Reality Check has already shown how “Neutral” Conservative News Websites Breitbart and The Daily Wire are actually fronts for the Ted Cruz Campaign. In our article “The $25 Million Dollar Trump Take Down” we clearly show that the owners of those sites donated over $25 Million Dollars to the Cruz Campaign and then use their websites to promote him. But is Talk Radio also on the take? Reality Check dug into Cruz FEC Filings and discovered the Cruz PACs paid a Talk Radio Insider over $8 Million Dollars, and the endorsements of Glenn Beck, Mark Levin and others quickly came in.

The FCC regulates the nation’s TV and Radio Stations because the signals they use are owned by the public. This is why you cannot use certain words on the radio, stations must have licenses, keep a public records file and make it available, etc.

One FCC rule is 47 U.S. Code § 317 or the Payola Rule. Simply put, Radio/TV Stations and their employees are not allowed to take money to put content in their programming, mention items, talk about candidates, etc. unless that sponsorship is disclosed.

In other words, if a Talk Show host like Glenn Beck, Mark Levin, Hugh Hewitt or others was paid money by a campaign to talk glowingly, defend or endorse a candidate, and not disclose that they were paid on-air to the audience, or the radio stations they are broadcast on, they’d be in violation of the law. The station could lose it’s license and the host could be jailed and fined.

Politico published an article in December called, “Talk Radio Rallies Around Ted Cruz” highlighting Glenn Beck, Mark Levin and Erick Erickson, amongst others as hosts defending Cruz and bashing Donald Trump (to Cruz’s benefit). If these hosts are doing it on their own, with no payment, it’s perfectly legal. However, if money is flowing to them, and they are not disclosing it, they are violating Federal Law.

Cruz won a convincing primary in Wisconsin and as Mark Graul, a Wisconsin based GOP Strategist pointed out:

The question is, are these talk show hosts becoming Pro-Cruz on their own volition? Or are they being paid big money to sway the election in Cruz’s favor?

A look at Ted Cruz PAC filings (Keep The Promise I & Keep The Promise PAC) turns up expenses totaling $8,467,466.00 to a company out of Plano Texas called Rigel Strategies LLC. Below is a screenshot of just a small sample of the payments Keep The Promise I has paid to Rigel Strategies, LLC.

Rigel Strategies, LLC is owned by a man named Dennis Sternitzky. Sternitzky is the only employee of Rigel Strategies, LLC from extensive research. Sternitzky is a former sales rep for Salem Communications (now known as Salem Media Group), which owns 117 radio stations across the United States. Salem also owns the website Red State which puts on the “Red State Gathering” that is hosted by Erick Erickson. The Red State Gathering notoriously banned Donald Trump from appearing at it’s latest get together in Denver Colorado.

When Sternitzky founded Rigell Strategies, LLC he began pushing a different kind of marketing he calls, “Embedded Marketing”. Sternitzky quotes Michael Margolis, “If you want to learn about a culture, listen to the stories…if you want to change the culture, change the stories.” In short, Sternitzky’s marketing plan is to pay hosts to promote brands, campaigns, etc. during their show which is perfectly legal, AS LONG AS IT’S DISCLOSED to the public.

According to Sternitzky’s LinkedIn Profile, he was the National Account Manager for Salem Communications (syndicator for Mark Levin, Dennis Prager, Michael Medved, Bill Bennett, Mike Gallagher, Erick Erickson and Hugh Hewitt) from August 2005 to August 2011. Before that Sternitzky worked for Premeire Radio Networks (syndicator for Glenn Beck, Rush Limbaugh, Sean Hannity, Meghan McCain).

In 2015, Ted Cruz’s PAC “Keep The Promise I” made 58 payments to Rigel Strategies, LLC. for a total of $1,094,268.00. The PAC increased its spending with Rigel Strategies, LLC. dramatically in 2016 and in just January and February (the latest filings available), has paid Rigel $7,373,198.00. The expenses are listed as “Media” and “Pac Radio Advertising”. Below is a screenshot of all of the payments made by Cruz’s “Keep The Promise 1” and “Keep The Promise PAC” to Rigel Strategies, LLC.

It’s also been widely reported that, David Barton, the Director of Cruz’s “Keep The Promise PAC”, is also the Chairman of Glenn Beck’s Mercury One Charity. Between January 18, 2016 and February 18, 2016, “Keep The Promise PAC” paid Rigel Strategies, LLC. $1,033,300.00.

Since Rigel Strategies, LLC. is not a public corporation, just what that $8,467,466.00 dollars in “Media” spending has been used for is not public record. However, it’s not hard to connect the dots and see that a one man corporation, with connections to radio hosts and a marketing plan of “embedded marketing” may be using that money to purchase the loyalty of Talk Show Hosts around the nation to sway the election in Cruz’s favor.

Is Cruz’s “Keeping the Promise I” and “Keep The Promise PAC”, through Rigel Strategies, LLC. paying conservative talk show hosts and media pundits for their endorsements, their defense of Cruz and to attack his opponents? If so, this would be a blatant violation of the FCC’s Payola and Plugola laws as the hosts mentioned have not disclosed on the air the payments made in exchange for their programming.

Further, this would be a violation of the FCC’s Equal Time Rule which was created because the FCC thought Radio and TV stations could easily manipulate the outcome of elections by presenting just one point of view, and excluding other candidates.

