Tyler, TX — Last week, police in Texas heroically saved the town from likes of two young girls who attempted to open a black market lemonade stand. The girls, one 7-year-old and one 8-year-old, dared to try to raise money to buy a Father’s day present for their dad by setting up a lemonade stand in their neighborhood.

Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father’s Day present. They wanted to take him to Splash Kingdom.

Over the weekend, the two young entrepreneurs took to the streets with their delicious batch of homemade lemonade and began to provide willing customers with their product. Only one hour into their business endeavour, these girls had raised 25% of their goal.

However, their cash cow would be shut down not long after it started. Overton police chief Clyde Carter showed up along with the city code enforcer and shutdown their criminal operation.

The girls had violated Texas House Bill 970, or the Texas Baker’s Bill, which does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since the lemonade would eventually grow mold after being left out for days, police said they needed an inspection from the health department and a permit to sell it and deemed their operation “illegal.”

The cost of the permit is $150 dollars.

“It is a lemonade stand, but they also have a permit that they are required to get,” Chief Carter said.

“I think that’s ridiculous. I think they’re 7 and 8, and they’re just trying to make money for their own cause,” said Sandi Evans, the girls’ mother.

The most absurd aspect of this ordeal is that the police know it’s a ridiculous law. However, they said ridiculous or not, it’s the law and they’ll keep enforcing it.

“We have to follow by the state health guidelines,” said Carter. “They have to have a permit if they’re going to do the lemonade stands.”

Police officers can certainly use discretion and choose not to “enforce” this law for use in such an asinine application. The fact that these girls had their good intentions ruined by those who claim to protect them speaks to the level of discontent with law enforcement in America today.

The heartening side to this story is that these young girls are now learning to bypass this tyrannical system of bureaucratic nonsense. The girls said they will be setting up their lemonade stand again this weekend. Instead of selling it though, they will be giving it away, but they will gladly be accepting donations.

Hopefully next week, we aren’t reading the story of these two Texas girls being raided by the IRS for tax evasion on their lemonade donations. But in today’s police state USA, it would be entirely expected.

The most absurd aspect of this ordeal is that the police know it’s a ridiculous law. However, they said ridiculous or not, it’s the law and they’ll keep enforcing it.

"Just following orders" Hmmm, where have I heard that before?

In all honesty, it's not the fault of the police, it's the fault of politicians.

Whatever happened to the police who killed Eric Garner for selling un-taxed cigarettes?

The media dropped reporting on this because Bill de Blasio wanted 5 or 6 cops to harass this guy for not paying taxes.

You would think by now they would have wised up to the PR nightmare they keep creating every time they do this,and quit shooting themselves in the foot.

Not really. What usually happens is some asshat that runs a nearby business sellign soft drinks,tea,and maybe even lemonade will rat the kids out by filing a formal complaint to the city about how THEY had to buy a business permit so the kids should get one,too. Which means they would have to provide public rest rooms,health inspectors,get a tax stamp,etc,etc,etc.

Once a formal complain is filed,the police have no choice but to shut they down.

Are you obligated to follow that kind of law? Well you are, inside the insane system of positive law. Is it moral to follow that law? Of course not. That is turning natural law on its head. Does following positive law support freedom? No, it supports coercion, the opposite of freedom.

And the SAME analysis applies to virtually ALL positive law. There are countless examples I could give you of made up “positive” non-laws and non-crimes that are passed and enforced. Vices, like smoking pot or paying for sex are not crimes because there is NO VICTIM complaining. They are no more crimes than watching too much t.v. or overeating is a “crime”.

The permit was $150. They were trying to raise $100. Staying open a few more days would have raised enough money to pay for the permit -- with the added benefit of introducing the girls to the effects of oppressive government regulations.

Or, if mom and dad are liberals, they could have sneaked over to the licensing bureau and purchased a permit for them. The little darlings.

Anyways. Now we'll see if mom will follow the strength of her convictions and petition the city to change their vendor licensing laws. I doubt she will. All she really wanted was an exemption for her daughters.

Typical. Support a law to regulate some behavior, then whine and cry when it applies to you.

For crying out loud, this was two little girls with a simple lemonade stand. That was quite common when I was a kid. The cops involved showed virtually NO COMMON SENSE. Yes, for those that want to pick fly specs out of the pepper, it may be a TECHNICAL violation, but the local PD gave it self two Big Black Eyes. Also, this was a waste of LE assets, that would have been better spent going after real bad guys, not a couple of 8 year old girls. Strictly from a PR stand point, this was DUMB, DUMB, and DUMBER.

The next time the PD wants funds for a new cruiser, radios, etc, I can hear a council man asking " whats up chief, do you have an increase in kids lemonade stands. I would have been a man with a brain, told someone to grow up. It was just a couple of little girls, and I would have concentrated my time & attention by looking for real bad guys that presented potential harm to the citizens. Tyler, TX — Last week, police in Texas heroically saved the town from likes of two young girls who attempted to open a black market lemonade stand. The girls, one 7-year-old and one 8-year-old, dared to try to raise money to buy a Father’s day present for their dad by setting up a lemonade stand in their neighborhood.

In Tyler Texas of all places. One of the most conservative Christian Texan places.

Local conservative radio here in Texas mentioned the local gov waived the traveling merchant vendor fee but could not waive the health inspection requirement. Which means local folks and their elected councilmen probably did not expect anyone to push/enforce requiring a kid's lemonade stand to have a health permit.

Plain stupid. We used to run these stands as kids to make enough money to do fun things in the summer.

