance was the result. There is no interpretation of the rule whatever to be made. There is no discretion afforded in enforcement. Do not bring a knife to school. Zero tolerance rules are made for nonsensical parents who exercise no common sense.

Look at the picture. There is nothing there to garner the description as a “butter knife.” That descriptive term was coined by the author to downplay the potential danger of the knife. Look at the picture and you will see a STANDARD stainless steel knife, fork and spoon set with, judging by the length of the handle in proportion, a blade length of at least 3 inches or more.

The school the girl attends has a written police that NO KNIVES OF ANY KIND will be brought to school. The school where the boy who stabbed 5 students also has a written policy that no knives of any kind will be brought to school Don’t you think the parents of the 5 stabbed students wish someone had discovered the boy with the knife before the stabbings and suspended him for six days?

But the bleeding heart libertarian assholes may contend that the young girl had no intention of stabbing anyone. Well they could have said that about the young kid that did the stabbing….until he did the stabbing.

Case scenario: Back in '95, I was in a dressing room with several of my co-workers. Two of them were fighting to the point that the one pushed the other very hard next to a standing vanity mirror. The mirror split into several places leaving shards of glass on the floor. The one co-worker picked up one of the shards of glass and took and grabbed the other co-worker and began slicing into their right side temple of the face and continued all way down to their leg. There was blood everywhere and all I remember is running to the restroom to get some paper towels to stop the bleeding while awaiting for an ambulance. I believe the fight started where one of the co-workers said some shitty stuff about the other co-worker which was effecting their earnings, and that set off the fight.

The kids who bring knives and guns to schools this day and time are not innocent babies who just happen to make a mistake.

They know what they are doing, and they will do it as long as they can get away with doing it.

A day after a 13-year-old boy brought a handgun to a Queens middle school, random metal detector searches at the same school uncovered even more weapons, officials said.

Three students at Middle School 202 in Ozone Park tried to sneak in two knives and two box-cutters Thursday, according to school safety agent union officials.

One 12-year-old boy came to school with a four-and-a-half inch, stashed in his backpack, police sources said.

School safety agents prepared a “juvenile report” against the boy, then released him to his mother, sources said.

School officials also caught a 15-year-old girl with two box-cutters, and a 13- year-old boy with a three-and-a-half inch knife.

“We take this matter very seriously, the item was safely confiscated and appropriate follow-up actions will be taken,” Education Department spokeswoman Toya Holness said when asked about the kitchen knife incident.

“Safety comes first, and we have detailed protocols and robust programs in place to ensure schools provide a safe and supportive learning environment in every school building.”

On Wednesday, cops took a 13-year-old boy into custody after he brought a .22- caliber handgun to the school.

The boy showed the gun to a friend, who told school authorities, sources said.

That incident marked the fourth time since the start of the current academic year on Sept. 8 that a city student was busted bringing a gun to school.

Also on Wednesday, school officials at Intermediate School 93 in Ridgewood caught a 13-year-old boy with an imitation pistol, police sources said. The boy told another student he was carrying a gun, and that student told school administrators, which led to a search of the boy’s bag.

Whatever the school, at its sole discretion, provides. That could be a plastic spork or whatever. I assume the other kids are getting it done somehow.

If the school allows knives and someone gets stabbed, the school district gets sued for allowing an unsafe environment. If some school authority determines that Johhny's knife is dangerous, and Jimmy's is not, the school district gets sued for disparate treatment. If the school sets a zero tolerance policy, and enforces it, they are golden. It is difficult to make any lawsuit.

The patents acknowledged they had reviewed the rules.

Your schools have basically the same RULES.
