LOS ANGELES – Hundreds of immigrants with mental disabilities who were deported from the U.S. after representing themselves in court may be allowed to return to the country under a settlement approved by a judge Friday.

Federal Judge Dolly M. Gee's ruling will let immigrants with serious mental disabilities request to have their cases reopened in hopes of returning to the U.S. The ruling covers immigrants deported from California, Arizona and Washington between Nov. 21, 2011 and Jan. 27 this year.

"This is really a historic settlement," said Carmen Iguina, staff attorney for the ACLU of Southern California, one of the groups that filed the 2010 lawsuit that led to the settlement.

"We're really happy that our class members are going to be able to go back to their communities and families and follow up their cases here," Iguina said.

The government identified 900 immigrants who could benefit from the ruling, though there could be more and it's unclear how many would qualify to have their cases reopened, Iguina said.

Many of those affected are Latino, but she said there's no way to know exactly how many.

Under the agreement, the federal government said it will help those with reopened cases return to the U.S. and pay for some transportation costs.

The settlement comes after an April 2013 injunction that found immigrants with serious mental disabilities have a right to an attorney if they're found mentally incompetent to represent themselves. An October 2014 order then required the federal government to establish screening procedures to determine immigrants' mental competencies. Those procedures took effect in January.

How can an "immigrant" have standing to have a suit in the US court system if they had been found to be in violation of immigration law in the first place? They have been deported, they don't belong here. Do we need to find "busy work" for the judges? Do they have so much time on their hands that they need to go back 4 years and RE TRY cases that do nothing but return people to their homes? INSANITY......The PTB are pushing pushing PUSHING us, it is a miracle that the shooting has not begun in earnest. There is no law but what we are told, and then we are ordered to SHUT UP and take it!!

They were not legally found to be in violation of immigration law in the first place. Judge Gee, at United States District Court for the Central District of California, found the immigration hearing to have been invalid, determining there was a violation of constitutional due process. Legally, there has been no finding of immigration status as the invalid hearing has been set aside.

Deal with the FACTS: there must be a hearing with due process. The federal court found the hearing held was invalid. It is as if it never took place. The complainants are still entitled to a hearing with due process observed.

No, those are not the facts.

Somebody is accused of being an illegal alien. There are all sorts of reasons that an alien may be permitted to stay in the country.

Nobody is deported without the due process of a hearing, to determine if the reasons exist to deport.

That's a quasi-judicial procedure, for which the Constitution guarantees due process.

It is not due process to railroad a non-English-speaking mental midget through a court in which he has no prospect of even knowing what his rights ARE, or how he might stay.

You fascists have always loved kangaroo courts, but you do not rule this country, and you never will. In this country, if you are going through a proceeding that can deprive you of life, liberty, property or take possession of your person and shove you across a border, you get a hearing. And if you're mentally incompetent and can't speak the language, you get representation at that hearing that understands the basic setup, and who can provide the necessary facts to the judge to get a reasonably fair outcome.

Your type just wants to railroad foreigners out of the country because you've decided, before the hearing, that they're illegal, and they don't get to stay. But you're not in charge. The Constitution is, and IT demands due process that is more extensive than you want to give.

Tough luck for you.

Now swear at me again, if it makes you feel good, because that is the only satisfaction you will ever get on this issue. The law doesn't work the way you want it to, and it never will, ever. So if this is where you take your stand, you've lost. If you need someone to rage at in your defeat, swear at me again. I'll just ignore it, and you may avoid a stroke.
