United States News Title: Illegal alien creep hit and runs, kills 7 year old JERSEY CITY – A judge on Wednesday set bail at $250,000 cash for an Ecuadorian immigrant who’s living in the country illegally and was accused of leaving the scene of an accident in which a 7-year-old girl was killed in West New York this week. Authorities say Fabian Rodriguez, 33, of Newark, struck and killed Sheyla Pichardo while she was walking to school with her mother on Monday morning. During his first court appearance at the Hudson County courthouse on Wednesday, prosecutors asked for the $250,000 bail amount, saying Rodriguez tried to avoid responsibility for the accident by leaving the scene and later falsely reporting that the vehicle was stolen. His lawyer argued that Rodriguez later cooperated with the authorities, a notion Assistant County Prosecutor Michael D’andrea said was “ridiculous.” In setting the bail, Judge Paul M. DePascale said the amount was appropriate because of Rodriguez’s illegal immigration status. Rodriguez and his wife, Johana Rosas-Alvarez, 26, who also has been charged in the case, appeared for Wednesday’s hearing over a video teleconference from the Hudson County Jail. Both were dressed in green jail jumpsuits and could be seen covering their mouths, apparently exasperated. At several points before the hearing began, Rosas-Alvarez wiped tears from her face and Rodriguez shook in his head. The judge set Rosas-Alvarez’s bail at $7,500 with an option to pay 10 percent to secure her release. She allegedly filed a false police report that her SUV was stolen immediately after the accident, a move authorities believe was a cover-up. Surveillance footage of the accident shows a Chevy Tahoe striking Sheyla and her mother while they were in a crosswalk on 61st Street at Van Buren Place in West New York. Authorities said Rodriguez exited the vehicle and approached the victims before retreating to the SUV and speeding away. Sheyla suffered severe head trauma and later died at a local hospital, while her mother, 32-year-old Yeimie Vital, was hospitalized with non-life-threatening injuries. Rodriguez’s lawyer, Brooke Barnett, said her client was presumed innocent. She said it was too early to tell whether prosecutors would be able to prove the identify of the driver from the camera footage. Barnett said Rodriguez wished to express his condolences to the Pichardo family. Ironically, she said, he and his wife have a 7-year-old son together. She said Rodriguez “somewhat” cooperated with the authorities. “As far as I’m concerned, he didn’t run, he didn’t go outside of the country,” Barnett said. A lawyer for Rosas-Alvarez said her life was “shattered” by the ordeal. Speaking to her on the phone, she told him, “in a matter of minutes her whole world got turned upside down.” The lawyer, Rodrigo Sanchez, said he expected her to be released on bail tomorrow. He said she would “take responsibility” for her role, but declined to comment on whether she filed a false police report. “I feel like she got caught up in something we’ll be able to resolve expeditiously,” Sanchez said. Detectives in West New York identified the first and last two characters of the SUV’s license plate from camera footage and cross referenced the information with vehicle registration records. They traced the vehicle to a house in Newark, where they arrested Rodriguez and Rosas-Alvarez. Rodriguez faces up to 10 years in prison if convicted of leaving the scene of a fatal accident, while Rosas-Alvarez faces a sentence of up to 18 months each on hindering apprehension and obstructing a governmental function charges.
