Eaton County, MI — The family of Deven Guilford filed a lawsuit on Wednesday in the U.S. District Court for the Western District of Michigan against Eaton County Sheriff Deputy Jonathan Frost and Eaton County. Around 8:00 pm on February 28, 2015, the 17-year-old Grand Ledge High School was shot seven times by Eaton County Deputy Sheriff Sgt. Jonathan Frost. While he was driving to his girlfriend’s house after playing basketball at his church, Deven was stopped because he momentarily flashed his bright lights to alert the oncoming officer that his brights appeared to be on. Five minutes later he was dead. During this traffic stop, it appears that Deven was puzzled and confused about why he was pulled over and why he was being confronted and ultimately arrested by the officer. The officer did nothing to calm or de-escalate the situation. Instead, Frost rapidly became argumentative and agitated when Deven asserted that the officer had been driving with his high beams on and resisted producing his ID. The entire encounter lasted just over 5 minutes and the backup Frost had called for, before he ever touched Deven or his vehicle, arrived barely a minute after the fatal shots were fired. The lawsuit alleges that Frost’s entire course of action was illegal and in violation of Deven’s constitutional rights. The momentary warning flash of high beams does not violate Michigan law. Hence, Frost had no right to pull Deven over, demand his paperwork, arrest him or require him to exit the vehicle. The force used was excessive and unnecessary. The suit also alleges that the County failed to properly train, supervise or disciple Frost and/or condoned unconstitutional practices, such as making illegal traffic stops. Brian Guilford, Deven’s father and the Personal Representative of Deven’s Estate, is represented by Hugh “Buck” Davis and Cynthia Heenan of Constitutional Litigation Associates, P.C., a Detroit firm specializing in police misconduct litigation. “Deven’s tragic and totally unnecessary death represents a disturbing trend of demanding 100% compliance with police authority, coupled with zero tolerance of risk of harm to police officers. Whatever happened to “protect and serve?” Ms. Heenan said. “When every governmental budget is overloaded with military and law enforcement spending (including courts, jails, prisons, probations, etc.) the decades-long push for ‘law and order’ and the failed ‘War on Drugs’ has made us a de facto police state,” said Mr. Davis. On Wednesday, Deven’s parents released the following, heartwrenching statement: As we take this action today we are outraged at the huge miscarriage of justice done to our son Deven Guilford. For three months we agonized in confusion trying to figure out how our son, who had never even been in a serious fight, was shot seven times coming from basketball at church and going to his girlfriend’s to watch movies. We played scenarios over in our minds trying figure out how Deven could have acted so out of character and attacked Frost as they told us he had. Since the moment we viewed the body camera footage our confusion has turned to outrage over what was done to Deven at the hands of Frost and the whole Eaton County “justice” system. We always had great respect for law enforcement and the men and women who chose that profession in the past. But we must say that belief has been shaken to the core by the actions of Frost and refusal of the Eaton County Prosecutor to hold Frost accountable. The failed criminal justice system forces us to seek other avenues for some kind of JUSTICE FOR DEVEN. Supporters will hold a rally at the state capitol on Saturday, October 24th from 2-5 p.m. Please show your support if you are in the area. Here we have a stupid 17-year-old who apparently has been busy reading all of Deckard's anarchist websites and believing every word. He ran through the litany of "I'm recording this for your safety and mine" to "I don't have to show you any ID" to "You can't do that". The cop was extremely polite, explaining the reason for the stop and asking for ID. Numerous times. Had the kid cooperated, he'd be alive today.

Playing the role of the armchair-detective: From the time the teen is tazed to the time you hear the shots is roughly 8 seconds. Six of those seconds can be counted while the officer is running around the car to chase the teen. The article excerpt that you just posted leads me to believe that there is a struggle that happens in the last 2-3 seconds in the young man's life, where the evil child was able to pummel the officer, in which time the officer also had time to - pull the trigger, realize the round did not discharge, eject a round, recharge the weapon, then fire his weapon 7 times - all while the teen is beating him within an inch of his pathetic life. But hey, at least he got home safely that night! I am relieved for John "call me McClane" Frost.
So, are you saying the teen wasn't shot in the ditch? That maybe he was shot 7 t tim t times someplace else, then dragged into the ditch? Or are you saying the cop w wasn't beaten by the teen, and that the hospital -- where he spent the night -- is c covering up? What ARE you saying, armchair detective?
It's illegal if you're within 500 yards of the approaching vehicle. Which he was.
I did not say that at all. I just noted that the officer chased the teen around the stopped vehicle into a low-light area then shot the teen. It could be a ditch. Maybe not. The video doesn't show a detailed location of the shooting. What I am saying is that there was not enough time elapsed for the teen to get chased around a vehicle, beat up on a grown man, have that grown man attempt to fire his weapon, fumble to eject the round from his "failed" weapon, re-chamber another round in said weapon, and aim/fire the weapon all while being pummeled by the kid. Nearly five seconds of the "fight" was just the teen being chased out of the 8 seconds of filming after the teen is tazed! Hell, just realizing that there was a misfire and dealing with ejection/re-chambering takes more seconds that do not compute in this case, according to the provided videos. I am not contesting the location. I am contest the time lapse versus the thug's detailed description of the events. I might stay in the hospital overnight too if it helps my version of the story! Don't people go to the hospital to get checked and then find out nothing is wrong all the time in hospitals? Maybe that is that department's procedure - to go to a hospital after murdering a civilian... Who knows?!?
