The Bill of Rights or any Amendments are not exonerated from the legislative process, either; I assume you think the Bill of Rights are built on a bedrock or fixed foundation that is unshakable. What is really sad is the government knows this FACT. That is why America is sinking into a cesspool of illegal immigration; it is to liberalize the foundations of America by creating a fascist government by clever opinions outside of American cultural norms or societal standards.
