Title: Cops Raid Little Girls’ “Illegal” Lemonade Stand, Shut it Down for Operating Without a Permit

Tyler, TX — Last week, police in Texas heroically saved the town from likes of two young girls who attempted to open a black market lemonade stand. The girls, one 7-year-old and one 8-year-old, dared to try to raise money to buy a Father’s day present for their dad by setting up a lemonade stand in their neighborhood. Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father’s Day present. They wanted to take him to Splash Kingdom. Over the weekend, the two young entrepreneurs took to the streets with their delicious batch of homemade lemonade and began to provide willing customers with their product. Only one hour into their business endeavour, these girls had raised 25% of their goal. However, their cash cow would be shut down not long after it started. Overton police chief Clyde Carter showed up along with the city code enforcer and shutdown their criminal operation. The girls had violated Texas House Bill 970, or the Texas Baker’s Bill, which does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since the lemonade would eventually grow mold after being left out for days, police said they needed an inspection from the health department and a permit to sell it and deemed their operation “illegal.” The cost of the permit is $150 dollars. “It is a lemonade stand, but they also have a permit that they are required to get,” Chief Carter said. “I think that’s ridiculous. I think they’re 7 and 8, and they’re just trying to make money for their own cause,” said Sandi Evans, the girls’ mother. The most absurd aspect of this ordeal is that the police know it’s a ridiculous law. However, they said ridiculous or not, it’s the law and they’ll keep enforcing it. “We have to follow by the state health guidelines,” said Carter. “They have to have a permit if they’re going to do the lemonade stands.” Police officers can certainly use discretion and choose not to “enforce” this law for use in such an asinine application. The fact that these girls had their good intentions ruined by those who claim to protect them speaks to the level of discontent with law enforcement in America today. The heartening side to this story is that these young girls are now learning to bypass this tyrannical system of bureaucratic nonsense. The girls said they will be setting up their lemonade stand again this weekend. Instead of selling it though, they will be giving it away, but they will gladly be accepting donations. Hopefully next week, we aren’t reading the story of these two Texas girls being raided by the IRS for tax evasion on their lemonade donations. But in today’s police state USA, it would be entirely expected. The most absurd aspect of this ordeal is that the police know it’s a ridiculous law. However, they said ridiculous or not, it’s the law and they’ll keep enforcing it. "Just following orders" Hmmm, where have I heard that before? Oh - now I remember.

The cops have been busting bake sales too. I guess pulling guns on 14 year old girls in bathing suits is not enough to keep them busy. :) In all honesty, it's not the fault of the police, it's the fault of politicians. Whatever happened to the police who killed Eric Garner for selling un-taxed cigarettes? The media dropped reporting on this because Bill de Blasio wanted 5 or 6 cops to harass this guy for not paying taxes. What a sad country we live in today.

Not really. What usually happens is some asshat that runs a nearby business sellign soft drinks,tea,and maybe even lemonade will rat the kids out by filing a formal complaint to the city about how THEY had to buy a business permit so the kids should get one,too. Which means they would have to provide public rest rooms,health inspectors,get a tax stamp,etc,etc,etc. Once a formal complain is filed,the police have no choice but to shut they down.
Good points and true. When I was at the command and staff college in KS something similar and not as innocent as a lemonade stand faced the same local merchant onslaught. 5 married Majors decided they did not want to uproot their family and PCS them for a one year assignment. So they all rented and roomed at a farm house near post. They turned the barn into a man cave with electronics, TVs with ball games on all the time. They built a bar and stocked out of their pocket. Soon it became a hang out for their friends and they hosted BBQs and parties there. They served drinks at these gatherings and had a 'tip jar' for those that wanted to contribute. Then folks they did not know started showing up and word got back to town that there was a 'speak easy' operating at the farm. The local saloon tipped off the DA and police and added some lies like they were hosting sex parties with prostitutes and drugs. So they raided the place and arrested some of the renters. Turns out three of the 5 were high powered up and coming Army JAG lawyers. They quickly got a local bubba lawyer and paid a fine and got a slap on the wrist. The amazing part of this is that although the deputy post commander found out, the post commander (three star) never found out...Until graduation day...that was a most uncomfortable day for them. But given they paid their dues to society already and the 'arrest' was more of a bring you in for questioning, there was not much he could do. The local DA tried to get these guys on a 1919 temperance law. Amazing.

The 'cherry on top' to the story was hilarious and legendary. If you believe the sources (I knew a Field Artillery officer who lived with the lawyers) the "Farm House 5" (we tongue and cheek called them) in addition to the fine were ordered by the local magistrate to 'get out of his county' by sun down on graduation day:) The farm they rented used to have Nike Nuclear silos from the old, old Cold War days. So they called the barn bar the "Nike Nuclear Lounge."
