(b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.(a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.
Well, there you have it. That is why the US Government is not prosecuting Clinton.

Are you sure? Blumenthal was surreptitiously used by Hillary despite Obama's explicit objections. Blumenthal's email account was hacked by Guccifer, revealing highly classified email about Benghazi from Blumenthal to Hillary's private account, and also revealing Hillary's private account. All of this deposited a big unwelcome shit sandwich inside the Obama administration. The IG investigation was ordered up by John Kerry (Democrat/Obama administration) and the IG is Steven Linick (an Obama appointee). These attacks are coming from Democrats. The IG report was ordered, performed, and released by the Democratic Obama administration. The Obama administration does not want Hillary as president. Neither does it want a Democrat loss in November. A well-timed release of the FBI report, perhaps in mid-July, just before the Dem convention, could persuade the superdelegates to desert Hillary. There could be an ouster of Debbie Wasserman-Schultz to help pave the way. There is some interesting crap going on behind the scenes with the Democrats.
So ... Bernie? A government strong enough to impose your standards is strong enough to ban them. Or parachuting in Uncle Joe or Elizabeth Warren or whoever they have in mind. It just seems apparent that the Obama administration is not protecting Hillary any more than is necessary to protect the Obama administration.
I suppose if Clinton delegates become unbound that's an option. A government strong enough to impose your standards is strong enough to ban them.

Well, there you have it. That is why the US Government is not prosecuting Clinton.
In September 2015, Secretary Kerry named a former career Senior Foreign Service Officer [nc - Janice Jacobs] as the Department’s Transparency Coordinator. The Transparency Coordinator has been tasked with leading the Department’s efforts in conjunction with the ERMWG to meet the President’s Managing Government Records directive, responding to OIG’s recommendations, and working with other agencies and the private sector to explore best practices and new technologies.
Clinton and her top staff did not cooperate with the investigation, which was requested by current Secretary of State John Kerry.
Separately, the State Department Office of Inspector General — which is headed by Steve A. Linick, an appointee of President Obama — conducted a review of the Office of the Secretary’s “email records management and cybersecurity requirements” since 1997, covering the tenures of five secretaries of state and their staffs. The result is a 79-page report that identified “systemic weaknesses … that go well beyond the tenure of any one Secretary of State.” It made eight recommendations to the department.
