Title: Cops Raid Little Girls’ “Illegal” Lemonade Stand, Shut it Down for Operating Without a Permit

Tyler, TX — Last week, police in Texas heroically saved the town from likes of two young girls who attempted to open a black market lemonade stand. The girls, one 7-year-old and one 8-year-old, dared to try to raise money to buy a Father’s day present for their dad by setting up a lemonade stand in their neighborhood. Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father’s Day present. They wanted to take him to Splash Kingdom. Over the weekend, the two young entrepreneurs took to the streets with their delicious batch of homemade lemonade and began to provide willing customers with their product. Only one hour into their business endeavour, these girls had raised 25% of their goal. However, their cash cow would be shut down not long after it started. Overton police chief Clyde Carter showed up along with the city code enforcer and shutdown their criminal operation. The girls had violated Texas House Bill 970, or the Texas Baker’s Bill, which does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since the lemonade would eventually grow mold after being left out for days, police said they needed an inspection from the health department and a permit to sell it and deemed their operation “illegal.” The cost of the permit is $150 dollars. “It is a lemonade stand, but they also have a permit that they are required to get,” Chief Carter said. “I think that’s ridiculous. I think they’re 7 and 8, and they’re just trying to make money for their own cause,” said Sandi Evans, the girls’ mother. The most absurd aspect of this ordeal is that the police know it’s a ridiculous law. However, they said ridiculous or not, it’s the law and they’ll keep enforcing it. “We have to follow by the state health guidelines,” said Carter. “They have to have a permit if they’re going to do the lemonade stands.” Police officers can certainly use discretion and choose not to “enforce” this law for use in such an asinine application. The fact that these girls had their good intentions ruined by those who claim to protect them speaks to the level of discontent with law enforcement in America today. The heartening side to this story is that these young girls are now learning to bypass this tyrannical system of bureaucratic nonsense. The girls said they will be setting up their lemonade stand again this weekend. Instead of selling it though, they will be giving it away, but they will gladly be accepting donations. Hopefully next week, we aren’t reading the story of these two Texas girls being raided by the IRS for tax evasion on their lemonade donations. But in today’s police state USA, it would be entirely expected. The most absurd aspect of this ordeal is that the police know it’s a ridiculous law. However, they said ridiculous or not, it’s the law and they’ll keep enforcing it. "Just following orders" Hmmm, where have I heard that before? Oh - now I remember.

What's ironic is that the girls' mother probably supported that law when it was written. The permit was $150. They were trying to raise $100. Staying open a few more days would have raised enough money to pay for the permit -- with the added benefit of introducing the girls to the effects of oppressive government regulations. Or, if mom and dad are liberals, they could have sneaked over to the licensing bureau and purchased a permit for them. The little darlings. Anyways. Now we'll see if mom will follow the strength of her convictions and petition the city to change their vendor licensing laws. I doubt she will. All she really wanted was an exemption for her daughters. Typical. Support a law to regulate some behavior, then whine and cry when it applies to you.
The Chief of Police showed up at the stand. Something tells me no beat cop wanted to touch this one.
Can you cite me a reference source that permits an officer to do that? ---- Gatlin Every law,enforcement officer gives his oath to support and defend our constitution (and laws made in 'pursuance thereof'). Obviously, if a law is constitutionally questionable, the officer must use his discretion to choose whether he will enforce it. "I was just following orders", is NOT a valid excuse, and never has been.

This story is a classic example of throwing common sense out the window, and throttle down on "Barneyism". For crying out loud, this was two little girls with a simple lemonade stand. That was quite common when I was a kid. The cops involved showed virtually NO COMMON SENSE. Yes, for those that want to pick fly specs out of the pepper, it may be a TECHNICAL violation, but the local PD gave it self two Big Black Eyes. Also, this was a waste of LE assets, that would have been better spent going after real bad guys, not a couple of 8 year old girls. Strictly from a PR stand point, this was DUMB, DUMB, and DUMBER. The next time the PD wants funds for a new cruiser, radios, etc, I can hear a council man asking " whats up chief, do you have an increase in kids lemonade stands. I would bet that citizens all over town are riding them like the citizens of Mayberry would heckle Barney when he did something dumb. If not, they should. You mean enforcing the law as written? Yeah. What were they thinking? Perhaps you're saying the law should have been written to exclude a certain class of people? Hmmmm. Would that be constitutional? Would that be fair? It's very possible that some commercial vendor called the police chief and complained -- perhaps a commercial vendor who was ticketed for not having a license. Now what? Should the police chief ignore the call, subjecting the city to a discrimination lawsuit? Should the police chief, on his own, make an exception in this case? Tell me. What would you do?

