Title: Two Kids Spotted Playing on a Beach, Cops Arrest Their Parents for Negligence

Parents who let their boys, ages 7 and 9, play on their own for an hour at a family beach will be arraigned later this month on charges of reckless endangerment of a child.

Charles Smith and Lindsay Pembleton of Niagara Falls were vacationing with their kids on Cape Cod. The boys wanted to stay at the beach for a little longer rather than walk back to the nearby campground (which is, according to one commenter, accessible via a car-free path). The parents said okay, but told them they couldn't go in the water, according to The Cape Cod Times.

By the time a lifeguard spot the children, they were—gasp—wet from the rain. What's more, they were "standing around a food truck with no adults in charge."

Thankfully, the police were called before any of that wetness and unsupervised food trucking could escalate into something worse—something potentially lethal (potentially):

“Although Head of the Meadow is a family beach with lifeguards, the Truro police have been called there for numerous calls related to dog bites, shark sightings, lewd conduct and people taking pictures of children,” [Officer] DeAngelo wrote in her report.

Those couldn't possibly be parents taking pictures of their own children, could they? Never mind. Always throw in sharks. And dogs. And predators. Wait... did the cop forget predators?

"Through my training and experience as a sexual assault investigator young boys at the ages of 7 and 9 are prime candidates for sexual predators."

Phew!

"This being a tourist community with a small year-round population, most people who frequent the beach are transients and unknown.”

In other words: Most people at the beach are on vacation.

Even though over 90 percent of sex crimes against kids are committed by people they know, not random beach inhabitants, the cop decided to file reports of suspected abuse or neglect in both Massachusetts and New York. And, for good measure, she also "applied for criminal complaints against them in Orleans District Court."

Apparently it is a crime to let your kids do anything by themselves. After all, they could end up standing around a food truck! Or wet.

Can't have that.

Ironic that this article was published in Reason magazine. An article which totally lacks any sort of reasonableness. It belongs in a magazine called Naiveté.

Hey. Nothing happened to these kids, meaning nothing CAN happen to kids left alone on a beach. Right? Sound reasonable?

Kinda tough for two kids to drown (in the original article) when they are standing by a food truck in the rain.

I figured your opinion on this would mimic that of the other statist tool who posted.

You don't like the law. You think it's silly. Fine. Have the parents sign a document saying they won't sue or use any government services if something happens to their kids and they can do whatever they want.

Two face charges of leaving children alone at Truro beach

Couple from New York left their sons, ages 7 and 9, unattended because the boys did not want to return to their campground, police said.

NORTH TRURO — Two Niagara Falls, New York, residents will be arraigned in November on charges that they left two children, ages 7 and 9, alone for an hour in August on a public beach, according to Orleans District Court records.

Charles Smith, 44, and Lindsay Pembleton, 30, will be arraigned Nov. 23 on one count each of reckless endangerment of a child, from an incident Aug. 23, records show.

Police were called at 4 p.m. that day to the town of Truro’s side of Head of the Meadow Beach on a report by lifeguards that two young boys were alone and wanted to walk back to a nearby campground, according to a report by police Sgt. Carrie DeAngelo. When Deangelo arrived at the beach, Smith and Pembleton also had just arrived. The 7-year-old is Pembleton's son and the 9-year-old is Smith's son, according to the report. The couple, who were dating, told police they had left the boys behind, with instructions to stay out of the water, because the boys wanted to stay at the beach rather than go back to the campground with their parents, according to the report.

Two lifeguards who were on duty at the time, Amy White and Matthias Christensen, told DeAngelo that the children were alone for about an hour, that they had only a blanket with them, that their shirts became soaked when it began to rain and that they were standing around a food truck with no adults in charge, according to the report.

“Although Head of the Meadow is a family beach with lifeguards, the Truro police have been called there for numerous calls related to dog bites, shark sightings, lewd conduct and people taking pictures of children,” DeAngelo wrote in her report. “Through my training and experience as a sexual assault investigator young boys at the ages of 7 and 9 are prime candidates for sexual predators. This being a tourist community with a small year-round population, most people who frequent the beach are transients and unknown.”

At the scene, DeAngelo told Pembleton and Smith that "leaving two boys ages 7 and 9 alone, without anyone knowing, without proper shelter from the elements and without any way of contacting them placed them in danger,” according to the report.

On Aug. 23, DeAngelo filed reports of suspected child abuse or neglect against Pembleton and Smith in Massachusetts and New York and applied for criminal complaints against them in Orleans District Court, the police report says. A criminal history check conducted by DeAngelo showed that Pembleton faces a charge of failure to exercise reasonable control of a minor, related to an alleged domestic July 9 in Niagara Falls.

And we used to walk there 2 miles. Barefoot.

My brother and I did this kind of thing nearly every day from the time we figured out how to get farther away from home than we were supposed to. I went camping a few years back, and ended up next to a spot where a 13 year old boy was left there to himself with equipment and food for a week. I was astonished, as my parents wouldn't have done this with me. We stayed 3 days, and the kid was amazing and would actually sweep his dirt and rake it into lines, fishing and cooking all for himself. He said nothing about being an Eagle scout candidate, but he was a Scout.

"I'd do the same thing."

Uh-huh.

And if they went missing you'd demand an AMBER alert, a county-wide search, call out the Coast Guard and the FBI, demand media time to put out a plea for help, and essentially ask everyone to stop what they're doing and look for your small children you left alone on some beach somewhere.

Since you're not responsible, I guess we have to be, huh? Is that how you see it? We're expected to clean up after you because you have better things to do?

Sure have. Today, people sue everyone at the drop of a hat. And sympathetic juries award them millions.

When I was 8, those people would have been laughed out of the courtroom with the judge telling them, "Next time, supervise your children".

And if someone's child went missing, gosh. What a shame. The parents should have watched them more closely.

When I got my drivers license and my first car me and 3 other guys drove to Florida (2,000 miles round trip) for Spring break and we slept on the beach instead of wasting our money on a hotel...

I remember that we took personal responsibility.

How did you learn personal responsibility? From your parents most likely.

Here we have two parents teaching their child about being responsible - and you don't like it because of the possibility that something might happen and the parents might sue somebody?

Why is it that every time a story like this is posted you trot out the same collectivist bullshit and insist that the State (in your opinion) has the power to dictate how parents must raise their children?

Because the parents will sue the State if something happens. And you know that. Do act so f**king dumb.

Given that the State is going to be held responsible, it only makes sense for the State to set up some rules and regulations to try to protect themselves.

Now, I'll make a deal with you. If the parents are willing to accept 100% responsibility and not sue anyone, I'm willing to get rid of all these silly laws. Deal?

Now you're doubling down on the assumption that all parents are going to file a lawsuit if something happens to their child.

You can not possibly know that for a fact.

You are still intent on punishing the parents because of something that might happen.

...it only makes sense for the State to set up some rules...

Attaboy!

You and your ilk will never be happy until all children are owned by the State and parenting becomes illegal.

But they don't. If something bad happens to their child they hold others legally and financially responsible.

The fact that "some" or "many" or "most" COULD file a lawsuit is sufficient reason to have rules and regulations in effect to minimize irresponsible behavior by the parents.

I believe nothing of the sort. The only time govt should get involved between parents and child is if actual physical harm is being caused. The government should not even have a say in the education. Citizens banding together to form a school district yes, but not a distant behemoth.

In my narrative a boy younger than I was trusted with more freedom than my parents allowed me to have. It shocked me, but again no one called the authorities. We observed and were happy to report he thrived. It further strengthened my belief in the strength of the individual.
