Hillary Clinton is going to prison–or would be, if she were an ordinary prison. The FBI has reportedly taken possession of the emails on her home computer server, according to U.S. officials cited by the Associated Press.

According to Sen. Chuck Grassley (R-IA), at least two of the emails contained “Top Secret, Sensitive Compartmented Information.”

An ordinary person–or even a well-known leader like General David Petraeus–would be prosecuted for moving classified information onto a private system. And that is just the beginning of her legal problems.

Clinton not only allegedly exchanged classified information via private e-mail, but also destroyed her emails before handing them over to the State Department before the government could determine for itself which were personal and which were job-related. That could constitute a felony, with a three-year prison sentence attached. And that is just the beginning of what is known.

It is worth noting, too, that much of the information emerging on Hillary Clinton first emerged from three sources: the Benghazi select committee, which the left attempted to dismiss; the independent Judicial Watch organization, which submitted key Freedom of Information Act (FOIA) requests; and the thorough research of Peter Schweizer, who documented Clinton’s alleged conflicts of interests.

Annoyingly, a president has broad discretion in pardons. Including pre-emptive pardons.

You recall that Ford gave a "full, free and unconditional pardon" to Nixon on 9/8/74. The classic case.

There are only three classifications: Confidential, Secret, and Top Secret.

A security clearance does not give access to anything. It only makes one eligible for a grant of access.

The responsible official can grant access authorization to subordinates on a need-to-know basis. According the to book, nobody has any level of access based on their position (except maybe the President?).

SCI is not a classification but a designator for Secret Compartmented Information. Indicators such as NOFORN (No Foreign Nationals) and LIMDIS (Limited Distribution) are caveats. Each limits access to the information. SCI is extremely limited outside of the intelligence community.

Obama was probably born in Kenya. He's a citizen by birth, probably, because of his mother, and therefore "natural born", but that issue should have been vetted by the public in the electoral cycle, but was instead squashed.

Compartmentalization policy doesn't just concern who can read something, it also applies to allowed venues for transmission of info, where a person can read it, whether any copy can be made or any notes taken, requirements to present credentials at an authorized location to read it, etc. So there are various protocols that can be attached to compartmentalized info. One way to implement SCI is how they allowed the congressmen to read the TPP materials a few months ago. I recall that Rand Paul said he didn't have to sign documents when he read it but a couple of his staffers that read them with him did have to sign off. That was reading in a SCIF room in the Capitol. They have other SCIF rooms for the Intel and Defense committees in House and Senate. But SCI goes well beyond just secured reading rooms at the Capitol. It has wide scope across the government in diplomacy, the military, intel agencies.

Yes, the magic words access authorization is very limited. The SCI designator may be accompanied by other caveats or code words which further limit access authorization and restrict handling and storage.

After one look at the Guccifer hack, I was wondering how Hillary could possibly hope to maintain her story that she had not handled classified information on the home server, unless she were to say she never received what Blumenthal sent. That's difficult because she forwarded the stuff and a government investigation would certainly find evidence of that.

Two reasons:

(1) I never paid attention to Trump as a politician before. He was an entertainer, not somebody whose political opinions I thought about.

(2) Obama was born of an American mother, and therefore, under the law when he ran for President, was natural born and eligible to be President no matter where he was born. I personally believe that he was born in Kenya, but that didn't make him not a natural born US citizen. Born a US citizen, you're natural born. I've heard the various arguments, but the only one that had any legal merit was the argument that when he was born his mother was not of an age sufficient to convey citizenship, if he were born in Kenya. Obviously if he was born in the USA, per the 14th Amendment he is a natural born citizen regardless of who his parents were, unless they were diplomats with immunity (which they weren't).

So to me the interesting legal issue is whether or not the later change to the law, which would make him natural born because his mother was American (assuming he was born in Kenya), would retroactively apply to 1961.

If Obama were born in Hawaii, he's natural born. If Obama were born in Kenya to an American mother in 2008, he was natural born. But if Obama were born in Kenya to an American mother in 1961 he was NOT natural born under the laws of the time.

