Cruz moved to the United States as a toddler in 1974 after being born in Canada in December, 1970. While your assertion is correct as stated, it does not apply to Ted Cruz. The only people eligible for naturalization are aliens, lawfully present in the United States. Of necessity, Federal law must define who are citizens and who are aliens. By elimination, defining all of one also defines the other. Persons born in the United States, and subject to the jurisdiction thereof, are citizens of the United States at birth. Persons born outside the United States are citizens of the United States if they meet the requirements of Federal law in force at the time of their birth. Cruz met such requirements and became a United States citizen at birth. Cruz has never been eligible, at any time, for naturalization. He has never been an alien as viewed by U.S. law. No foreign law carries any weight, or receives any consideration, regarding a U.S. determination of U.S. citizenship.
