(New York, NY) December 7th, 2015, -- Donald J. Trump is calling for a total and complete shutdown of Muslims entering the United States until our country's representatives can figure out what is going on. According to Pew Research, among others, there is great hatred towards Americans by large segments of the Muslim population. Most recently, a poll from the Center for Security Policy released data showing "25% of those polled agreed that violence against Americans here in the United States is justified as a part of the global jihad" and 51% of those polled, "agreed that Muslims in America should have the choice of being governed according to Shariah." Shariah authorizes such atrocities as murder against non-believers who won't convert, beheadings and more unthinkable acts that pose great harm to Americans, especially women.

Mr. Trump stated, "Without looking at the various polling data, it is obvious to anybody the hatred is beyond comprehension. Where this hatred comes from and why we will have to determine. Until we are able to determine and understand this problem and the dangerous threat it poses, our country cannot be the victims of horrendous attacks by people that believe only in Jihad, and have no sense of reason or respect for human life. If I win the election for President, we are going to Make America Great Again."

No. This makes no sense at all. We can't stop people from coming to the U.S., even if they if they fill in the blank:

Reason for entering: To kill Americans.

You see, that would violate the Equal Protection clause. Yes, yes, I know. You'll respond that affirmative action and racial preferences also violated the EP clause. But the court allowed that because it served a “compelling state interest”.

So I ask you. How does banning Muslims who want to kill Americans serve our interests? If you can't answer that, then we can't ban Muslims.

I woke up this morning hearing this on the radio news. I don't know where he was, some kind of a rally, but the crowd was very loud in agreement with him. I also heard Jebby bashing Trump calling him "unhinged". The reporter also reported that Trump was slammed by Kaisch, Christie, Grham, and others.

The PC crowd may wet their panties over this, but I will bet dollars to doughnuts that Trump will gain in the polls over this.

It is anecdotal, but I went to a gun show this past Saturday. The general mood was people are upset about terrorism, and of all the presidential candidates, the only favorable comments I heard were about Trump. Hillary - no.

The PC crowd can cry all they want, but the American people do not want the country to be flooded with rattlesnakes.

Admitting minorities to college over qualified whites, for example, is a violation of equal protection. It was allowed by the USSC due to a "compelling state interest" in achieving diversity on campus.

The current cases (filed by white students) in front of the court today are claiming a violation of equal protection.

Do you read what you write? I would have though saving american lives was a compelling state interest, but then banning weapons that kill more americans every year than terrorists ever have is not a compelling state interest. A better question is what is a compelling state interest, anything short of a hot war doesn't appear to be and even then motives have to be questioned.

Trump has succeeded, noone is talking about his opponents policies, they are just talking about him and sooner or latter he can just dismiss it all with an "I overreacted" and move on with less opponents nipping at his heals.

Here is a question for you which is preferable? banning muslims or banning a class of weapon used by muslims to kill americans? I see banning weapons as the lesser of two evils, In fact it would make no difference since there are already so many weapons that it would take a long time to make any difference in the weapon population.

Instead of banning muslims you could just do what you do to Syrian refugees to all muslims. That screening has been so effective that few have been allowed to settle in the US

Syllabus:

(a) The admission of aliens to this country is not a right but a privilege, which is granted only upon such terms as the United States prescribes. P. 542.

(b) The Act of June 21, 1941, did not unconstitutionally delegate legislative power to prescribe the conditions under which aliens should be excluded. Pp. 542-543.

(c) It is not within the province of any court, unless expressly authorized by law, to review the determination of the political branch of the Government to exclude a given alien. P. 543.

(d) Any procedure authorized by Congress for the exclusion of aliens is due process, so far as an alien denied entry is concerned. P. 544.

At 544:

Whatever the procedure authorized by Congress is, it is due process as far as an alien denied entry is concerned. Nishimura Ekiu v. United States, supra; Ludecke v. Watkins, supra.

In the particular circumstances of the instant case the Attorney General, exercising the discretion entrusted to him by Congress and the President, concluded upon the basis of confidential information that the public interest required that petitioner be denied the privilege of entry into the United States. He denied her a hearing on the matter because, in his judgment, the disclosure of the information on which he based that opinion would itself endanger the public security.

We find no substantial merit to petitioner's contention that the regulations were not "reasonable" as they were required to be by the 1941 Act. We think them reasonable in the circumstances of the period for which they were authorized, namely, the national emergency of World War II. Nor can we agree with petitioner's assertion that Proclamation 2523 (see note 2, supra) authorized only the Secretary of State, and not the Attorney General, to order the exclusion of aliens. See Presidential Proclamation 2850 of August 17, 1949 (14 Fed. Reg. 5173), amending and clarifying Proclamation 2523. We reiterate that we are dealing here with a matter of privilege. Petitioner had no vested right of entry which could be the subject of a prohibition against retroactive operation of regulations affecting her status.