Here's where a little community common sense comes in. If LE felt they had to 'enforce' 7 year old girls to comply with the letter of the law, then all they had to do was tell the parents to dump out the lemonade at the end of the day. Problem solved.

This law is for those truck vendors who keep their stuff in the truck for days without recycling the beverages and food.

I am sure the good citizens of Tyler Texas will fix this. One of the best places to visit during Texas "spring" to view the roses and wild flowers.

What usually happens is some asshat that runs a nearby business sellign soft drinks,tea,and maybe even lemonade will rat the kids out by filing a formal complaint to the city about how THEY had to buy a business permit so the kids should get one,too. When I was at the command and staff college in KS something similar and not as innocent as a lemonade stand faced the same local merchant onslaught.

5 married Majors decided they did not want to uproot their family and PCS them for a one year assignment. So they all rented and roomed at a farm house near post. They turned the barn into a man cave with electronics, TVs with ball games on all the time. They built a bar and stocked out of their pocket. Soon it became a hang out for their friends and they hosted BBQs and parties there.

They served drinks at these gatherings and had a 'tip jar' for those that wanted to contribute. Then folks they did not know started showing up and word got back to town that there was a 'speak easy' operating at the farm. The local saloon tipped off the DA and police and added some lies like they were hosting sex parties with prostitutes and drugs. So they raided the place and arrested some of the renters. Turns out three of the 5 were high powered up and coming Army JAG lawyers. They quickly got a local bubba lawyer and paid a fine and got a slap on the wrist. The amazing part of this is that although the deputy post commander found out, the post commander (three star) never found out...Until graduation day...that was a most uncomfortable day for them. But given they paid their dues to society already and the 'arrest' was more of a bring you in for questioning, there was not much he could do.

The local DA tried to get these guys on a 1919 temperance law. Amazing.

The 14 year old girl in the bathing suit was just standing in a group of friends when the cop grabbed her and threw her to the ground.

Watch the video -- before this, the girl kept moving away from the rest of the action.

She wasn't threatening anyone.

So, what did she do wrong?

Oh, maybe the cop didn't like what she had to say. Tough shit.. We have something called the First Amendment that let's her say whatever she wants.

The cop threw her to the ground. As as result of the cop's action, two of her friends ran passed the cop and one reached out to touch him.

The cop pulled his gun and luckily two of his buddies stepped in to stop him or it would have been a bloody mess.

Then the cop shoved his knee in the little girl's back. After he had her subdued he put the gun away. So yes, he had a gun pulled on a 14 year old girl in a bathing suit laying on the ground with his knee in her back.

What did this girl do to deserve this???

Even the Police Chief says that the cop was out of control.

How anyone can excuse his behavior is beyond me.

A friend of mine told me a story about the time a lady neighbor went to Las Vegas to play the slots. It was during the days when they still used coins in the slots. She had played the slots all evening and had done very well to accumulate a very large bucket filled with coins….many of which were “silver” dollars. She decided to retire from the hotel casino to her room for the night and keep the coins in the bucket with her to resume play the next morning.

She went to the elevator and pressed the up button. The elevator arrived, she entered and pressed her floor button. Just as the door was closing, someone yelled “hold the elevator” and stuck a hand in to block the doors closing. The doors again opened and into the elevator walked an entourage of five of six neatly dressed Black guys in suits.

The lady became very frightened, so frightened that she dropped the bucket of coins spilling them all over the elevator floor. One of the guys who appeared to be the head of the group, said “let us pick those up for you.” She declined and wanted to pick up all the coins herself. The guy insisted, so many hands were grabbing coins from the floor and placing them back in the bucket.

When the elevator arrived at her floor, one guy held the door until they had all coins back in her bucket. She said “thank you” and almost started to run out of the elevator. The apparent leader of the group said “let us walk you to the door, to make sure you are safe.” She said that would not be necessary. The guy insisted and the group walked her to the door, opened it for her and said “Good Night.”

About thirty or so minutes later, there was a knock on the door. They lady was still shaken and asked “who’s there”….not knowing what to expect. She determined it was room service and opened the door to receive a few dozen roses being delivered to her room. She looked at the card and read something like: “Thank you for a wonderful evening. I have not had so much enjoyment in a long time.” It was signed, “Eddie Murphy.”

I cannot vouch if the story is true of not, I can say that my friend told it to me as being true.

Ok, I get it; You believe Buffy's lemonade and Mom's baked cupcakes for a church or school should be regulated like Keebler or McDonalds. BECAUSE SO MANY people have been "poisoned" by Buffy's lemonade and Mom's cupcakes, right? Ooops. NOT. You might, but I don't quite believe 'Buffy's Lemonade' is paying the mortgage.

I saw the mom and two little girls finally get interviewed on FNC.

The mama said they were selling Country Time lemonade mix and the mama said that the label says it is safe to use for several days without refrigeration. I don't see that on the product info. Country Time is available as a powdered mix or as a liquid concentrate. Pour it in water and stir.

So it wasn't real lemonade at all and had no pulp or sugar or other preparation considerations other than using a clean container to mix it in.

Seems like quite a kerfuffle over lemon-flavored drink mix.

I wasn't aware of the thread you mentioned. It was exceptionally entertaining, too. I can tell you, for a fact, who "Necessary Critique" was on the mentioned LP thread.

Strange as it may seem, I never expected third or higher derivatives from the initiatives performed. But it makes sense as many posters read from one sight to the the other.

At least the cops found a worthy adversary. Did they get to shoot any dogs in the process? It would be a fitting end to a productive day.