So to my eyes it was always a narrow legal question that the court would need to decide: does a change in the citizenship law apply retroactively for the purpose of determining natural born citizenship for Presidential eligibility purposes?

The Supreme Court has never answered that question, nor ever come particularly close. They both have and have not applied laws retroactively. So what they would say, if they ever accepted a case, was a jump ball. That's interesting.

My own read would be MAYBE NOT. Maybe he wasn't natural born (if he were born in Kenya) because he wasn't born a citizen under the laws at the time of his birth. But I could just as easily see the Court deciding it the other way.

The other arguments, about having to have both parents born citizens, or being born on US soil, or whatever, are just silly, with no legal foundation, so I never paid attention to them.

I was interested in the degree to which Obama was able to successfully cover up the issue, and to issue a patently false Hawaiian document. The degree of naked, open, brazen fraud was so stunning that it was obvious that he was probably born in Kenya, just like he always said before when he was younger. (Of course HE wouldn't remember either way.)

The issue should have been focused upon and politically vetted during the Democrat primary, but it was not. That was interesting. It showed, again, the degree to which extremely powerful people were backing Obama. That he was able to pull it off was educational.

But it was what it was, and McCain didn't raise the issue during the election. Hillary didn't. The proper time, place and manner for that was during the election fight. After the election, there was too much power arrayed with the President, so it just became a sort of theoretical. I knew nothing was going to be done about it, so I stopped focusing on it.

To find out that Trump was pushing the issue is delightful.

Apparently, you entirely missed this entire episode of Trumporama. They refer to Trump's investigators. Trump started this off by saying he was going to hire investigators to get that long-form BC. Then he hooked up with Sheriff Joe who provided him with a posse of Arpaio's top retired deputies. Top men, of course. That's who they mean why they refer to Trump's investigators.

The whole thing was ridiculous but it seems that the Taitz Birthers harped about it long enough that Trump's entry finally got the WH to release the Obama BC. Or the Photoshop forgery of the Obama BC, depending on who you ask.

Don't worry. I'm sure the upcoming debates and interviews will revisit The Donald and The Birth Certificate.

Trump makes me happy with politics for the first time since…well…since we'd won the Cold War and Bush hadn't raised taxes yet.

And the way Trump forces Blitzer to sit there with that little shit-eating grin as Trump insults him and forces him to talk about Obama's birth certificate. Notice how Blitzer is trying to remind Trump they have a long relationship ("Nice doggie...nice doggie...")...do you seriously expect this country to put up with 4-8 years of that?

Trump pulled 2 no-show phone interviews with CNN and one of the other networks just this weekend. And they agree just to get him on the air, knowing he can humiliate them at will.

absolutely ! It's never a good sign when the FBI is seizing property from you. General Petraeus was indicted for much less than what they've ALREADY found on Evita's email server .

It may be that Obama planned all along to made Hitlery the patsy for all of his foreign policy disasters. Once the Xlintons know that that is his intention, they'll suddenly decide they want to spend more time with their family or develop some medical problem. Then Bammy can soft-pedal the server scandal, have DoJ sanitize the evidence, and issue a pardon before he leaves office.

SHE was the Secretary of State. Foreign policy was her bailiwick. Sure, the buck stops with the President, but he's not running for office. She is. And if the Sec State withholds information from the President and doesn't give him the full picture, he can't very well make good decisions And Biden had nothing to do with any of it.

Also, if she goes after Barack Obama, TODAY he controls the Attorney General that will prosecute her and perhaps literally put her in jail, or not. And HE ALONE holds the pardon pen that can let her off the hook if she goes quietly.

He's going to strip her of her Presidential bid using this investigation, and then pardon her at the end, after Biden wins the election (which will happen if the GOP doesn't nominate Trump).

But if she goes after him, he will nail her to the wall and not pardon her.

Obama has all the cards, and Hillary will fall in line or wear orange.