OK Barney. I would have been a man with a brain, told someone to grow up. It was just a couple of little girls, and I would have concentrated my time & attention by looking for real bad guys that presented potential harm to the citizens. Bad guys such as thugs, robbers, murderers, rapists, drug dealers, thieves, etc, etc, etc. I would have protected the citizens, and the law. I would not have given my department, and LEO's in general a black eye, and made the Department the laughing stock of the state, and the entire LEO community of the courtry. Hell, I would have visited their stand and bought a glass, then told them to have a nice day, and continued patrol looking for real crime! I guess in this town, it was easier for this bunch of Barneys to go after two 8 year old little girls, oooh scarey oooh !, than to go after real bad guys. In Tyler Texas of all places. One of the most conservative Christian Texan places. Local conservative radio here in Texas mentioned the local gov waived the traveling merchant vendor fee but could not waive the health inspection requirement. Which means local folks and their elected councilmen probably did not expect anyone to push/enforce requiring a kid's lemonade stand to have a health permit. Plain stupid. We used to run these stands as kids to make enough money to do fun things in the summer. Here's where a little community common sense comes in. If LE felt they had to 'enforce' 7 year old girls to comply with the letter of the law, then all they had to do was tell the parents to dump out the lemonade at the end of the day. Problem solved. This law is for those truck vendors who keep their stuff in the truck for days without recycling the beverages and food. I am sure the good citizens of Tyler Texas will fix this. I keep waiting for the Breaking News gong to sound on Fox News Channel, warning the Great Unwashed about the Tyler Texas Lemonade Gestapo. FNC just loves these lemonade-lasses-tased-by-jackboots-run-amok stories.
Good points and true. When I was at the command and staff college in KS something similar and not as innocent as a lemonade stand faced the same local merchant onslaught. 5 married Majors decided they did not want to uproot their family and PCS them for a one year assignment. So they all rented and roomed at a farm house near post. They turned the barn into a man cave with electronics, TVs with ball games on all the time. They built a bar and stocked out of their pocket. Soon it became a hang out for their friends and they hosted BBQs and parties there. They served drinks at these gatherings and had a 'tip jar' for those that wanted to contribute. Then folks they did not know started showing up and word got back to town that there was a 'speak easy' operating at the farm. The local saloon tipped off the DA and police and added some lies like they were hosting sex parties with prostitutes and drugs. So they raided the place and arrested some of the renters. Turns out three of the 5 were high powered up and coming Army JAG lawyers. They quickly got a local bubba lawyer and paid a fine and got a slap on the wrist. The amazing part of this is that although the deputy post commander found out, the post commander (three star) never found out...Until graduation day...that was a most uncomfortable day for them. But given they paid their dues to society already and the 'arrest' was more of a bring you in for questioning, there was not much he could do. Hate to say it but given the time of year with coaching baseball and the hours at work recently I have not been following much of FNC or any news source other than here and on the net. Frankly it is quite liberating not hearing O'Reilly and Hannity bloviating every night:) Megan Kelly is becoming the Eva Braun for the hyper sexualized, pro gay, penthouse with Long Island McMansion East Coast wealthy who call themselves conservatives. You don't realize how shallow that station is until you take a break from it. Don't get me wrong, MSNBC and all the rest are horrible and Fox is the best of them all...but that is not saying much. I do like Greta's show. She still asks pols some uncomfortable questions. But they have her on when most folks are eating dinner or just ate dinner and are doing something else. Putting Megan Kelly in that evening line up really has turned out to be a drag. Most men watch that airhead's show to see how much cleavage she will reveal. Why LE? I think the city police officers work for the Mayor and Town Council. That be the case, then why lay this “exception to enforce decision” on the backs of LE? Lay it where it belongs….lay it in the laps of the Mayor and Council Members. Furthermore, if anyone is going to get pissed off at someone for stopping kids from operating lemonade stands, then get pissed off at the Mayor and Council Members. They are the head honchos, the big dogs in charge, the bosses…. and the responsible individuals who control the actions by the city police officers. Make sense?

Somewhat. However, cops can choose to not go to a lemonade stand call as it is not a priority manner. Just like the cops ignore all the calls on the 4th of July where I live of people complaining of fireworks. They nicely tell the residents it's the 4th of July but don't worry we will send a car to check it out. They drive by the neighborhoods but don't stop. That seems to be a sane approach to kids who are trying to make a little money. It seems to me to be the Pharisee effect. The Pharisees complained Jesus Christ healed on the Sabbath. Selective enforcement. Instead, I say the Mayor and City Council should make exceptions for the lemonade stands and write the exceptions into the code.

Good find, but Martin Luther King had a similar quote, as did Henry David Thoreau and several others. The point is that the politicians and bureaucrats seems to have lost all common sense. Are we just going to sit here and take it because it's "the law"? That may have been the prudent approach in Nazi Germany or the Soviet Union, but not in America.
Times sure have changed, and not for the best, no sir. Yup. It's so sad. Those guys were our neighbors and our friends. I'm just surprised SWAT wasn't dispatched to "the scene of the crime" in this case. The acid from lemon is said to be very caustic, a potential "dirty bomb" so to speak.

Not really. What usually happens is some asshat that runs a nearby business sellign soft drinks,tea,and maybe even lemonade will rat the kids out by filing a formal complaint to the city about how THEY had to buy a business permit so the kids should get one,too. Which means they would have to provide public rest rooms,health inspectors,get a tax stamp,etc,etc,etc.
