But they want their brand to cross state lines. They could also have franchised it into a couple of spinoff companies that operated only in each state they wanted to sell in. The feds could have done nothing. So this isn't much of a story really. And it seems to me they were banking on the memorability or suggestion of LSD to help sell their beer. You have to wonder how far this kind of regulation can go. For instance, will "Hooters" get regulated as an interstate franchise because its name offends and supposedly objectifies women?
