Officers from the Fayetteville, Georgia police department brutally arrested a retired four-star Army general, and now he says he’s ashamed to be an American” because of how out-of-control the police have gotten.

William J. Livsey, 84, along with his neighbors, have accused police of severe violent acts during an alleged dispute with a food delivery driver.

“It’s the first time in my life I’m ashamed to be an American,” Livsey said to the Atlanta Journal-Constitution.

The Raw Story notes a report from the Journal-Constitution, which “noted that a portion of Highway 314 in town was renamed the ‘General Bill Livsey Highway’ in Livsey’s honor.” They add that “he retired from duty in 1987, following a career that saw him win the Distinguished Flying Cross, Silver Star and Distinguished Service Medal, among other honors.”

“They took me away without my shoes, glasses or medicine. I fought for this country so hard, and I’ve tried to do good all my life,” Livsey recounted.

This all started when a delivery driver said his debit card was not accepted. Livsey offered a check, but the driver refused.

What happened next is for a court to sort out. The drive says that the 84-year-old man “grabbed him by the throat and pinned him” against his refrigerator. But the physical state of Livsey makes that somewhat difficult to imagine, as you will see in the video at the bottom of this article.

Police believed the driver though, and they decided the elderly man needed some police-administered “street justice.”

The former commander of US forces in South Korea was swarmed by ten officers, who claim he “resisted” and eventually tried to “punch one of the officers and kick another one all while making threatening and disparaging remarks.”

But neighbors who witnessed this incident say it was “just blown out of proportion,” by the police, according to a neighbor who spoke with local WSB-TV.

“Way too many police for that. Way too many. And the way they handcuffed him was ridiculous.”

"The general" denies this. OK, then what really happened?

Let's see. The delivery driver shows up, the debit card is rejected and the check refused. So they both just stand there staring at each other while someone calls 911 and says, "You'd better send out a whole bunch of cops!"

10 cops show up and start beating on the old man.

So that's what we're expected to believe really happened? More yellow journalism at it's finest.

All over an incident that they did not witness.

Back in the day, upon arriving at the scene of an alleged incident, they ( the officers )would advise the complainant to contact the jurisdictional judge ( back then it was the county judge ) and swear out a warrant. The warrant would then be delivered to the appropriate LE agency, and the arrest warrant would then be executed. Officers were not supposed to take action on their own, merely on the accusation of an individual. If the warrant had been issued, it would be based on sworn, documented claims. Then if later the claim is proven false, the affiant would be guilty of perjury, and would be prosecuted for same.

If the officers take action like in this case without that process, unilaterally, then they have gone too far, and are on their own.

They are only supposed to take action upon activity they have witnessed and have probable cause, or for which they have court orders ( executing issued arrest warrant, etc. ).

Things may be somewhat different nowdays, but I believe them to still be basically the same. I will wait to hear GI's opinion.

But, I believe this was an inappropriate beat down!

Well, upon arrival, the officers can develop enough PC to make a warrantless arrest, based on the statements from the alleged victim, provided the suspect is still at or near the scene and can be identified by the victim.

As far as the issue of "10 cops being too many". It's always been my experience that in most cases, you can't have too many officers on scene. There are cases, however, where too many cops is a bad thing, and as a supervisor, I'd always make the officers I didn't need at a scene, roll back in service. If someone is resisting, that's a case where too many is never enough. In resisting cases, other people will come out of the woodwork to interfere... and within seconds, a handful of cops are not enough.

As far as excessive force. Officers only should exert enough force to get the resistor in custody. No more, no less. Often times elderly resistors will hurt themselves in the struggle. This very well could have been excessive force, hard to tell, I wasn't there. If the officers violated his rights by purposely hurting this subject when it wasn't necessary, then they should be charged and grand juried.
