Gary Johnson's running mate, Bill Weld has already declared Hillary to be free from criminal intent.

Intent in no way factors into the applicable statute, 18 USC 793, nor does it mention the word “classified.” It’s all about information concerning the “national defense.”
793 (f) specifically makes it a crime for anyone “entrusted with … any document … or information relating to the national defense … through gross negligence (to permit) the same to be removed from its proper place of custody.”
