Police kill bystander when New York undercover gun buy goes bad

NEW YORK (Reuters) - A police officer shooting at a fleeing suspect during an undercover gun buy that went wrong killed a 61-year-old bystander in the New York City suburb of Mount Vernon, police said on Saturday.

Two suspects were taken into custody during the investigation into the sale of illegal guns, the New York Police Department said in a statement. The undercover officer in the Bronx on Friday met a suspect who said he had guns for sale and directed the officer to drive to Mount Vernon. A second suspect got into the back seat of the officer's car, pointed a gun at his head and demanded money, the NYPD said.

After the officer gave him cash, the suspect attempted to flee and the officer tried to stop him. When the suspect pointed his gun, the officer fired several times at the suspect, striking him three times in the torso, police said.

A man standing behind the suspect was also hit in the torso. The bystander, identified as Felix Kumi, 61, of Mount Vernon, died early Saturday morning at Jacobi Hospital, police said.

One suspect, identified as Jeffrey Aristy, 28, of the Bronx, was arrested on gun and drug sale charges. The second suspect, identified only as a 37-year-old male, was also taken to Jacobi Hospital and also has charges pending.

If a common citizen accidentally shoots a person wounding or killing, what would happen to the shooter under our laws? Should the police be required to obey those laws and be punished under those laws? If not, why should they be exempt?

Negligent homicide or maybe manslaughter if the victim dies,assault with deadly weapon if they live or die,possible maiming charges,and possible racist charges if the victim isn't white.

Should the police be required to obey those laws and be punished under those laws?

No. As trained officers of the law with extensive training and instant backup on the way,they should be held to a STRICTER standard than mere citizens (civilians,in cop-speak).

I totally agree. When the ones responsible for enforcing the laws feel they are above the laws, the result is a growing police state thoroughly alien to what this nation should be. We see that in the "leaders" of this nation from the top tier to the bottom tier.

That's typically what they do. When engaged in felony criminal activity, if anyone dies, including accomplices, they pin murder on the person(s) doing the activity, even if they never held a deadly weapon or threatened to kill anyone.

Perhaps this type of scenario is exactly why they do it. Without that, no one would be prosecuted for the death of an innocent, and the public doesn't like that. And prosecuting a cop in this situation is so uncool.

Normally shooting a fleeing criminal suspect in the back is murder even for cops. But if he did have a gun and was shooting back, that would be an exception.