Obviously there was, despite what you think. Just claiming, "That couldn't have happened that way" doesn't cut it. If you have an alternate scenario that does fit your timeline, I'd be interested in hearing it. Along with why you think it happened your way vs. the way the cop described it. "I might stay in the hospital overnight too if it helps my version of the story!" Perhaps even hit yourself in the face to create some bruises, too! Right?
A followup on this story from HA. We unfortunately have another police shooting of an unarmed teenage suspect back in the news, though this one took place much earlier in the year. (Before the SJW and BLM get their knickers in a bunch, don’t worry… the kid was white.) Back in February, teenager Deven Guilford was pulled over in Mulliken, located in Eaton County, Michigan. The cause for the stop was the fact that Guilford had flashed his high beams at a cop coming in the opposite direction, so we’re not exactly talking about an international crime spree here. But upon being approached by Officer Jonathan Frost and asked for his license and other normal documents, Deven took it upon himself to refuse and demanded to know why he was being “detained.” Things went from normal to bad to horrible pretty quickly. Upon being told to exit the vehicle and facing arrest, an altercation took place which wound up with Deven being shot seven times. He did not survive the injuries. No action was taken against the cop and now Devin’s parents are taking the matter to court. (Detroit Free Press) Deven Guilford’s parents, Brian and Becky Guilford, said in a statement that their trust in law enforcement was “shaken to the core” by the shooting. “As we take this action today we are outraged at the huge miscarriage of justice done to our son Deven Guilford,” they said. Without any more supporting information that certainly sounds pretty bad. But fortunately for all of us, this was another case where the officer was wearing a body camera for the encounter and recorded all of the activities until the equipment was eventually smashed. (More on that below.) The video has now been released and if you watch the roughly five minutes applicable to the case (below) I think you’ll see that this entire fiasco was completely avoidable… and it was Deven who could have prevented it, not the cop. I should offer the usual warning that the content may be disturbing to some readers, though it doesn’t actually show the moment of death. Just to see how culpable the officer might have been and the attitude he took, you need look no further than the opening gambit as Officer Frost approaches the driver side of the car and begins the conversation with Guilford. Guilford: Yes you did sir. At this point, Frost’s tone is nothing but friendly. The only “weapon” he has in hand is a flashlight. He greets the kid, asks for the totally normal documents which cops ask for in every traffic stop and immediately lets him know why he was pulled over. Let’s stop and ask ourselves a question here. If this kid had simply handed over his license and registration, would this have ended in anything other than a warning and sending him on his way? The parents are claiming that it was an “unlawful stop” to begin with, but in fact it is illegal in Michigan to flash your high beams at another driver within 500 feet. It’s a civil infraction that carries a 2-point penalty on your license so yes, you can be pulled over for it. From that point the officer continues to ask for the documents several more times, growing increasingly frustrated as Guilford continues to refuse, pulling out his phone to record the conversation and then attempting to place a phone call. At that point Frost is clearly fed up and orders Deven out of the car. He refuses to comply and at that point the officer pulls his taser and threatens to use it. Finally Guilford gets down on the ground after much additional arguing, but won’t comply with the commands given so that he can be placed under arrest. That’s when all hell breaks loose. Guilford is resisting and Frost finally fires his taser, but for some reason it doesn’t work. Deven breaks lose and begins attacking the officer. In the muddled final frames of video you can see him, not running away, but in Frost’s face with his fists raised. The body camera is damaged in the attack but there’s still audio in which you hear shots ring out. Here’s what Officer Frost looked like in the ambulance immediately after the event. We always hear from the Social Justice Warriors about the need for cops to approach people in a more human fashion and the importance of training so they can “deescalate” tense situations. I lost track of the number of times Frost calmly asked for the documents and then how many warnings he issued to try to get the kid to calm down and follow instructions. We’re also told that hot under the collar cops are supposed to hold back and never use deadly force unless they honestly feel they are in real danger of death or injury. Frost tried to go to the taser first before resorting to his service weapon while under attack. There is absolutely nothing in this video record which indicates that Officer Frost violated any of these guidelines. In the end, Deven Guilford wound up dead. And it was entirely the fault of Deven Guilford from what I can see.
I've seen the picture of the officer on Facebook. I'd have posted it, but don't really understand the code. As you can see, the officer was assaulted and that picture alone gives plenty of deadly force justification. Just like Zimmerman, repeated strikes to the face, head and neck by an unarmed person can cause death, and the person getting assaulted has justification to take like (law enforcement or non law enforcement). 9 out of 10 of these yella, pro drug, journalistic articles, have another, more accurate story to tell. My only criticism is that the officer did not escalate quickly and firmly enough. He was into his Officer Friendly routine for too long. If he'd been more hardnosed from the first (or second) backtalk, maybe this kid would still be alive. But then, maybe that's just Monday-morning quarterbacking. I suppose I say that because the cop looks physically capable and athletic around 180lb and this punk kid looked 150lb and physically disorganized, barely able to handle his cellphone. It should have ended otherwise than a 17yo mouthy punk dead after flashing his brights, unlawfully or not. Not that that is necessarily the cop's fault, as the FTP-style reports of such incidents always insists. I feel sorry for the cop, who didn't want to shoot a kid but a kid ended up dead for no good reason (than stupidity and circumstances) and he was the one who shot him. And that won't ever change. Now he'll always be the cop that shot the 17yo bright-flasher.
Due to the pro drug, anti LE mantra, all the recent police involved shootings, Furguson and Baltimore, there is a huge huge anti LE climate. The officers now must worry more, with not so much "less support", but with a lot more skepticism than before. You'll see officers try and be too nice, too long to avoid law suits or suspensions. I blame the body cam for that. The result was that the kid thought the cop was soft and that he had the upper hand.
