Donald Trump asks on his Twitter account whether he can “press charges” against Michelle Fields, as David Martosko of the Daily Mail prints purported quotes from an anonymous Secret Service agent in Trump’s security detail — claiming Fields was warned she was too close to the billionaire presidential candidate.

From the Daily Mail:

Republican front-runner Donald Trump’s campaign manager Corey Lewandowski has been charged with simple battery for allegedly grabbing a reporter, in a case that may hinge on a Secret Service claim that the journalist first made unwanted physical contact with the billionaire-turned-politician.

‘Victory press conference was over. Why is she allowed to grab me and shout questions? Can I press charges?’ Trump tweeted this afternoon.

Excerpt, 18 U.S.C. 3056(d):

(d) Whoever knowingly and willfully obstructs, resists, or interferes with a Federal law enforcement agent engaged in the performance of the protective functions authorized by this section or by section 1752 of this title shall be fined not more than $1,000 or imprisoned not more than one year, or both.

By jumping from her assigned space and grabbing at Protected Candidate Trump, and interfering with the ability of the Secret Service agent to remain next to Mr. Trump, Ms. Fields may have commited simple batttery and also a Federal Crime by interfering with a Federal law enforcement agent engaged in the performance of protective functions. Some reporterette has decided to try to raise a scandal with a bogus "I was ASSAULTED!" charge, and Trump himself rounds on her and goes after her for the same thing.

He has much deeper pockets and can hound her legally, both criminally and civilly, until she retreats, defeated.

Good.

This sort of politically-motivated bullshit should be hit hard. If you're going to wield law, you should get hit back with law.

Actually, he can round on her and bring a much more serious Federal charge as he was the subject of a secret service protective detail. Donald does not take any crap. He is signalling loud and clear to Fields to back off. If she chooses to continue, she faces the much greater problem, similar to Tommy DiMassimo.

'She crossed in between agents and our protectee after being told not to,' said the agent, who was present that night in Jupiter.

The aerial footage from inside the country club ballroom, which is a series of still photographs taken at steady intervals, doesn't capture Fields making contact with Trump. But it shows him apparently pulling his arm away from her.

'We supplied those tapes and those tapes to me are very conclusive,' Trump told journalists this afternoon.

I used to really like Levin, but he, like Beck, has gone crazy with their irrational hatred for Trump. Every time a listener calls & tries to talk positive about Trump, Levin breaks red on the caller.

I really do not get it. Its like if Cruz does not win, they and their families are going to be assassinated. They are both really out there on this. Sad really.

Trump can't make any federal charges at all. A federal agent has to file charges and it can't stick if a federal prosecutor won't press charges.

I don't see the 0bama JD doing Teh Donald any favors in a press scrimmage against an intrepid Girl Reporter.

I'm not sure what Florida statutes Trump might resort to since every state is different. But since Trump was under a federal SS protection detail, I would guess Florida is likely to decline any involvement.

I don't believe this at all.

I don't think that SS agents ever talk to foreign tabloids. DailyMail could simply be making it up entirely. It's the problem with "anonymous" stories. It has the same kind of credibility problem as the National Enquirer's story about Cruz and his supposed affairs, all based on "claims" and "rumors", entirely from anonymous sources.

If the SS detail wanted to make waves for Fields, they certainly have the power and jurisdiction to do so with no repercussions at all. Even a lone SS agent could press charges against her if he wished to and he would be given the benefit of the doubt in the initial arrest.

Thomas DiMassimo just went to court yesterday regarding Federal charges for his actions in Vandalia, Ohio.

The appicable Florida statutes would apply equally to Fields as to Lewandowski. There is evidence of de minimis battery, an unwanted touching.

If Trump has the Secret Service bring a Federal charge, that carries a year.

Thomas DiMassimo, who rushed Donald Trump on stage at a recent rally, appeared in court this weekend and pleaded not guilty.

WDTN News reported:

DiMassimo pleads ‘not guilty’ in stage rush case

Thomas DiMassimo, the man accused of rushing the stage during Donald Trump’s rally in Vandalia pleaded not guilty to federal charges.

2 NEWS Investigates’ Natalie Tendall was in the courtroom Friday morning.

DiMassimo faces a possible maximum sentence of one year in prison, $100,000 in fines and one year of probation. The Judge allowed DiMassimo to go free until his next court appearance as long as he adheres to some rules. DiMassimo is not allowed to travel outside the southern district of Ohio, he must attend all court appearances and he must undergo a psychiatric evaluation if one is ordered by the Court.

Thomas DiMassimo winked at our cameras but didn’t have much to say as he walked into federal court Friday. His attorney did speak with us after court.

“It’s clear from our point of view that Tommy was simply engaged in his mind, in political speech. He was simply trying to make the point that he has political views and he wanted to be heard,” said attorney, Jon Paul Rion.

It seems to me unlikely that Trump is going to visit a U.S. attorney and allege wrongdoing. It is an implicit accusation that the SS that is assigned to protect him is not doing its job because, if there is or was any real danger or violation, it is the SS that is already responsible.

No, I don't think Trump will try to file a federal charge. A recognized federal agent is required.

And there is another problem there. If Trump was in danger, the SS was fully entitled (and responsible) to detain or arrest the perp. Yet they took no action at all. That alone would make it far harder to prosecute this woman in any way under federal law.

Trump's most obvious recourse would be to file charges of unwanted touching against the woman under Florida law, exactly as she filed charges against Lewandowski for unwanted touching. You'll notice that Teh Donald has not done that.

Not true. They warned her -- twice -- to back off. When she didn't, Lewandowski stepped in and separated her from Trump.

Let's remember. The 45- minute press conference was over. Trump was no longer taking questions. He was trying to leave the building. She trotted alongside, getting inside security and sticking a microphone in his face.

You might say she was doing her job. Fine. But don't tell me that no reporter has ever been jostled, herded, blocked, shoved or pulled away. That's all part of the job, especially when you are somewhere you're not supposed to be.

That would work too but Trump's lawyers would likely tell him that that would be risky as it would give various news outlets a chance to run all kinds of negative stories that Trump can't control and that Trump's media stooges (all the FNC non-news staff) would find hard to defend. And she'd drop those charges against Corey tout suite.
