Hillary Clinton is going to prison–or would be, if she were an ordinary prison. The FBI has reportedly taken possession of the emails on her home computer server, according to U.S. officials cited by the Associated Press.

According to Sen. Chuck Grassley (R-IA), at least two of the emails contained “Top Secret, Sensitive Compartmented Information.”

An ordinary person–or even a well-known leader like General David Petraeus–would be prosecuted for moving classified information onto a private system. And that is just the beginning of her legal problems.

Clinton not only allegedly exchanged classified information via private e-mail, but also destroyed her emails before handing them over to the State Department before the government could determine for itself which were personal and which were job-related. That could constitute a felony, with a three-year prison sentence attached. And that is just the beginning of what is known.

It is worth noting, too, that much of the information emerging on Hillary Clinton first emerged from three sources: the Benghazi select committee, which the left attempted to dismiss; the independent Judicial Watch organization, which submitted key Freedom of Information Act (FOIA) requests; and the thorough research of Peter Schweizer, who documented Clinton’s alleged conflicts of interests.

Just for info, I have been involved on the receiving side of missent SCI information. The authorities, for Hillary the FBI or DIA, show up in a hurry to track down anyone who could possibly have seen or learned of the information, and then get non-disclosure agreements signed by each and all of them. That is just for the innocent people with Top Secret clearances (but not SCI access authorization). In Hillary's case, as she took no effort to protect the stuff, but forwarded it without markings. It's a mess.

Which does not speak to whatever might have once been, but are no longer, in her custody. And then the FBI scoops up her email server and thumb drive.

That could constitute a felony, with a three-year prison sentence attached.

For a military SCI comm worker that would likely mean an immediate loss of SCI access authorization and perhaps loss of all security clearance.

I wonder how they handle a loss of security clearance or SCI access for a presidential candidate, or a president in office.

I stress one more time that Hillary was personally the original classifying authority for the State Department and she was personally responsible for protecting the information.

Something tells me that the FBI was not asking.

I sure would like to know how Clinton's team has worked witi the State Department to ensure her mishandled SCI information is stored in a safe and secure manner. In the military, that stuff is pretty much limited to the brass and the spook community. The Navy facilities that handle it have Marine guards.

Virtually none of the TS cleared people would have had authorization to possess, store, or read it. Uncleared lawyer David Kendall would not be authorized. Ordinary TS material is mild by comparison.

The inspector general for the Intelligence Community notified senior members of Congress that two of four classified emails discovered on the server Clinton maintained at her New York home contained material deemed to be in one of the highest security classifications -- more sensitive than previously known.

WASHINGTON (AP) -- A U.S. official says the FBI has taken possession of Hillary Rodham Clinton's emails, a few of which have been deemed to contain classified information.

The official is not authorized to be quoted by name and requested anonymity.


The official says the FBI recovered two thumb drives containing the emails from Clinton’s lawyer, David Kendall.

Republican Sen. Chuck Grassley says two of the emails, which traversed Clinton's insecure home email server, were deemed "Top Secret, Sensitive Compartmented Information." That’s one of the government's highest classifications.

That is indeed one of the highest level of classification. I think the only higher levels are levels of classification you're not even permitted to know the names of.

This compartmentalized information is what is called Codeword Clearance, I think: You have to be cleared by a special codeword to see the information. That is, it's not just top secret; it's like top secret/GOLDEN TEMPLE, with "GOLDEN TEMPLE" being the codeword of the compartment of information.

You don't just need a Top Secret clearance to see it -- you have to be cleared specifically for GOLDEN TEMPLE information.

So this is either the highest level of classified information, or the highest we know about. (Daniel Moynihan spoke of there being a higher level he couldn't even mention in a 60 Minutes interview.)