I suppose it's possible, but it would be incredibly risky for someone like Mark Levin to simply sell his endorsement. His whole audience share is built on trust, and something like this would destroy their trust.

I don't believe it for Levin. I would not believe it for Limbaugh or Hannity either. They're already very rich, and they got rich because their audiences trust them. I can't see either of them, or Levin (of whom I am no longer a fan) jeopardizing everything they've built to support some marginally failing candidate.

If the piece asserted that Limbaugh or Hannity or Levin had been bought, I would immediately think that it was a hit piece from the LEFT, seeking to discredit talk radio - their nemesis - completely.

On the other hand, local conservative radio hosts, guys who want to be Limbaughs and Hannitys, but who right now are just getting by on local radio salaries (which are not great), and who are inclined to be pro-Cruz anyway, well, they might take some money, if proffered, to keep saying nice things about Cruz and nasty things about his opponents. Their rationale would be that they're going to do that ANYWAY, so why not get a little financial help. After all, "Everybody does it." Hillary gets paid a quarter million dollars for one speech.

Local talk radio guys who have not built personal fortunes and reputations by taking a little money on the side, but Limbaugh, Hannity or Levin? It would be stupidity beyond belief for them to do it. None of those three are at all stupid, so for them I do not believe it.

Mark Simone is Mr. New York. He's the stand-in guy on the big local AM talk station whenever anybody is absent, any day of the week. He's a bit of a man-about-town, knows everybody and has a style that screams "New York". Of course Simone is going to embrace Donald Trump. I'm sure they know each other, and both Trump and Simone, and also Curtis Sliwa (the Guardian Angel founder who is now a talk-radio host) and Joan Hamburg on the left - New York folks - they talk alike, they think alike. OF COURSE they're going to like Trump.

Hell, even Al Sharpton says oddly nice things about Trump. He undetstands Trump. Says he's a kid from Queens who made it big but who still thinks like an outsider. Sharpton says that you have to understand New York to understand Trump. Tellingly, he says that Trump isn't a racist, that he talks like a guy from Queens - certainly nobody has paid SHARPTON. It was Sharpton who said that if Don King were white, he'd be Donald Trump, and that's actually a COMPLIMENT...to a New Yorker.

Mark Simone in the tank for Trump because of payoffs? Nah. New Yorkers love the idea of a New Yorker running the show. Last time that happened, FDR, was pretty good. The time before that, Teddy Roosevelt, was also pretty good.

I will say that from the beginning, Beck & his crew of toadys have been so rabid, non stop anti Trump, that I wondered why. I believed that it was either they were being paid, or they were being blackmailed. I do not believe they are "true believers"

Not all of us NYers love Trump . Some of us see his brand of populism as a form of demagoguery. He isn't as lefty as Hugo Chavez was ; but there are similarities .He often uses his television show to fire the ministers he hired .

Anyway I do agree with you that it would be foolhardy for the major conservative radio personalities to risk everything for chicken feed payola .If anything ,the smart play is what Hannity and Rush are doing.....pretending they are objective .

Agree. But since you use the word "pretending" I assume you do not think they are objective.

As a long time listener to Rush, I think his facade of being objective has shown some cracks. I still remember when he carried water for poppy Bush. He tried then to hide it, but there was no doubt, he wanted to stay in the good graces of the establishment. And, I believe he still wants to stay in the good graces of the establishment. He has a very narrow path he has to try to stay on. I still like Rush, and listen to him, but I remain objective while listening.

Anyway, in my opinion, that is the way it is.

Not all of us NYers love Trump .

Not all New Yorkers love anything. Mets? Yankees? Jets? Giants?

Nevertheless, Trump's style is that of New York. New York gets things done. It's not a dead carcass like Detroit, or an out-of-control pit of violence and corruption like Chicago, or a rotten banana like Miami. New York works. It's loud, brash, often in-your-face, as are its people, but it works. It works, and as you know, New Yorkers are really tough and rather aggressive, but they are actually helpful folks as long as you're not a putz. If you're a putz, they shit all over you to your face.

I've been living around here for a long time. I'm still a Midwestern boy at heart and by manner. I still see New Yorkers as being very different than me. But when I had to come here for school 21 years ago, I came hating the idea of New York, the rotten apple, and New Yorkers with their New York values.

That attitude of mine didn't last a month. New Yorkers are gruff and aggressive, but they're good people. And unlike my native Detroit, this City WORKS. It's very liberal - socially - but New Yorkers are anything but stupid when it comes to handling money, and that includes your government. Is it perfect? No. But it works, and it works pretty well.

So then you have been here long enough to know that the governments in the state ,from Albany on down to the local villages are the sleaziest in the nation .Yeah that may be my jaded self talking ,but in one weeks time I saw my town supervisor busted ;former Speaker of the Assembly ,already busted and now carrying on with mistresses ;and US District Att Preet Bharara targeting Governor il Duce Cuomo ,and Mayor Sandanista Bill.

You missed the bad old days before Rudy and Bloomy became mayors outside of the Democrat modern day version of Tammany Hall. Back then it didn't "work" . de Blasio is on his way to returning the city to those days .

I'm a NYer ,but some of the best times I lived was the years I was in Kansas . One thing I know for sure. I'll never be able to retire here . The property taxes is like paying a 2nd mortgage on my home.
