In this February 18, 2014 Times file photo, Tommy Drake is seen during an interview at The Cullman Times. The Drake Law Firm reportedly filed a federal lawsuit alleging that Republican Presidential candidate Ted Cruz, by virtue of his Canadian birth to a mother who is a U.S. citizen, is not a “natural born” U.S. citizen and is, therefore, not legally qualified to run for the presidency. The local GOP isn’t choosing sides on whether U.S. Sen. Ted Cruz (R-Texas) is qualified to seek his party’s presidential nomination — at least, not right now. Why’s that important? Because, according to a Friday report at al.com, a handful of Cullman County residents has filed a federal lawsuit alleging that Cruz, by virtue of his Canadian birth to a mother who is a U.S. citizen, is not a “natural born” U.S. citizen and is, therefore, not legally qualified to run for the presidency. The suit, a copy of which al.com said it received Friday from the Drake Law Firm in Cullman, was reportedly filed in U.S. District Court last week. Attempts to reach Tommy Drake of the Drake Law Firm at his office Saturday were unsuccessful. At issue is the interpretation of the U.S. Constitution’s requirement that “no person except a natural-born citizen, or a citizen of the United States…shall be eligible to the office of president.” Local GOP party chair Kelly Duke was surprised to learn of the suit Saturday evening, saying the local party’s leadership would not be in a position to offer an official opinion anytime soon, if at all. “To be honest, this is absolutely the first I’ve heard about it,” said Duke. “I’m not going to make any comments as far as the Cullman County Republican Party is concerned.” Duke said he knew of no other instance, either in Alabama or in other states, involving a legal challenge to Cruz’ eligibility for the presidency. The lawsuit mirrors the many so-called “birther” lawsuits filed against current President Barack Obama since 2008, challenging his eligibility on the basis of his citizenship. In January, Houston, Texas attorney Newton B. Schwartz Sr. filed a federal lawsuit against Cruz similar to the Drake Law Firm’s filing. A Florida resident also filed a “birther” lawsuit against U.S. Sen. Marco Rubio (R-Fla.) in January, challenging his legal eligibility to seek the presidency. Good ,Drake and his law firm can face sanction and disciplinary actions for filing a frivolous law suit . Although SCOTUS has not decided this question ;one thing the courts have been very clear about in numerous cases against the emperor is that private citizen do not have standing to challenge the constitutional eligibility of a person to be President. This clown Drake should know the decisions about standing ;so this case ,like the Texas case is frivolous .

As always, the courts will refuse to grant any legal standing to make such a challenge. That way, they try to stay out of these fights over elections. I don't see why this bunch in AL think they'll get standing when all the similar attempts against Obama fell flat in the courts. And Cruz is actually known personally on the Court, having clerked for Rehnquist when he was chief justice. Cruz also argued a number of cases successfully before the Court, a few of them pretty major cases. I don't see how this goes anywhere. Anyone can file such a suit but the courts don't have to take it up. They certainly didn't with Obama.

This is the United States of America, not the United Nations! Typical Country Club Republicans trying to manipulate the system so another Globalist Bush might be able to get the nomination. I'd really love to see the list of names of the clients that hired that law firm to file the suit,as well as a list of candidates the law firm has contributed to and supported in the past. ISLAM MEANS SUBMISSION! Why is democracy held in such high esteem when it’s the enemy of the minority and makes all rights relative to the dictates of the majority? It's not really about any courts other than the Court of Public Opinion. The goal is to influence the casual voters that never pay any real attention to politics or the candidates except for once ever 4 years. They want to convince them that Cruz isn't eligible so they can try to encourage them to support JEB. ISLAM MEANS SUBMISSION! It's a legal distinction only, not a moral one or an endorsement. They're constitutionally qualified, That's the first step in picking a prez.

If you strip away all of the immigration statues passed by congress and you're still a US citizen, then you're natural born. Cruz does not pass the 14th amendment requirement "born in the United States". He's a citizen at birth by NATURALIZATION (statue), not natural born.