Update: KG, who sounds like he knows what he's talking about, writes:

Compartmentalized means you have to be 'read in' to that particular information.. you sit in a SCIF [I believe this is a room where you can read the secret information, but are not permitted to take notes or remove it; this is the "skiff" you hear about Congressmen reading the TPP info in--ace] of some kind, someone who is cleared to handle the information hands it to you, you read through it and then sign some paper work. You then are 'cleared' to read material with that particular code word. So, in other words, just because you have a TOP SECRET clearance does not mean you have access to any and all TOP SECRET classified material. Most TOP SECRET material has one or several code words attached to it. That way, only the people with 'need-to-know' have access and it limits the vulnerability of the information.

Hillary better be prosecuted for this. If she isn't, it is maddening and, personally, I think the whole system collapses. How could you prosecute someone else for a lesser offense after letting Hillary go. She is in deep doo-doo and must've believed herself untouchable due to her 'Clinton' name. This is jail-worthy stuff.

Update: The articles confused me speaking of both "Hillary's server" and a "private email account."

I wrote the emails were in Hillary's private emails.

AllahPundit suggests otherwise: he says that the emails were on her servers, in private emails used by her aids and such, and thus, in a way, "her accounts," but not actually her accounts. Like one of her henchmen's accounts.

I will go with Allah's more cautious reading for now. I have corrected the headline and article to reflect this nuance.

I believe, from Wikipedia, that SI/TK are sorts of SCI information, but I'm not sure.

Confirmed: Schindler says yes, SI and TK are specific codewords in the SCI classification system. As you can see, SI = Special Intelligence and refers to signals intelligence (radio, telephone intercepts); TK = Target Keyhole and refers to satellite intelligence.

"NOFORN" means "NO FOReign Nationals," i.e., US citizens only, no sharing with foreign counterparts.

About half the politicians in Washington DC would not qualify for TS SCI clearance if they held the same standard as they did for us.

You know the questions on foreign travel, foreign acquaintances, MONEY (read debt, foreclosures etc.) Not to mention sexual harassment, abuse, and assault.

Half the people in elected office would fail the NORMAL requirements. That's what makes this such a farce.

Just look at Obolo. It took him 4 years to produce a birth certificate and there are so many holes in his timeline from HS age to the 90s. Wonder who did the background check on him for his clearance?

Annoyingly, a president has broad discretion in pardons. Including pre-emptive pardons.

You recall that Ford gave a "full, free and unconditional pardon" to Nixon on 9/8/74. The classic case.

There are only three classifications: Confidential, Secret, and Top Secret.

A security clearance does not give access to anything. It only makes one eligible for a grant of access.

The responsible official can grant access authorization to subordinates on a need-to-know basis. According the to book, nobody has any level of access based on their position (except maybe the President?).

SCI is not a classification but a designator for Secret Compartmented Information. Indicators such as NOFORN (No Foreign Nationals) and LIMDIS (Limited Distribution) are caveats. Each limits access to the information. SCI is extremely limited outside of the intelligence community.

On that last 11 August 2015 Memo:

Unlike the Petraeus compromise, this one is untrackable. Basically, everything must be assumed compromised due to hacking, and known compromised due to mishandling resulting in unauthorized distribution.

Obama was probably born in Kenya. He's a citizen by birth, probably, because of his mother, and therefore "natural born", but that issue should have been vetted by the public in the electoral cycle, but was instead squashed.

I'm glad that Trump did not let it go, if what you say is true. What a mensch!

SCI is not a classification but a designator for Secret Compartmented Information.

Compartmentalization policy doesn't just concern who can read something, it also applies to allowed venues for transmission of info, where a person can read it, whether any copy can be made or any notes taken, requirements to present credentials at an authorized location to read it, etc. So there are various protocols that can be attached to compartmentalized info. One way to implement SCI is how they allowed the congressmen to read the TPP materials a few months ago. I recall that Rand Paul said he didn't have to sign documents when he read it but a couple of his staffers that read them with him did have to sign off. That was reading in a SCIF room in the Capitol. They have other SCIF rooms for the Intel and Defense committees in House and Senate. But SCI goes well beyond just secured reading rooms at the Capitol. It has wide scope across the government in diplomacy, the military, intel agencies.
