Officers from the Fayetteville, Georgia police department brutally arrested a retired four-star Army general, and now he says he’s ashamed to be an American” because of how out-of-control the police have gotten. William J. Livsey, 84, along with his neighbors, have accused police of severe violent acts during an alleged dispute with a food delivery driver. “It’s the first time in my life I’m ashamed to be an American,” Livsey said to the Atlanta Journal-Constitution. The Raw Story notes a report from the Journal-Constitution, which “noted that a portion of Highway 314 in town was renamed the ‘General Bill Livsey Highway’ in Livsey’s honor.” They add that “he retired from duty in 1987, following a career that saw him win the Distinguished Flying Cross, Silver Star and Distinguished Service Medal, among other honors.” “They took me away without my shoes, glasses or medicine. I fought for this country so hard, and I’ve tried to do good all my life,” Livsey recounted. This all started when a delivery driver said his debit card was not accepted. Livsey offered a check, but the driver refused. What happened next is for a court to sort out. The drive says that the 84-year-old man “grabbed him by the throat and pinned him” against his refrigerator. But the physical state of Livsey makes that somewhat difficult to imagine, as you will see in the video at the bottom of this article. Police believed the driver though, and they decided the elderly man needed some police-administered “street justice.” The former commander of US forces in South Korea was swarmed by ten officers, who claim he “resisted” and eventually tried to “punch one of the officers and kick another one all while making threatening and disparaging remarks.” But neighbors who witnessed this incident say it was “just blown out of proportion,” by the police, according to a neighbor who spoke with local WSB-TV. “Way too many police for that. Way too many. And the way they handcuffed him was ridiculous.” Watch the local WSB’s report in the video below…

An 84 year old man is resisting arrest? Right. I know my dad was a bit testy when reaching that age. He resisted many a healthcare professional trying to draw blood since he used blood thinners daily. However, someone that age can only resist arrest with a blunt instrument or firearm. Does not seem to be the case here. I said "really" because there are so many other ways to handle even a testy 84 year old. From the looks of the pics provided it looks like the General was on blood thinners too by the bruising of his arms. He could have lost blood and his life. A debit card IS your checking account. If the card is rejected it means there's no money there. So expecting someone to accept a written check is ridiculous.

"The general" denies this. OK, then what really happened? Let's see. The delivery driver shows up, the debit card is rejected and the check refused. So they both just stand there staring at each other while someone calls 911 and says, "You'd better send out a whole bunch of cops!" 10 cops show up and start beating on the old man. So that's what we're expected to believe really happened? More yellow journalism at it's finest.

That is when Livsey allegedly grabbed the driver’s throat and facial hair, pushed him and pinned him against a refrigerator in his kitchen. During the assault, police said, two people in the home took the food, placed it on a counter and began eating it. The driver was ultimately released and reported the incident to police, the chief said. Officers went to Livsey’s home in the 200 block of Carriage Chase. Police said he told them he ordered the food and consumed some of it without paying for it. He also said the delivery driver pushed him when his debit card was rejected, Pitts said. Pretty much what happens every time in a case like this - a thugscrum of cops shows up and instead of dealing with the situation in a professional manner, they assault the man and then make up a story to justify it. In a Cop Culture, the Bill of Rights Doesn’t Amount to Much I cannot believe it hasn't occurred to you that the debit card and checking account might be of two different accounts. But that won't stop you from defending the police no matter what wrong they do, or might have done.
Not always. For three reasons. 1. Within 4 hours I successfully used my debit card to pick up groceries only to later have it declined at a gas station. I immediately went to the ATM and it dispensed money for me I knew was there. Called the bank and they put a fraud alert on my card due to some security breach. Has happened to me a few times. 2. Sometimes those mobile card swipers are crappy. If the delivery guy was using a mobile device to swipe the card sometimes that is hit or miss. Some of those services don't accept certain cards. Usually delivery food places take your credit/debit card over the phone and before delivery can resolve these issues. So it must have been one of those mobile device crappy readers. 3. The check could have been from a completely different bank account. That would not matter as the restaurant had a no checks policy. Finally, all could have been avoided if (1) The general just said "ok take the food back" or "call your manager, I want to talk with them." At that point the manager would have said "Hey Ping come back, we bill general, ok bad Ping leave nice customer alone." Or (2) the delivery man could have nodded his head and said 'we can work this out sir, please speak to my manager.' Cops could have been avoided if one or the other or both were not jerks. All over an incident that they did not witness. Back in the day, upon arriving at the scene of an alleged incident, they ( the officers )would advise the complainant to contact the jurisdictional judge ( back then it was the county judge ) and swear out a warrant. The warrant would then be delivered to the appropriate LE agency, and the arrest warrant would then be executed. Officers were not supposed to take action on their own, merely on the accusation of an individual. If the warrant had been issued, it would be based on sworn, documented claims. Then if later the claim is proven false, the affiant would be guilty of perjury, and would be prosecuted for same. If the officers take action like in this case without that process, unilaterally, then they have gone too far, and are on their own. They are only supposed to take action upon activity they have witnessed and have probable cause, or for which they have court orders ( executing issued arrest warrant, etc. ). Things may be somewhat different nowdays, but I believe them to still be basically the same. I will wait to hear GI's opinion. But, I believe this was an inappropriate beat down! A retired 4 star general should have a very good retirement pension, which casts doubt on the payment issue. Additionally, 10 cops for an 86 year old cream puff is at least an 8 cop over kill. I suspect the neighbors saw it correctly.

When the delivery guy objected, he was assaulted. He called the cops, and when they showed up the general resisted arrest. Shameful behavior on his part. All around.

He retired in 87. Even with COLA increases that is ok for today. But these generals have good job opportunities after retirement. I'm sure he has a second retirement with some graybeard firm in DC or Ft Leavenworth KS. So yeah this guy is not hurting for money. You figure today 75% at 30 years and base pay is well over six figures for 4 star generals. Put that in 1987 pay scales. Given the lack of coherency and logic in your arguments, the police should be happy you are not working for them trying to convince a jury about this general.
That doesn't matter anymore the police will charge the guy with so many things his lawyer will "counsel him" to take a plea bargain for a reduced sentence. Nowadays if you've been arrested you've got to be guilty, no ifs ands buts or maybes... It wouldn't take much to "convince" the jury the fine, upstanding general is guilty of theft, assault, and resisting arrest. And I wouldn't even mention the fine, upstanding general's checking account. Or two accounts.
Well, upon arrival, the officers can develop enough PC to make a warrantless arrest, based on the statements from the alleged victim, provided the suspect is still at or near the scene and can be identified by the victim. As far as the issue of "10 cops being too many". It's always been my experience that in most cases, you can't have too many officers on scene. There are cases, however, where too many cops is a bad thing, and as a supervisor, I'd always make the officers I didn't need at a scene, roll back in service. If someone is resisting, that's a case where too many is never enough. In resisting cases, other people will come out of the woodwork to interfere... and within seconds, a handful of cops are not enough. As far as excessive force. Officers only should exert enough force to get the resistor in custody. No more, no less. Often times elderly resistors will hurt themselves in the struggle. This very well could have been excessive force, hard to tell, I wasn't there. If the officers violated his rights by purposely hurting this subject when it wasn't necessary, then they should be charged and grand juried. I'm the infidel... Allah warned you about. كافر المسلح
