Bruce Redwine says that he has watched Fairfax County parking enforcement officer tickets his customers’ cars for expired tags or inspection stickers for several years now. Finally, he says that he has had enough and is speaking out.

In almost all cases, he explains, the vehicles are waiting at his garage for state inspection or repair at his Chantilly, Virginia autoshop.

The last time it happened, the Washington Post reports that “he snatched the latest ticket out of Officer Jacquelyn D. Hogue’s hand and added some profane commentary on top.”

Officer Hogue didn’t take kindly to having mean words written about her. As a result, she had Redwine arrested for felony assault on a police officer.

The most amazing thing is that parking enforcement officers aren’t technically police officers. But that didn’t stop her buddies on the force from charging him accordingly.

When the case first went to court, Redwine was sentenced to four days in jail.

Thousands of dollars in legal fees later, Redwine has appealed and won an acquittal. But the whole incident has left him extremely bitter.

The Washington Post reports that Redwine doesn’t “understand why Fairfax police have zealously sought to enforce laws on expired tags or inspections, mainly on drivers who are making the effort to get their cars into compliance, while on private property.”

Ray Barrera of A&H Equipment Repair said, “they’re harassing the small businesses trying to make it in this tough economy.”

He says his customers have been charged a total of $60,000 in fines and fees over the past six years… all while parked on his private property, and all while awaiting inspection for the things they were being ticketed for.

No. They were parked there waiting for car repairs. The Fairfax County parking enforcement officer was authorized to check the vehicles for expired inspection tags. Which she did.

He was charged with assault for twisting the ticket out of her hand.

From the Washington Post Article:

Hogue wrote in her report that Redwine “squeezed my hand and twisted it” and that it later began to swell. An officer took pictures of Hogue and her hand. A number of officers and supervisors arrived on the scene, the reports show, but they elected not to charge Redwine with felony assault.

Instead, Wright said, Hogue was advised to see a magistrate and obtain a misdemeanor charge. Four days later, she did. But the magistrate, Fred Bubenhofer, issued a felony warrant for assault on a police officer.

Redwine subsequently drove to the county jail, was handcuffed, booked, fingerprinted and photographed. “I’d made it 57 years without any arrest record until that,” Redwine said.

When Fairfax prosecutors looked at the case before Redwine’s preliminary hearing in January, they acknowledged that a parking enforcement officer did not fit the legal definition of a law enforcement officer and reduced the charge to a misdemeanor. But when Redwine went to trial in general district court in April, Judge Ian O’Flaherty convicted him and sentenced him to four days in jail.

Redwine appealed to circuit court and had a jury trial on Sept. 9. Young said that Hogue did not testify that Redwine had grabbed or twisted her hand and that the photos from that day did not show any injury. The jury was out about 20 minutes before finding Redwine not guilty, court records show.

Young said Redwine offered to apologize to Hogue for his angry comments to her, in exchange for dismissing the charge, but Hogue declined. He said the officers who testified “thought it was ridiculous that it was being prosecuted so vigorously. . . . Is this the kind of investigation we pay police to do?”

They must have some screwed up written laws in that state. In NY, to have PC to write a car for uninspected or unregistered, the car must in fact be unregistered or uninspected AND ON THE MAINTAINED PORTION OF THE ROADWAY.

I'd never write a ticket for a car parked on private property unless I followed it in on that property from the roadway.

I can explain it. They are doing it because they can do it,because they were told to do it to pump up revenue,and because what's safer than leaving a ticket on a car with no one in it?

What is the provable offense? If I buy an inoperative vehicle and have it towed to a garage, and parked on the private property of the garage, does it need either an inspection sticker or registration to be sitting there? The vehicle may never have been driven on a public road without a sticker and registration. How does the parking enforcement officer know that any offense has occurred?

Big whoop. How did the property management company invent an offense? It does not appear that the Fairfax County, Va laws are that crazy.

Inoperable Vehicles

Cars, trucks or vehicles that do not work may only be kept on a residential lot if they are within a fully enclosed building or structure, or are kept completely screened or shielded from view in accordance with Chapter 110 of the Code. An inoperable vehicle is defined as one that:

Does not start and move under its own power; or

Does not display valid license plates; or

Does not display a valid inspection decal or one that has been expired for more than 60 days.

For complaints about junk or inoperable vehicles on private property, contact the following departments:

Five or less vehicles: Police Department Traffic Division Impound Section,703-280-0716, TTY 711 or email.

Six or more vehicles: Department of Code Compliance, 703-324-1300, TTY 711.

Of course, “he snatched the latest ticket out of Officer Jacquelyn D. Hogue’s hand and added some profane commentary on top.” He wasn't charged for calling anybody out, but for his action.

40 days after being towed, the vehicle can be declared abandoned. The vehicle can then be sold/disposed of.

Under your definition of an arrestable unregistered offense, I could pull into the local Chevy dealership with my patrol car, and write the owner 500 tickets.

To be a violation of the state, for a state law, THE VEHICLE MUST BE ON THE MAINTAINED PORTION OF THE ROADWAY.

The only exception would be a local ORDINANCE regarding unregistered vehicles on a property.

No, read it again. That only applies to an inoperable vehicle kept on a residential lot. The garage would apparently be a commercial lot.

The Counter Current News article conveys that tickets were issued to vehicles "while parked on his private property, and all while awaiting inspection for the things they were being ticketed for." The property is part of a commercial condominium.

The letter permitting parking enforcement to set foot on the property was issued by the property manager, J.R. Motz of Commercial Condominium Management. The auto shop is located at Mariah Business Center on Sullyfield Circle off Route 28.

A police spokesperson said, “The minute they stop enforcing they’re going to get calls from the property manager.” They are authorized to go on the property and enforce the code, but what part of the code are they enforcing?

Redwine alleged that the parking enforcement officer "ticketed a Mercedes with an expired tag even after it had been pulled into his shop."

As I read the county code, it applies to residential lots.

Additional garage operators claim similar stories which appear to wind up accounting hundreds of thousands of dollars. The WAPO article is more complete. This whole thing smells of a revenue enhancement program with the cooperation of the commercial property condominium operator.
